Application and plans must be complete in order to be accepted for plan review. VALUATION OF CONSTRUCTION The valuation is for the work covered by this permit and must be filled in by the applicant. This figure is used for budget reporting purposes only and not to calculate your fees. BUILDING OWNER / AUTHORIZED AGENT If the applicant is other than the owner, registered architect/engineer, or contractor licensed by the State of Washington, a notarized letter from the property owner authorizing the agent to submit this permit application and obtain the permit will be required as part of this submittal. EXPIRATION OF PLAN REVIEW Applications for which no permit is Issued within 180 days following the date of application shall expire by limitation. The building official may extend the time for action by the applicant for a , period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Building Code (current edition). No application shall be extended more than once. As we discussed at our December 1, 1989 meeting with city staff, Puget Power staff and CENTRAC staff, the newly constructed storm drain on Nelson Place will not be usable until future sections are completed. A temporary connection was constructed to tie in with the existing storm drain along Nelson Place. However, the existing line is plugged at S. 158th Street and, thus, water ponds at the intersection. The roadway is failing as a result of this water damage. Ross Earnst committed to unplugging the line and draining the water into lines to the east provided that Puget Power would grant an easement. This is badly needed to protect the infrastructure of the road. Puget Power agreed to grant the easement and would send the City the appropriate permit. According to Wayne Bressler of Puget Power, this easement should be complete and available this week. With Nelson Place line unplugged the Hampton Inn storm water could be pumped into the Nelson Place line. It is our understanding that this work will proceed immediately, therefore, we will install our pump to allow site water to be pumped into the city system. This is consistent with past agreements and the construction of the storm drain as a condition of the development. It will be some time before the pump is installed so we anticipate no conflict with the City completing the work prior to us needing the connection. Responsibilities of Owner. A. New Street. Owner shall design, engineer and construct, at Owner's sole cost and expense, a new street, including curbs, gutter and storm drainage, meeting City standards for commercial streets from a point on West Valley Highway at Exit 1 to a point on Nelson Place located approximately 600 feet north of Longacres Way. H. Signalization. The City and Owner understand that the Washington State Department of Transportation is currently designing improvements to 1 -405 and West Valley Highway and as part of such design, and the improvements to be constructed thereafter, WSDOT will design and construct a fourth leg for the traffic signal located at the intersection of West Valley Highway and the new street to be constructed under paragraph A above. Owner agrees to assume all responsibility for the design, engineering, and construction costs of such signalization. C. Seventh Lane. The City and Owner understand that a seventh lane will be added to West Valley Highway by Owner in cooperation with WSDOT as part of its improvements in the area in order to facilitate ingress and egress to and from the new street to be constructed pursuant to paragraph A above. Owner agrees to assume all responsibility for design, engineering, and construction costs related to such seventh lane. Both parties understand that the seventh lane will be constructed from a location to be determined by WSDOT somewhere between South 158th and the new street and continuing to the 1-405 overpass. Owner shall design, engineer, and construct, at Owner's sole cost and expense, sidewalks meeting City standards at the following locations: (1) Along the northerly edge of the new street to be constructed pursuant to paragraph A above; and (2) Along the west property line of the Owner's property adjacent to West Valley Highway and running from the new street northerly to the I -405 overpass. E. Water Line Extension. Owner shall design, engineer, and construct at Owner's sole cost and expense, a twelve -inch diameter water main line from a tap located on the Nendel's Hotel property which will run across West Valley Highway to the east boundary, thence northerly and terminating at a point to be later determined on or about the hotel site. If the Embassy Suites development has extended the water line from Nendel's to its development, Owner need only extend such line to Owner's development to the point described above. Said water line shall be constructed to City standards and the location and design of the water line shall meet City approval. F. Nelson Place Improvements. Owner agrees to provide, at Owner's sole cost and expense, all design and engineering services necessary for the improvement of Nelson Place to City standards. G. Dedication of Improvements and Right of Way - Maintenance Bond. Upon completion of the new street and DEVELOPER'S AGREEMENT - Page 4 •o?ocI /Jvc sidewalks, the water line .extension, and the storm sewer line described in A.I., below, and approval of the same by the City, the Owner shall dedicate, assign, and convey to the City, free from any lien or encumbrance, the improvements to be made public, the real property upon which such improvements are to be located having already been dedicated to and accepted by the City. Also, at such time, Owner shall furnish to the City a bond or other suitable security in an amount approved by the Public Works Department of the City and in a form approved by the City Attorney, guaranteeing the new street, sidewalks, the water line extension and the storm drain line, if any, against defects in workmanship and materials for a period of one (1) year from the date of approval and acceptance of the same by the City. H. Future Storm Drainage LID. Owner acknowledges that Owner's development will have a cumulative impact on the storm drainage facilities in the area of Owner's property and that Owner's property would be specially benefitted by improvements to such facilities. Owner agrees to participate in any local improvement district or utility local improvement district which is formed for the purpose of storm drainage improvements as described in the KCM study of December, 1986 and the KCM Preliminary Design Report of June 28, 1988, and hereby waives the right to protest the formation of any such LID or ULID, provided that Owner retains the right to contest the method of DEVELOPER'S AGREEMENT - Page 5 0070CS /J ►C calculating assessments in such LID or ULID and the amount thereof to be levied against Owner's property. I. Storm Drainage System and Interim Design Reguirements. Per design criteria of the Longacres /Nelson • Place Storm Drain Preliminary Design Report by Kramer, Chin & Mayo, the Owner, at its sole cost and expense, will construct, in lieu of permament on -site detention facility, as a condition of receiving its final certificate of occupancy, a piped storm drainage system generally easterly along the new S. 156th Street then southerly along Nelson Place to hook up to that portion of Phase I as constructed or to be constructed by Embassy Suites and /or by public contract. Thereafter, the drainage will be in an open ditch and will extend to the north after passing under the Burlington Northern tracks. If at the time of development of impervious surfaces at S. 156th and /or the building site the portion of the system beyond the intersection of Nelson Place and S. 158th Street has not been completed, Owner will construct to City standards temporary detention facilities including flow restrictions in upstream manholes, temporary detention facilities in S. 156th Street, if required, until it is opened to traffic and detention systems on property, which will surcharge upstream drainage system, S. 156th Street, and Developer's property as necessary in order to reduce flows to undeveloped rate of discharge. In consideration of Owner's agreement to assuMe the design and engineering costs of bringing Nelson Place up to City standards, the City agrees that Owner shall have no responsibility with respect to the construction costs of such improvements. Nothing herein shall be construed, however, to relieve Owner of any responsibility for additional improvements to Nelson Place which may be constructed in the future. B. City will use its best efforts to obtain the necessary easements and construct the downstream storm drainage system in a timely manner. C. Benefited Area and Assessments - Facilities. The water line extension and the storm drain line to be constructed by Owner, will directly benefit certain property not owned by the Owner which cannot be legally described until the extent of the improvements has been determined, by enabling and facilitating development thereof. Pursuant to Chapter 35.91 RCW, the Owner agrees to develop a latecomers agreement, to be approved by the City, to reimburse Owner for its costs on a pro rata basis by assessing any owner of real estate located in the benefited area who does not contribute to the original cost of the facilities to be constructed by the Owner under this DEVELOPER'S AGREEMENT - Page 7 •0700 /J VC , Agreement and who subsequently taps into and /or uses said facilities. The agreement is to be developed when the extent and cost of the facilities are known. The pro rata share for any one parcel of real estate contained within the benefited area shall be computed by the Owner subject to approval by the City Engineer. The pro rata share for each parcel shall be shown on exhibits to be attached to the agreement. The City agrees to pay Owner all said sums collected within sixty (60) days after receipt thereof, less costs of administering the Agreement, until the total of said payments equals the cost of constructing the facility less Owner's pro rata share, or when fifteen (15) years from the date of the Agreement have elapsed, whichever shall occur first. 3. Time of Commencement and Completion. Construction of the new street and water line extension to be constructed by Owner under the terms of this Agreement shall commence within 365 days after this Agreement has been signed by both parties and shall be completed prior to issuance of any certificate of occupancy for the hotel. 4. Non - Waiver - Extensions. Failure of either party to insist on the strict performance of any of the terms of this Agreement shall not be construed as a waiver or relinquishment of that party's right thereafter to strictly enforce any such term, but the same shall continue in full force and effect. DEVELOPER'S AGREEMENT - Page 8 5. Binding Effect. This Agreement shall be binding upon the parties, their respective heirs, legal representatives, assignees, transferees and successors. 6. Recording. This Agreement shall be recorded with the King County Auditor as required by Chapter 35.91 RCW and the cost of said recording shall be paid by the Owner. 7. Attorney's Fees. In the event that either party shall commence litigation against the other in order to enforce any term or condition of this Agreement, the prevailing party in such litigation shall be entitled to recover its costs, including reasonable attorney's fees. 8. Entire Agreement. This Agreement contains the entire understanding between the parties hereto, and no other agreements, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to exist or to bind any of the parties hereto or to have any other force or effect.
