It appears that the City has issued building permits for several homes that do not meet the 50 Floor Area Ratio (FAR) standard required by the Tukwila Municipal Code. You now wish to build additional homes that would also violate the current standard. but have been denied permits for those additional homes. You have been intormed that the City is currently reviewing a proposed change to its zoning code that may resolve the situation. and have asked that consideration of the code amendment be accelerated. Unfortunately. the proposed change to this portion of the code is part of a larger issue (proper treatment of group homes) that will likely require a few months. rather than a few weeks to resolve. The proposed code changes are currently pending before the City's Planning Commission. At this point. the Commission has voiced its support for a new "building footprint" standard of 35% for lots of 6.500 or fewer square feet (this would replace the current 50 °1, FAR). Start' is now preparing ordinance language based on the Commission's direction. The Commission is expected to hold a public hearing on this matter and then forward a recommendation to the City Council. which also must conduct a public hearing before taking final action. Public notice and other procedural requirements will prevent us from acting as soon as you would like. There may be other options available to you. including revising your plans. seeking a refund of your application fees, or seeking a variance.
