ORDINANCE NO 396
AN ORDINANCE relating to health and sanitation and
defining litter, refuse, garbage, rubbish, ashes, dead animals,
industrial refuse, commercial waste; and regulating the throwing,
depositing and accumulating of litter; requiring the use of public
receptacles and disposal sites provided therefor and providing
penalties for violation, and
WHEREAS, the City Council of the City of Tukwila, Washington
deem it necessary for the protection of life, health, safety, and
general welfare of the inhabitants of the City of Tukwila ego enact
measures to govern the disposal of litter;
NOW, THEREFORE:
The City Council of the Cityof Tukwila do ordain as follows:
Section 1. DEFINITIONS.
The following definitions shall apply in the interpretation
and enforcement of this resolution:
A. Litter- -The term "Litter" as used herein means and in-
cludes refuse, rubbish, ashes, garbage, dead animals, industrial
refuse, commercial waste, and all other waste material of every
kind and description.
B. Refuse- -The term "Refuse" shall include garbage, rubbish,
ashes, dead animals, and all other putrescible and non putrescible
wastes, except sewage and human body wastes.
C. Garbage -The term "Garbage" shall mean all putrescible
wastes, except sewage and human body wastes, recognized industrial
by- products and dead animals.

D. Rubbish- -The term "Rubbish" shall mean all non- putre-
scible wastes except ashes and recognized industrial by- products.
Includes tree branches, twigs, grass and shrub clippings, weeds,
leaves, and general residential yard and garden waste materials.
E. Ashes -The term "Ashes" shall mean the solid waste
products left after combustion of coal, wood, other fuels, or other
combustible materials.
F. Dead Animals- -The term "Dead Animals" shall mean small
animals such as dogs, cats, rabbits, squirrels, rats, etc. that are
deceased.
G. Industrial Refuse -The term "Industrial Refuse" shall
mean solid waste materials, putrescible and non putrescible, from
factories, processing plants, farms, businesses, and commercial
establishments.
H. Commercial Waste -The term "commercial Waste" shall
mean liquid and semi liquid waste materials, putrescible and non
putrescible, from factories, water craft, processing plants, farms,
businesses, commercial establishments, and any non used by- product
of a manufacturer or industrial plant and /or sludge and sewage.
Section 2.
It shall be unlawful to place, throw, deposit, or otherwise
dispose of litter in any public place, public road, public park, on
any private property; or in the waters within Tukwila except as pro-
vided in section 3, or at the official refuse disposal facilities.
Section 3.
It shall be unlawful for the owners or occupants of private
property to deposit or accumulate; or to permit the deposit or accu-
mulation of, litter upon such private property; provided however,
that this shall not prohibit the storage of garbage or rubbish in

public or private litter receptacles, when approved by the Health
Officer or in garbage cans or in securely tied bundles when such
garbage cans or bundles are for immediate disposal; provided further
that the use of a compost pile or bin shall not be prohibited if the
use and maintenance thereof is in such a manner as to prevent the
attraction, breeding and /or harboring of insects and rodents. Any
such use permitted here under shall not be construed to permit a
nuisance as defined by state law.
Section 4.
The storage of refuse, garbage, dead animals, and other put-
rescible and non putrescible waste shall be in containers constructed
and maintained so as to prevent leakage, rodent and insect infestation
and other public health hazards until removed to official disposal
sites. Any other type of storage and disposal must be approved by
the King County Health Officer.
Section 5.
It shall be unlawful for any person, firm or corporation to
haul refuse, garbage, rubbish, dead animals, ashes, or any other
waste material of the kind herein defined in this resolution on the
highways and roads in Tukwila unless such materials are properly
stored, covered and otherwise secured so as to prevent spillage or
"littering
Section 6. PENALTIES.
Any person convicted of a violation of any of the terms of
this ordinance shall be punished by a fine not to exceed THREE HUNDRED
DOLLARS ($300.00), or by imprisonment in the City Jail for a period
not to exceed 90 days, or both such fine and imprisonment. Each and
every violation of the provisions of this ordinance shall constitute
a separate offense.

Section 7.
This ordinance shall take effect five days from and after
its date of publication.
Section 8.
If any section, subsection, paragraph, sentence or clause,
or phase of this ordinance is declared unconstitutional or invalid
for any reason, such decision shall not affect the validity of the
remaining portions of this ordinance.
Section 9.
This ordinance shall be known as the Tukwila Refuse Ordinance
and may be cited as such.
