Start: 6:20 p.m. Mayor Haggerton announced the purpose of the Executive Session is to discuss: Collective Bargaining — Pursuant to RCW 42.30.140(4)(a) It will last no more than 35 minutes, and no decisions will be made during the Executive Session. End: 6:53 p.m. CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:02 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie, Dennis Robertson, De'Sean Quinn, Allan Ekberg, Verna Seal, Kathy Hougardy, and Kate Kruller. SPECIAL PRESENTATIONS a. Introduction of two new Police Department Records Specialists: Jonathan Long and Chandra Reiter. Bruce Linton, Assistant Police Chief Bruce Linton, Assistant Police Chief, introduced Jonathan Long to the City Council. Mr. Long moved to Tukwila when he was 11 years old and comes to the City with dispatch experience. Mr. Long expressed his excitement at working for the City and the opportunity to serve the community. Assistant Chief Linton introduced Chandra Reiter who comes to Tukwila with both Police department experience and multiple degrees involving health related studies. Ms. Reiter relayed that she is happy to be here and looks forward to working in the City. Mr. Long and Ms. Reiter will be welcome additions to the Police Records Office. The Mayor and Councilmembers welcomed Mr. Long and Ms. Reiter. Tukwila City Council Regular Meeting Minutes April 7, 2014 Page 2 of 9 b. Code Enforcement Update. Jack Pace, Community Development Director Mayor Haggerton explained the City vision expresses that Tukwila will provide services that support a safe, inviting and healthy environment for residents, businesses and guests. In response to community and Council feedback, he is pleased to provide an action plan for neighborhood cleanup in the year 2014. It has been designed to provide resources to residents to make the process easy and hassle -free. Mayor Haggerton introduced Jack Pace, Community Development Director, who will provide an overview of the plan. Mr. Pace and Kathy Stetson, Code Enforcement Officer, utilized a Powerpoint presentation to provide an update on Code Enforcement and the new action plan for neighborhood cleanup, with the following key points. Response to Community Concerns • Streamline code enforcement process • Add temporary staffing • Involve the community Streamline Process • Immediately issue Notice of Violation when property owners fail to comply with initial correction notice • Shorten compliance deadlines • Initiate abatement actions • Monitor and report back to Council • Create Abatement Triage team Add Temporary Staffing • Contract .5 FTE Code Enforcement Officer • Reassign Administrative Support as Acting Code Enforcement Officer who will focus solely on residential nuisance abatement • Hire full -time administrative support • Require rental inspections be performed only by private inspectors Community Involvement • Community -wide "Spring Clean -Up" — First weekend of June (tentative) — Site dumpsters in neighborhoods to encourage disposal of debris — Junk vehicle removal effort • Institute "free dump pass" program for code enforcement cases Next Steps • Community Affairs and Parks Committee briefing and site tour: April 29, 2014 • Long -term changes for 2015 -2016 Budget The Councilmembers asked clarifying questions of Mr. Pace and Ms. Stetson and thanked them for the presentation and commended the Mayor and City administration for this code enforcement action plan. Sharon Mann, 4452 South 160th Street, expressed excitement at this plan as the community's image has long been a priority for the City. Staff has put together a great program, and it is her hope that a firmer hand will be applied regarding code enforcement violations. She referenced an individual who came to a Council meeting regarding code enforcement issues. She stressed the importance of the Council backing up the staff regarding those who violate the code. She also feels that if mandatory garbage pickup was in effect, it would provide relief from some of the violations. Councilmember Robertson conveyed that it has been beneficial for the Council to refrain from making what could be construed as negative remarks to those who come to speak under citizen comments. The Council encourages public comments and would not want anyone to feel attacked or discouraged from Tukwila City Council Regular Meeting Minutes April 7, 2014 Page 3 of 9 sharing their viewpoints. It is also important to perform fact - finding and get all the information before providing a response. Mayor Haggerton encouraged the staff to provide 6 month updates on the progress of the program. PROCLAMATIONS /APPOINTMENTS a. Proclamations: (1) A proclamation declaring April 6 -13, 2014 as National Volunteer Week. Mayor Haggerton read a proclamation declaring April 6 -13, 2014 as National Volunteer week, acknowledging that volunteers are vital to our future as The City of Opportunity and the Community of Choice." (2) A proclamation declaring April 9, 2014 as Arbor Day. Mayor Haggerton read a proclamation declaring April 9, 2014 as Arbor Day and encouraging citizens to plant trees to gladden the heart and promote the well -being of this and future generations. (3) A proclamation declaring April 22, 2014 as Earth Day. . Mayor Haggerton read a proclamation declaring April 22, 2014 as Earth Day which offers citizens and governments alike an opportunity to work toward a healthier and cleaner environment. The Mayor presented the 3 proclamations to Robert Eaton, Parks Superintendent. Mr. Eaton thanked the Mayor for the proclamations and extended an invitation to all to the Arbor Day tree planting on April 9, 2014 at the Tukwila Community Center at 1:00 p.m. Children participating in the City's spring break camp will be contributing to the event. b. Appointments /Reappointments: Community- Oriented Policing Citizens Advisory Board (COPCAB) • Confirm the reappointment of Kim Karnes to Position #2 on the Community- Oriented Policing Citizens Advisory Board, with a term expiring 3/31/18. MOVED BY QUINN, SECONDED BY SEAL TO CONFIRM THE REAPPOINTMENT OF KIM KARNES TO POSITION #2 ON THE COMMUNITY - ORIENTED POLICING CITIZENS ADVISORY BOARD, WITH A TERM EXPIRING 3/31/18.* Ms. Karnes was in attendance and the Mayor and Councilmembers thanked her for her commitment. *MOTION CARRIED 7 -0. • Confirm the reappointment of Jerry Thornton to Position #4 on the Community- Oriented Policing Citizens Advisory Board, with a term expiring 3/31/18. Human Services Advisory Board • Confirm the reappointment of Sharon Kidd to Position #5 on the Human Services Advisory Board, with a term expiring 4/30/17. CITIZEN COMMENTS Robert Neuffer, 13813 37th Avenue South, described an incident at the Tukwila Pool on March 31 during a male -only swim, where he told a female lifeguard to leave during that period as it was inappropriate. He and his son finished their swim and nothing came of it. This past Friday he received a letter that said he had used the "F" word to pool staff during that incident. He relayed that he did not say that and would take a polygraph test. In his view this is retaliation due to his views regarding things going on at the pool. Due to the single gender swim programs, people are being asked to leave the facility because of the way they were born. Christine Neuffer, 13813 37th Avenue South, referenced the letter her husband received and questions the leadership in Parks and Recreation and a culture that targets citizens and resists change and positive transformation. From her standpoint, there are issues with the staff at the pool and concerns regarding a quality customer experience. She and her husband have used the public records request process to receive documents, and opposition to their presence has occurred after the requests were filed. They will continue to observe the activities at the pool and others have agreed to assist in that effort. Irma Buckwalter, 13832 37th Avenue South, said that she spoke against single gender swim at a Council meeting approximately 2 months ago. While she was going home that evening, there was a car driving in front of her that slowed down near her house, looked inside the house and parked in the driveway. The driver sped away as she was approached. Ms. Buckwalter was fearful and called the police and feels she was being intimidated for speaking against single gender swim. Jacqueline Carroll, 16241 49th Avenue South, submitted a written comment regarding issues at the Tukwila Pool and the negative impacts. The City Clerk stated that the comment would be distributed to the Mayor and City Council after the meeting. CONSENT AGENDA a. Approval of Minutes: 3/17/14 (Regular Mtg.); 3/24/14 (Special Mtg.) b. Approval of Vouchers: #365909- 366033, #140401 in the amount of $1,096,394.72 c. Accept as complete the 2013 Small Drainage Program Project (contract #13 -151) with Henderson Partners, LLC; authorize release of retainage subject to the standard claim and lien release procedures (final cost of project, including retainage: $307,233.51). Mayor Mayor Haggerton reported that on March 28, 2014, there was a fire at the Boulevard Apartments that displaced 67 residents. There was also a fire on March 30 at Riverside Residences that displaced 80 people. Additionally, there was also a residential fire this past weekend. The displaced individuals, amounting to 40 -50 people, were accommodated at the Tukwila Community Center with the help of the Red Cross. Food and cots were provided and the collaboration between the Red Cross and Parks and Recreation staff was exceptional in serving community members during this difficult time. The Mayor accompanied Tukwila's Emergency Operations Manager, Marty Grisham, to the Oso mudslide area on April 6, 2014 as part of the delivery of supplies. Tukwila is assisting in the recovery and cleanup effort and has a 5- member team from the Fire Department on site. Matt Hickey from Tukwila's team is in charge of the communications system at Oso, as he has been for other disaster recovery events. The American Flag that is flying from a tree at the recovery site was provided by the City of Tukwila. We will continue to do everything we can to help the community members in and around Oso. When the firefighters return, they can provide an after action report to the City Council. Mayor Haggerton asked the Council President to provide the names of 2 Councilmembers to be involved in a trip to Washington D.C. with the Mayor and 1 staff member on May 20, 2014 that could last for 2 -3 days. This would involve a general update to the federal officials, as well as essential conversations regarding the City's application for a TIGER 6 grant for the Strander Boulevard extension and BNSF (Burlington Northern Santa Fe railroad). Additionally, the Mayor found out this past Friday that the City's federal lobbyists from Ball Janik will be in Tukwila on April 15, 2014. It would be helpful if the 2 Councilmembers that will be traveling to Washington D.C. could be available to meet with the lobbyists from 4:00 -5:00 p.m. on April 15. At 5:00 p.m., all Councilmembers are invited to meet with the federal lobbyists at Billy Baroos at the Foster Golf Course. Council President Quinn expressed this is a tight timeline, and he will follow up with the Mayor. Tukwila City Council Regular Meeting Minutes April 7, 2014 Page 8 of 9 b. City Council Councilmember Duffie relayed pride at the work done by the Fire and Parks and Recreation staff relating to the assistance provided to displaced residents due to multiple fires. Additionally, he expressed appreciation for the work done by the Fire team at Oso. Mr. Duffie referenced that Bruce Linton, Assistant Police Chief, has also been involved in this effort by flying the Governor in and out of the site at Oso. He asked Assistant Chief Linton to come forward and provide an overview of the efforts. Assistant Chief Linton stated that he is the Aviation Brigade Commander for the Washington Army National Guard. His team has transported officials and dignitaries who needed to see the incident area at Oso. Over the past several weekends, they have been actively engaged in facilitating moves that included the Governor, Congressmen, the Homeland Security Secretary, FEMA Administrator, and the entire senatorial contingent, and others as needed. He is proud to serve with hundreds of other National Guard members in this important effort. The Mayor thanked Assistant Chief Linton for his contributions. Council President Quinn reported that he provided the Mayor and administration with the Councilmember names for committees and was also reassured by the City Administrator that the citizen requests will be responded to with some form of communication. Councilmember Ekberg relayed appreciation to the Department of Community Development staff for the Southcenter Plan workshop on April 3, 2014. Councilmember Hougardy recently attended the plays at the high school and middle school. It was announced that the CASTT performances that are sponsored by the City of Tukwila will be forthcoming, and they have put out a call for actors. Ms. Hougardy said she was in Georgia last week and it is clear that the Oso tragedy has touched the entire nation. Councilmember Kruller attended the Law, Safety and Justice Meeting on March 28, 2014 that included prosecutors and judges. The discussion focused on marijuana laws for the state with a focus on how easy it is to become addicted early. She reported that Councilmembers Ekberg, Quinn, Seal and herself were involved in the Strike - Out - Against Hunger bowl -a -thon event that supported the Tukwila Food Pantry. During that event a moment of silence was taken for the people involved in the Oso mudslide. Additionally, she attended the VROOM event sponsored by the Bezos Foundation, which focused on the greatest learning curve for children at age 0 -5. Studies show that disadvantaged children are greatly impacted during this time period due to a lack of mental and language stimulation. On April 2, 2014 she participated in the King County Caucus Transportation Policy Board, which evaluates projects for grants. Tukwila came in third and she commended Bob Giberson, Public Works Director, and his team. On April 3 she attended the Southcenter Plan workshop, commending the Department of Community Development for a well- written document. On April 4, as part of her role on the King Conservation District Advisory Committee, she worked with staff from Sound Cities Association (SCA) to harmonize outreach to cities and ensure appropriate processes are followed. On April 5 she attended the TPAC (Tukwila Pool Advisory Committee) meeting and is always impressed with this group of citizens. c. Staff In the absence of the City Administrator, the Mayor referenced the City Administrator Report in the packet and offered to answer any questions. d. City Attorney Shelley Kerslake, City Attorney, said she was asked to prepare a legal opinion regarding conflicts of interest, which is now complete. She had a request from Councilmember Ekberg to hold off on providing that opinion to the Council until the MPD's attorney had an opportunity to review the matter and render an opinion. She talked with Brian Snure, the MPD Attorney, and he is on vacation and will not be able to render an opinion for approximately 2 weeks. She would like input on whether there was a majority of the Council who wants her to wait on issuing the opinion. Tukwila City Council Regular Meeting Minutes April 7, 2014 Page 9 of 9 Council discussion ensued on this matter with concern being expressed that it would be helpful for both attorneys to work out any differences to minimize unnecessary conflict. Ms. Kerslake explained that due to attorney client privilege laws and rules of professional conduct, she could share her analysis with Mr. Snure and not her conclusions or advice to the Council. It was the consensus of the City Council that the legal opinion could be rendered to the full Council at this time. e. Intergovernmental There was no report. MISCELLANEOUS Councilmember Kruller visited the Oso site on March 31, 2014 and talked with the Tukwila team and community members in the area. The American Red Cross sent her an email thanking her for coming and indicated they would be interested in working with the City to determine if partnerships could be formed regarding emergency preparedness for large disasters. She would like to see this pursued by City administration. She reported that the Utilities Committee met on March 17, 2014 and reconsidered the idea of mandatory garbage collection, which is very well explained in the minutes. It is notable that approximately 25% of Tukwila citizens do not participate in the garbage collection program. This topic was not advanced to the Committee of the Whole as the Committee did not find it necessary to require all citizens to participate in mandatory garbage collection.
