SPECIAL MEETING Tukwila City Hall
Mayor Todd led the Pledge of Allegiance and called the
Special Meeting of the Tukwila City Council to order.
CRAIN, STERLING, HILL, GARDNER. MOVED BY HILL, SECONDED,
BY STERLING TO EXCUSE THE ABSENT COUNCILMEN. CARRIED.
Mayor Todd requested Council to examine the present
situation that has developed on the construction of a
commercial building being built by Cabot, Cabot Forbes
within the industrial area of the city (Andover Pk. E.
and Minkler Blvd.), stating that a building permit has
not been issued due to a requirement that a sidewalk be
constructed as part of the approved plan as recommended
by the Planning Department and accepted by the Plann-
ing Commission. He then read from the Tukwila Municipal
Code, Sec. 18.32.040 (Architectural Control).
Councilman Sterling inquired as to whether anyone else
had put in sidewalks,with Steve Hall, Public Works
Director answering that there had been only one.
Sterling asked of there were any retail outlets within
the structure. Mr. Jim King, representing the contracto]
stated that it was strictly commercial, no retail. He
further added that the non issuance of the permit is
now holding up the project on just the issue of the
sidewalk, which may be appealed before the Board of
Appeals at a later date in September. He requested
relief of this situation as is was causing a great
hardship and laying -off of personnel on the project.
Councilman Hill stated that if the city does not now hav(
requirements for sidewalks, that a plan should be
developed for the future. Mr. Hall noted that within
existing covenants of city projects a clause has been
added stating that the developer will not oppose any
future LID's for sidewalks.
Mayor Todd requested that Council give their permission
to issue(the building permit and the sidewalks would
be considered at a later date if in fact the contractor
should appeal.
Councilman Hill questioned the effect upon parking and
landscaping. Mr. Hall stated that these matters would
be worked our before hand or the building permit could
be issued with a restrainer clause.
Councilman Gardner asked how many buildings in the area
had sidewalks. Mr. Hall stating that most all were
developed without them.
Councilman Crain stated that he felt that the Planning
Commission acted in good faith and would like to see
their recommendation, but was not adverse to this action
MOVED BY CRAIN, SECONDED BY GARDNER TO ISSUE THE BUILDING
PERMIT BUT WITHHOLD THE OCCUPANCY PERMIT UNTIL THE
SIDEWALK ISSUE IS RESOLVED. CARRIED. There being no
further business before the Council, it was MOVED BY HIL:
SECONDED BY STERLING THAT THE MEETING ADJOURN. CARRIED.
