z ;c MEMORANDUM OF MEETING Meeting between Duane Griffin, Building Official, and John Easter, 12/10/91: Mr Easter's building permit expired. As a result of my letter notifying him of the expiration, he requested this meeting to see what would have to be done to reinstate the permit when he obtains financing. I explained that the plans would have to be changed to meet ; the Energy Code and the Ventilation & Indoor Air Quality Code. It was agreed that if the actual structural part of the plans would not be substantially changed he would be charged only half the original permit fee and half the plan check fee when he resubmits, if he resubmits the original plans modified to meet the current codes. He also said he owned two lots side by side and there was a person interested in buying the lot that this set of plans applied to. Mr Easter wanted to know if he could use this same set of plans if he built the house on the adjoining lot. I told him a complete new permit with full permit fees would be required in that case because the plans would have to be routed through all city agencies again. He said he understood. VALUATION OF CONSTRUCTION Valuation for new construction and additions are calculated by the Department of Community Development prior to application submittal. Contact the Permit Coordinator at 431 -3670 prior to submitting application. In all cases, a valuation amount should be entered by the applicant. This figure will be reviewed and is subject to possible revision by the Building Division to comply with current fee schedules. BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is Issued within 180 days following the date of application shall expire by limitations. The building official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. I regret to inform you that your request for extension of the above referenced building permit cannot be extended because of the following reasons: a. The permit expired prior to your requesting an extension. Section 303(d), Uniform Building Code, states that building permits expire by limitation and become null and void if the work authorized by such permit is not commenced within 180 days from date of such permit. b. This section further states that "any permittee holding an unexpired permit may apply for an extension of the time within which he may commence work under that permit when he is unable to commence work within the time required by this section for good and satisfactory reasons." In this case, however, your permit had expired before you requested an extension. Also, the building code only allows for one extension not to exceed 180 days, and your request is for six to twelve months. c. The code further states that "to renew action on a permit after expiration, the permittee shall pay a new full permit fee." 2. Another reason for not granting your request for extension is that the State has mandated the enforcement of more stringent and additional building and construction codes since your permit was originally issued. Specifically these are the Washington State Energy Code and the Washington State Ventilation and Indoor Air Quality Code, both which became effective July 1, 1991. Since the plans submitted for your permit did not include the requirements of these new codes I do not feel it would be appropriate to extend your permit past the original expiration date. 3. It may be used for commercial buildings where appropriate. This form, or acceptable alternate calculations, must be completed for each dwelling unit. A separate copy shall be attached to each set of drawings submitted with the building permit application. Mike Easter addressed the Council with his proposal to build two single family homes at 4820 So. 150th Street. He noted that there are no large trees on the property. The houses would be built on what is now a pasture. In response to Council President Hernandez' question of urgency, he noted that to wait until after the moratorium expires, he will lose the ability to schedule sub - contractors for early summer and the interest rate is unstable. Councilman Moriwaki asked Mr. Easter if he would be willing to conform with the adopted SAO at his own risk and expense. Mr. Easter replied that regarding surface water management, he had assumed that he would have to put in some type of infiltration system to handle the downspouts. He commented that he wouldn't mind creating some water diversion or more extensive infiltration type systems, but if he has to put in a.400 foot storm drain, he might want to apply for some help. He stated.he would be willing to take care of any water he personally diverted. He commented that it is beneficial to the City to join in this program, and there is a very low risk in the way it is set up to start. We can modify the boundaries or get out of it easily. Our commitment at this time will help to hire an administrator and a consultant to put together a project list.
