Council President Steve Lawrence called the Committee of The
Whole Meeting of the Tukwila City Council to order and led the
audience in the Pledge of Allegiance.

It was the consensus of the Council to excuse
Councilmembers Hernandez and Simpson.
JOHN MCFARLAND, City Administrator; MIKE KENYON, City
Attorney; LUCY LAUTERBACH, Council Analyst; ROSS
EARNST/RON CAMERON DOUG MICHEAU, Public Works;
RICK BEELER/VERNON UMETSU, DCD; ALAN DOERSCHEL,
Finance.
It was the consensus of the Council to move "Cit i?en's Comments"
forward on the agenda to come before "Special P: entations."
None.
Council President Lawrence called the meeting back
to order with those present as listed above.
Lawrence suggested that discussions on the RTP be
postponed for one week. During that week invite
the community to submit written comments. Then, be prepared to
resume discussions at the next council meeting concentrating on
Tukwila's preferred option.
Paul Matsuoka, Corridor Planning Manager for Metro,
accompanied by Kevin Grigg, South Corridor Manager;
and Chris Deffebach, Capital Project Coordinator, gave a presentation
on the three alignment options to the regional transportation program.
Option 1 includes Interurban Avenue and I -405; Option 2, Shuttle
between SR99 and North Renton; and Option 3, Branch Line Service
to Tukwila and Renton. Matsuoka stated that a final EIS is planned to
be submitted by mid March of this year with a final plan being adopted
by April. All of this is in preparation for forming a regional transit
authority by the middle of this year. The regional transit authority
would then place this issue before the voters in the fall. Matsuoka said
this same presentation will be presented to as many subcounty cities as
possible. The goal of which is for all the cities to define what their
interests are and what their preferred alternative would be in order for
those cities to develop a consensus at the South King County
Transportation Benefit District (SKATBD). Once SKATBD agrees to
a recommendation, it will be forwarded to the joint regional policy
committee to feed into the regional discussion and ultimately into the
regional adopted final plan.
A discussion followed with questions being asked by the council, staff
and citizens. Questions focused on capital costs, ridership, service
areas, noise levels, travel time from various points and relationship to
land use plans for the options.
Councilmember Robertson requested that a copy of the alternative
analysis on Rainier Valley vs. East Marginal Way be sent to the
Council this week due to time restraints. Deffebach said the materials
will be sent to Lucy Lauterbach for distribution to City staff, Council
and any other interested parties.
Attorney Mike Kenyon stated that the Council has
already adopted the moratorium, but the 1992 session laws require
that in the event of a moratorium on any permitting or licensing issue,
a public hearing be held within sixty (60) days after the adoption of the

Public Hearing moratorium. Tonight's public hearing is only to
Moratorium on adult take public testimony, if there is any, on the
entertainment. moratorium not on the merits of the adult entertainment legislation
that the City will be proposing, or adult entertainment uses in general.
The moratorium is good for six (6) months and can be extended for
additional six months increments by additional affirmative action of
the council. Should it become necessary, a public hearing would have
to be held prior to each additional extension.
Council President Lawrence opened the public hearing at 9:05 p.m.
Anna Bernhard, 14241 59th South, commended the Council and
Attorney Kenyon for the work they've done on adult entertainment
moratorium. She urged the Council to continue to do whatever they
can to prohibit another establishment, such as this, to open in Tukwila.
Council President closed the public hearing at 9:10 p.m.
Attorney Kenyon stated that a draft of the Adult Entertainment
Moratorium Ordinance including findings and conclusions will be
submitted at the next Regular Council.

REPORTS
The Mayor stated that King County Council has
authorized and Tim Hill has signed the docun' to transfer the
Southgate property to the City of Tukwila. T roperty is located on
the east side of Pacific Highway South near 134th. The Mayor
recommended the Council's acceptance of this property. King County
Council has surplused the land under King County Ordinance #9350
and prepared a deed to transfer ownership to Tukwila. A formal
motion must be passed to accept this parcel of land.
It was the consensus of the Council to accept the Southgate property
transfer and forward to the next Regular Meeting Consent Agenda.
Councilmember Robertson suggested for clarification
that the "and" be replaced by "or" in the Maximum
Bldg. Height section, i.e. "1 story or 15 ft.: 2
stories or 25 ft. etc. In the "Maximum building length with bonus for
modulating off sets" section, replace the "and" with "or."
The Mayor said he will review with the attorney for procedure
compliance. If the changes do not conflict with procedure, they will
automatically be made. If there is a conflict, the ordinance will be
placed on next week's agenda for formal action.
Councilmember Lawrence reported that he had attended a meeting at
the City of Normandy Park. He was accompanied by Hernandez,
Robertson and Ekberg. The topic for discussion was the third runway.
Lawrence said the RCAA Organization will be discussing this issue
and making recommendations. The individual cities will be making
arrangements to bring it to their councils for further discussion.
Councilmember Robertson requested that the Mayor provide the
Council with a report on real estate consultants at the next Executive
Session.
Mayor Rants reported that if the background reports are received on
time, he should have a selection for the new city attorney by next
council meeting.
Councilmember Robertson requested a full week for review of the
new city attorney's credentials. He stated this is a crucial position and
adequate time should be allowed for review.

Mayor Rants informed Robertson that he has the option to ask
questions and if the answers are not satisfactory, the confirmation
process can be continued.
Robertson insisted on having adequate time for review of applications
of the new city attorney's position, while all other councilmember
preferred to go forward with the Mayor's suggestion.
After a brief discussion, it was the consensus of the Council, and the
Mayor agreed, to place all pertinent information regarding the new
city attorney in the councilmembers mail boxes by late Thursday
afternoon.
City Administrator McFarland reported on the abandoned house on
Foster Point. A letter was sent to the owner of the property. The
letter gives notice that legal action will be taken if he doesn't contact
the City Administration in a reasonable amount of time. A copy of the
letter was provided to the Council President and to the City Attorney.
McFarland also stated he was disappointed that delays associated with
getting the labor union contract ratified had prevented the City from
being able to formally observe Martin Luther King, Jr.'s Birthday this
year.
