SPANG The City Attorney's Office has been asked to review the situation leading to your construction of a structure that encroaches upon the property of your neighbor. You received a letter from Duane Griffin, Tukwila's Building Official, dated August 29, 2001 wherein you were notified to cease work on the house you arc constructing at 14924 62 Avenue South because of the encroachment. The letter requested that you provide a survey prepared by a licensed land surveyor. You were given 30 calendar days from the date of the letter to provide the survey. After receipt of the stop work order, you had conversations with both Carol Lumb and Jack Pace, of the Department of Community Development, on possible options to resolve the setback violation. A copy of the property survey was included as part of the materials in an application for a short plat for the two parcels you own submitted on October 10, 2001. The short plat application was apparently submitted as a way to address the setback issue. In the interim, your property continues to encroach onto the property of your neighbor. Such a continuous encroachment constitutes a trespass upon the adjacent property. Although you have submitted a short plat application seeking a short plat approval that would effectively modify your yard configurations and also modify setback requirements, that application does not insulate you from potential liability for the continuing trespass. You should be aware that you continue to trespass upon your neighbor's property at this time at your own peril. Additionally, the encroachment constitutes a violation of City code. Such a violation must be corrected immediately. If the violation is not abated immediately, the City will seek legal redress. This means that you must, at a minimum, remove the structure from your neighbor's property immediately. You may disregard the stop work order only to the extent necessary for you to take measures to remove the encroachment. The City expects that the encroachment will be removed within the next two weeks. We will be looking at the issue of setbacks and the orientation of the lots to the access road as part of the short plat process. This may then affect whether the western setback of the house under construction is viewed as a front or side yard setback. The minimum lot size for new residential lots in Tukwila is 6500 square feet. The two parcels owned by the Kay /McGrath's are of sufficient size to divide into four lots. The short plat process in Tukwila is administrative, which means that it is reviewed by the Short Plat Committee (comprised of the appropriate City Departments) and does not go to the Planning Commission or City Council for review and approval. Public notice is not provided for short plats that create less than 5 lots. A decision by the Short Plat Committee is appealable to the City's Hearing Examiner. Steven M. DO 1 -076. This letter is a follow -up to our telephone conversation on August 6th and our meeting on July 23. 2001. In your letter, you request that a stop work be placed on the building permit (D01 -0076) that has been issued for construction of a house and garage on the parcel behind your property. As we discussed on the telephone. the City cannot stop the work until we receive a survey that indicates there is a problem with the location of the house that is under construction. The survey provided by the applicant indicates that the house is sited so as to meet the setbacks of the Low Density Residential district. You have contacted Schroeter Surveying to have the property corners identified on your property. When your rear property line has been established. I can come out with one of the building inspectors to determine the location of the new house in relation to your property line. Your letter states you believe the house /garage has been built illegally. The original building permit was issued for a garage, which is an accessory structure under the Low Density Residential district. A garage cannot stand alone on a parcel. but must be on the same lot as the house. The site plan submitted with the building permit application showed the proposed garage on the same parcel as the house. As we discussed at our meeting in July, as well as on the telephone, when it was discovered that the garage was located on a separate parcel from the house it was to serve, it was a violation of the zoning code. There are several possible remedies for this problem: consolidate the two lots so the garage is on the same parcel as the house; move the garage to the parcel with the house on it; convert the garage to a living structure with an associated garage. Since the garage was designed to be converted to a house some time in the future. the applicants opted to void the first building permit (D99 -0253) and apply for a new building permit for a house /garage (D01 -076). This is an acceptable solution to the City. You ask that the City consider changing the policy for residential permit applications to require the submittals to include a survey of the property. Molina August 9, 2001 surveys for single family residential permits for several reasons. First, surveys are expensive. typically running from $1,000 to $3,000 dollars. Second, most residential properties have been surveyed through some land development process, either formal subdivision or short platting. Frequently property lines are clearly defined through such features as fences. The issue of discrepancies in property line location has not been a frequent enough problem to justify requiring single family residential permits to go to the expense of submitting a survey.
