BACKGROUND

Shall the City Council approve increases in the permit fees for Building, Mechanical, Plumbing,
and Fuel -gas piping permits, such that there are incremental increases scheduled through each
year of the code change cycle.
The Unifoun Building Code was published on a three year cycle. Each code change included an
increase in their published fee schedule. Prior to 1991 there had been no increase in the fee
schedule for two code cycles. Upon publishing of the 1997 UBC, I.C.B.O. included a 14
increase in their fee schedule. The pellnit fees remained unchanged for six years. The adoption
of the International codes brought an increase of approximately 22% to the fee schedules. These
were significant increases made at each code change cycle.
Previously the permit fee schedules were adopted as presented in the Codes. The authors of the
International codes do not include fee schedules in the administration section of their codes.
Permit fees are left to be established by the governing authority. To date we have adopted the
fee schedule format that was used by ICBO and increased the fees by the ICBO methodology.
DISCUSSION /ANALYSIS /ALTERNATIVES
Our system of permit fees and plan review fees do not recover the cost of the administration and
inspections for each permit. The intent of these fees is to recover some of the costs incurred in
the issuance of each permit. Currently, the rising cost of code administration is exceeding our
recovery rate. The proposed fee increase is intended to reflect the increase in cost to the City.
A historic analysis of the published schedules shows that there was an increase of approximately
4% per each year of the code cycle. This would be an incremental and predictable increase if it
were to be employed annually by the proposed ordinance.

Alternatives.
Do nothing, and remain with the current fee schedule through 2008 and 2009 and adopt
the 2009 International codes with no overall increase in the fee schedules.
Amend TMC Section 16.04.250 "Schedule of Permit Fees" to include a 4% increase in
the fee schedules, effective January 2008 with an increase of 4% each year thereafter.
Amend TMC Section 16.04.250 "Schedule of Permit Fees to include a 4% increase in the
Fee schedules effective January 2008 through 2009.
RECOMMENDATION
Approve the proposed ordinance that would provide for a 4% increase in the permit fees for
Building, Mechanical, Plumbing, and Fuel -gas piping permits for the years 2008 and 2009.
Review the issue of fee increases in conjunction with the Code adoption process.
Forward this recommendation to the November 26, 2007 COW for approval.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON; AMENDING ORDINANCE NO. 2171; AS CODIFIED AT
TUKWILA MUNICIPAL CODE CHAPTER 16.04, SECTION 16.04.250
"SCHEDULE OF PERMIT FEES ADOPTING NEW PERMIT FEE
SCHEDULES FOR BUILDING, MECHANICAL, PLUMBING, AND FUEL
GAS PIPING PERMITS. PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFrECTIVE DATE.
WHEREAS, a permit shall not be valid until the fees prescribed by law have been
paid; and
WHEREAS, it has been four years since the current permit fee schedules were
established; and
WHEREAS, the City Council desires to increase cost recovery rate for permit
administration and inspections for 2008 and 2009; and
WHEREAS, the City Council desires to index the cost of providing permit
administration and inspection services to the increase costs incurred by the City; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. TMC Section 16.04.250 Amended. Ordinance No. 2171, as codified at
TMC Chapter 16.04 "Buildings and Construction" is hereby amended to read as
follows:

the permit fee and is in addition to the permit fee.

Work without a permit Any person who commences electrical work before obtaining
the necessary permits shall be subject to twice the established fees as set forth in the
electrical fee schedule or increased by $100, whichever is greater. This fee, which shall
constitute an investigation fee, shall be imposed and collected in all cases, whether or
not a permit is subsequently issued.
H Fee Refunds. The Building Official may refund any permit fee paid by the original pemit
applicant that was erroneously paid or collected. The Building Official may also authorize the
refund of not more than 80 of the permit fee when no work has been done under a permit
issued in accordance with the code. Where a plan review fee has been collected, no refund will be
authorized once it has been determined that the plan review process has commenced. Refund of
any permit fee paid shall be requested by the original permittee in writing and not later than one
hundred and eighty (180) days after the date of fee payment.
Section 2. Ordinance No. 2171 is hereby amended.
Section 3. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to arty person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 4. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force five days
after passage and publication as provided by law.

B. Plan Review Fee: When submittal documents are required by IBC
Section 108 or IRC Section R108, a plan review fee shall be paid at the time of
submitting plans and specifications for review. The plan review fee shall be 65%
of the permit fee as set forth in the permit fee schedule. The plan review fee
specified herein is a separate fee from the permit fee and is in addition to the
permit fee.
1. Inspections outside normal business hours: $60 per hour (two -hour
minimum charge).
2. Re- inspection fee: $60 per hour, assessed upon call for third
inspection of same correction notice.
3. Inspections for which no fee is specifically indicated: $60. per hour
(1/2 -hour minimum charge).
