Municipal Court Judge Jerry Belur administered the Oath of Office to Charles Simpson, appointed by Council to fill the unexpired council term of Mayor John Rants. Mayor Rants read a Proclamation designating January 20, 1992 as Martin Luther King, Jr. Day in Tukwila. Former Mayor Ed Bauch, 16603 53rd Ave. So. urged Council to join with the cities of Des Moines and Normandy park in donating $50,000 to the investigation of stopping the expansion of the third runway at SeaTac airport. According to Bauch increased traffic and plane take- offs will impact the newly annexed area of the City as well as surrounding neighborhoods. Elizabeth Springer, 13325 Macadam Road So., encouraged Council to declare Martin Luther King, Jr. Day an official City holiday. Ms. Springer agreed that the City should provide matching funds to help stop the SeaTac airport expansion. Ms. Springer spoke briefly on House Bill 1150 which would cut the term of office for port commissioners from 6 years to 4 years. MOVED BY ROBERTSON, SECONDED BY SIMPSON, TO DISCUSS THE RUNWAY ISSUE AND THE ALTERNATIVES THE CITY MIGHT PURSUE UNDER NEW BUSINESS. MOTION CARRIED. Sarah Skogland, General Manager, Southwest Chamber of Commerce, distributed copies of their 1991 Contracts Report and gave a brief overview of the chamber's performance to date of their agreement with the City. Councilmember Robertson suggested the report be forwarded to the Finance and Safety Committee. Councilmember Hernandez thanked the Chamber for hosting the Open House on January 16th at City Hall. a. b. CONSENT AGENDA IS APPROVED AS AMENDED. An overview of the progress of Vision Tukwila was given by Lora Fowler, project coordinator. Fowler reported that facilitator training has begun, and promotional materials have been completed and distributed. She urged the Mayor and Council to attend the community meetings and the review sessions that will follow. OLD BUSINESS Mayor Rants explained that several months ago the Council began a Draft Mitigation Provisions process to deal with the Rabanco project. It was the staff's direction to Rabanco get the most mitigation possible to protect the citizens of Tukwila from the impacts of the Rabanco project. Rick Beeler, DCD Director, briefed Council on staff's progress to date. He explained that intergovernmental cooperation and coordination between Tukwila and Renton are reflected in an agreement between the two cities. The mutually agreed upon timeframe for completing the agreement is January 21. Mr. Beeler stated he believes Tukwila has reached a reasonable and fair agreement with Renton that protects the short term and long term interests of the City. Mr. Beeler and Associate Planner Vern Umetsu reviewed the agreement at length with Council whose primary concerns were noise impacts and hours of operation. Traffic concerns were not part of the appeal. Council suggested several changes to the document. Mr. Beeler recommended Council authorize Mayor Rants and himself to complete the negotiations with Renton on Tuesday and work towards withdrawing Tukwila's appeal. Citizen Comment Tukwila resident Scott Nangle, 14140 56th Ave. So., President of the Black River Quarry Coalition, stated that most of the Coalition's interests were not included in the agreement; most everything has been geared to Tukwila. However, getting Renton to recognize Tukwila's noise ordinance should help to produce a better level of response for impulsive noises. Mr. Nangle also voiced his concern about the hours of operation. Council President Ekberg suggested that Mr. Beeler and Mr. Umetsu organize the requested changes /additions /deletions to the agreement and present them following the next agenda item. Back to Order Mayor Rants called the meeting back to order at 9:20 p.m. with Councilmembers in attendance as listed above. Regarding the SeaTac runway issue, Councilmember Robertson suggested the City of Des Moines be formally invited to attend the February 10th committee of the whole meeting. Scheduled on the agenda is the Puget Sound Air Transportation Committee with a Tukwila City Council Regular Meeting January 20, 1992 Page 3 New Business (con't) Citizen Comment REPORTS Old Business (cont) Rabanco Special Meeting Called presentation on The Future of SeaTac Airport. John McFarland added that a public hearing on the third runway is scheduled on February 13th at 7 p.m. at the SeaTac Red Lion Inn. Associate Planner Moira Bradshaw will track this issue. McFarland noted his concern that it could be premature to donate funds to this cause before knowing what the issues and options are. Joe Egan, 14438 Military Road So., commented that the third runway is actually a replacement of the short second runway. The FAA requires a 2500 foot separation between runways to use them both simultaneously during inclement weather. The second runway would be moved west, which would be away from Tukwila, to approximately 12th Ave. So. He suggested Council get thorough information on the runway before committing any funds. He believes a portion of the noise will actually be moved away from Tukwila. Council President Ekberg stated he would like to see more information presented prior to making any decision. Council agreed that the City of Des Moines be formally invited to give a presentation at the February 10th meeting. Councilmember Robertson reported he would be attending an all day program entitled Coping with Growth Management sponsored by the Washington State Bar Association on Friday. Councilmember Mullet urged everyone to support the schools on February 4th. Rick Beeler reviewed the requested changes to the Rabanco agreement as follows: 1) Page 3, #14 (Whereas): The word "governmental" should be changed to "Renton governmental"; 2) Page 4, Paragraph 2 (a) Other Permits and Approvals Required.: The agreement would be amended so that whatever permits or licenses Renton would issue on Rabanco, Tukwila would have review and comment. 3) Page 4, Paragraph 4: Modification to Revised Project Require Agreement: Within the document it be inserted that the City of Tukwila gets review and comment on adjustments that are being proposed. 4) Page 7, Paragraph 5: Hours of Operation: Four requested changes: (1) The hours of operation during weekdays be limited to 8a.m. -6 p.m. for production, with low impact activities from 6 -8 p.m. (2) Saturday hours be changed to 10 a.m. -4 p.m.; (3) The second sentence which begins "in the event that the maximum noise levels as established by Renton" should be changed to include Tukwila as applicable; (4) In the second sentence where it states "operation in the event that Rabanco is unable to mitigate the noise impacts" the sentence be changed to include pulling of the permit or license. Mr. Beeler explained that some of the issues Renton probably would not agree with. He felt Renton would argue the change on Page 3 (Whereas clause); however, Tukwila will try to argue that with the removal of the Coalition from this entire agreement it makes the agreement between Renton and Tukwila. It makes reasonable sense to use the words "Renton governmental Another area of disagreement may be the hours of operation. There is nothing in the EIS that would justify shortening the Saturday hours to 10 -4. Renton feels the noise study that's been done is very adequate. It was the consensus of the Council to call a Special Meeting for Wednesday, January 22, in the Public Works conference room to review the January 21 negotiations with the City of Renton.
