FLAG SALUTE AND CALL Mayor Todd led the Pledge of Allegiance and called the
TO ORDER meeting of the Tukwila City Council to order.
Councilman Stevens noted a correction to be made on
page 5 under "Personnel Committee 9th line, change
from "Sterling" to "Stevens Councilman Traynor noted
that he asked that the matter of bulletin boards be
placed in Committee not Council. MOVED BY STEVENS,
SECONDED BY STERLING, THAT THE MINUTES OF 9 -4 -73 BE
APPROVED AS AMENDED. CARRIED.
MOVED BY STEVENS, SECONDED BY HILL, THAT PROPOSED
RESOLUTION BE READ. CARRIED. Attorney Parker read
Resolution authorizing the Mayor to fill the position
of firefighter, utilizing funds allocated by Public
Employment Program. MOVED BY STEVENS, SECONDED BY
CRAIN TO ADOPT RESOLUTION #370 AS READ. The motion
CARRIED with Councilman Traynor voting "no
MOVED BY TRAYNOR, SECONDED BY STEVENS, TO TABLE THIS
MATTER AND NOTIFY THE ARCHITECT TO HAVE A REPRESENTA-
TIVE PRESENT. CARRIED.
Councilman Johanson stated that he would like to wait
for the final report before it is read into the
record. MOVED BY HILL, SECONDED BY CRAIN, TO MAKE
COPIES AVAILABLE AT CITY HALL. Councilman Johanson
stated that he feels there are certain corrections to
be made before the report is made public. He then
read paragraph 2 under Audit Findings and noted that
he is not in agreement with the statement. Councilman
Sterling moved to comment back to the auditor, on this
matter, and make the final report available to the
public. Councilman Hill suggested that all the
Councilmen have their comments in by Friday and the
City Clerk can mail them to the auditor. Councilman
Crain suggested that they draft one letter for all
the Councilmen to sign and send in. MOVED BY STEVENS,
SECONDED BY JOHANSON, TO DELETE THE FORMER MOTION.
CARRIED. Councilman Sterling moved to have a Finance
Committee Meeting on Tuesday the llth of September
at 7:00 p.m. to discuss this matter.
Councilman Traynor recited a section of R.C.W. 35.24.210
"No Ordinance and no resolution or order shall have
any validity or effect unless passed by the votes of
at least four Councilmen." He then questioned the
Attorney as to clarification as to whether this means
4 Councilmen in favor or 4 Councilmen voting.
Discussion followed between Council, Attorney and
Mayor regarding an interpretation of this R.C.W. and
valadity of previous votes. City Attorney, Wayne Parker
stated that it is his opinion that if 4 members
constitute a quorem, then it takes 4 votes to pass an
Ordinance or Resolution. Councilman Traynor asked that
the Attorney check into this and give Council an
opinion. Attorney Parker stated that he has found no
cases on this matter and will have to check further.
MOVED BY TRAYNOR, SECONDED BY STEVENS, TO TABLE THIS
TO THE NEXT MEETING AND GIVE THE ATTORNEY TIME TO
INVESTIGATE THIS MATTER. CARRIED.
Mayor Todd read a letter from John Fotheringham,
Superintendent of Schools. Mr. Fotheringham's letter
stated that he met with the South Central School Board
of Directors and proposed that the lower three acres
be considered as a future recreational park involving

the City of Tukwila as leasee and developer. The
letter further stated that he is now prepared to
discuss this matter in further detail, or would be
receptive to any proposal the City might have for
utilization of that particular acreage. Councilman
Traynor agreed to meet with Mr. Fotheringham and the
Mayor on this. The Mayor noted that he will set up a
meeting date and notify Councilman Traynor. Councilman
Crain noted that if a Recreational Director were hired,
the City should get input from that person in relation
to this property. Mayor Todd noted that the City would
only be leasing the property at this time.
Mayor Todd read a letter from Fire Chief, Hubert
Crawley, asking that Council formally accept for use
the listed donations to their Aid Car Fund. Mayor Todd
noted that this would have to be done by Resolution
and further noted that the Rotary is also donating
$300.00 to the Aid Car and that this should be
included when the Resolution is drawn. MOVED BY STEVENS
SECONDED BY JOHANSON, TO DRAFT RESOLUTION TO ACCEPT
THE DONATIONS. CARRIED.
Councilman Sterling read a letter from Mrs. Chas.
Claybaugh. The letter noted the litter problem created
by horses within the City and stated that she feels
horses should be banned from certain areas and
licensed the same as dogs and cats. Mayor Todd noted
that on Sept. 9th, a horse and colt were the cause
of an accident near the church, involving a car. He
further stated that some definite action must be
taken as they are also creating a health hazard.
Councilman Johanson questioned the Attorney on the
matter of licensing horses. Attorney Parker stated
that by Statute the City can license cats dogs but
can not license livestock. Councilman Hill noted that
the Code does designate certain areas where horses
are to be kept. Mayor Todd stated that an Ordinance
was drafted at one time but was not passed. Field
Superintendent, Gene Isler stated that if they used
the bridle trail it would be acceptable, but stated
that they go through other areas in the Park. He
also noted that his crews can't keep up with the horse
litter on the streets. Councilman Johanson stated
that if horses were banned from the streets that the
City should offer something in exchange as a recreational
outlet for the children. After further discussion, it
was suggested by Councilman Sterling that this matter
be referred to the Police Committee.
City Clerk, Shirlee Kinney suggested the possability of
obtaining a glass enclosed and lighted bulletin board
to be placed in front of City Hall. Councilman Stevens
also noted that there might be a possibility of having
a public information center in the Fire Station.
Mayor Todd asked Chief Sheets the status of the Police
Service agreement with King County, for the use of the
County jail for housing Tukwila prisoners prior to
the issuance of a warrant for their arrest. Police
Chief, John Sheets stated that the County started
billing the City for this service in February. He
stated that he requested an opinion from the Attorney
General as he felt that they were State prisoners
until they were charged and the County jails must
house those prisoners. He further stated that he found
that the prisoners do not become State prisoners until
the warrant has been filed and noted that this would
cost the City an additional $15,000.00 $16,000.00
per year to house these prisoners thru King County.
Discussion followed after which Chief Sheets described
the process of filing and charging the prisoners.
Councilman Sterling stated that he feels it would be
better to go ahead with the agreement. Mayor Todd
added that this item would be placed on the agenda.

Public Works Director, Steve Hall noted that there will
be a work meeting on the llth and also two pre
construction meetings, 2:00 p.m. on the Tennis Courts
and 4:00 p.m. on Signalization, Strander Boulevard
and Southcenter Parkway. He also noted that the bid
opening on L.I.D. #22 will be Wednesday the 12th and
L.I.D. #21 will be Thursday the 13th.
Councilman Sterling asked if the cost for side sewers
has been reduced. Steve Hall stated that it is $75
for single residence plus $20 inspection fee. Attorney
Parker stated that the Ordinance sets the charge and
in order to reduce the cost, the Ordinance would have
to be amended.
Councilman Sterling stated that there are some election
signs on public property and noted that this is against
the sign code and the code should be enforced.
Mayor Todd stated that he has been in contact with the
Department of Elections and Records and that if any
candidate gets 91% of the votes in the Primary, he
or she will be in by acclamation.
Councilman Traynor asked if it would be possible to
hold Public Hearings at the 2nd 4th meeting of every
month at 7:00 p.m. thereby reducing the length of
meetings. City Clerk, Shirlee Kinney stating that
there is no reason they couldn't be scheduled in that
manner.
Councilman Traynor asked that a meeting of the
Buildings and Public Grounds Committee be held after
the Council Meeting.
Personnel Officer, Jim Fraser discussed the salary
wage study and stated that all is in order and will
discuss further at the Work Meeting on Tuesday the
llth. Mayor Todd requested that he be allowed to
retain Mr. Fraser for an additional one or two weeks
until the position of Administrative Assistant is
filled. Council concurred.
MOVED BY STEVENS, SECONDED BY STERLING, THAT THE
MEETING ADJOURN. CARRIED.
