Mayor Todd led the Pledge of Allegiance and called the meeting of
the Tukwila City Council to crder.
GARDNER, STEVENS, TRAYNOR, STERLING, DAVIS, HARRIS, SAUL.
MOVED BY TRAYNOR, SECONDED BY STERLING TO APPROVE THE MINUTES OF
JANUARY 21, 1974 SUBJECT TO APPROVAL OF AMENDMENT BY COUNCILWOMAN
DAVIS VERBATIM COMMENTS WITH THE CITY ATTORNEY. CARRIED.

Committee comments:
If you have no personal financial interest otherwise in any of
these sites then you can vote on them. The fact that you served
on the Planning Commission in my opinion does not disqualify you
on that. Whether cr not you have a personal interest in it, if
you have such an interest so state and disqualify yourself, if you
have none, go ahead and vote.
It was stated at the time in the Planning Commission that after
stating what I had felt, that I was feeling and talking as a
citizen that night, that voting as a Council member would be
questioned. You don't feel this?
I think when we're all called upon to make decisions on this thing,
we may have made up our minds ahead of time. When you serve cn a
jury and you take in new evidence and have to have an open mind in
receiving that and your disqualified there if you have heard some-
thing, but I don't see how its possible if you serve on the City
Council and not have heard some of these things. They may not
have expressed an opinion before but I don't think expressing your
opinion will disqualify you.
Could I have that in writing?
Ho.
Why?
My secretary is working her fingers to the bone putting everything
in writing. It is just impossible to do. We have to eliminate
some of these things. So that's one we're going to eliminate. If
I gave legal opinions to everyone in the City of Tukwila it would
be impossible.
Councilman Gardner read a letter from Steve Hall, Public Works
Director recommending that the joint usage connection between the
Independent Water Co. and the City of Tukwila be maintained and
further requested that Council notify him of their intentions as
to the continuation or possible changes within the existing agree-
ment. His letter additionally informed Council that the survey of
the Independent Water Co. performed by Philip M. Botch and Assoc.
will be available in the near future.
Councilman Traynor asked if the agreement met with approval of the
City Attorney; Attorney Parker answering yes. MOVED BY TRAYNOR,
SECONDED BY STERLING THAT THE CITY ENTER INTO THIS AGREEMENT FOR
PROFESSIONAL SERVICES WITH PHILIP M. BOTCH AND ASSOCIATES, INC.*
Councilman Gardner asked if this was only for one specific job or
for any job. Steve Hall answered that it was only for the inter
tie with Water District #75. Councilwoman Harris requested more
time to study the agreement with Mayor Todd stating that it was
also his recommendation that this matter be acted upon at this
meeting, Council having the opportunity to study this agreement
over the previous weekend. Councilman Sterling noted that the new
Councilmembers are perhaps not quite as aware of current matters as
are the older members. *ROLL CALL VOTE: 6 AYE: GARDNER, STEVENS,
TRAYNOR, STERLING, DAVIS, SAUL 1 NC: HARRIS. MOTION CARRIED.
Attorney Parker presented his written opinion as requested by the
Council and stated that final determination of this matter would be
the Council's action. Councilman Traynor stated that the ordin-
ances codified within the Tukwila Code Book are enacted by the

Council and should be enforced by the Council, he further added
that he felt Benaroya should be asking for a varience per his
interpretation of the Code, therefore, MOVED BY TRAYNOR, SECONDED
BY SAUL THAT THE REQUEST OF BENAROYA BE DENIED AND THAT THEY GO
BEFORE THE PLANNING COMMISSION AND REQUEST VARIENCE.* Councilman
Sterling agreed with Councilman. Traynor's comments and stated that
he thought that the City Attorney's opinion was to address itself
to whether or not a varience is needed in this matter. Councilman
Saul was of the same opinion. Voting on the motion, *CARRIED.
MOVED BY TRAYNOR, SECONDED BY STEVENS THAT THE CLAIM FOR DAMAGES
BY LEO SHAHON BE DENIED AND REFERRED TO THE CITY'S INSURANCE
CARRIER. MOTION CARRIED with Councilman Sterling voting NO and
Councilwoman Harris voting No, stating her no vote was based upon
the wording of the motion, she felt the matter should have only
been referred, not denied and referred.
Councilman Saul inquired as to the status of the Board of Adjust-
ment, directing his question to Committee Chairman Harris.
Councilwoman Harris stated that information on this subject is
forthcoming from Mr. Kinsey at the Association of Washington Cities
and that as soon as the Committee can review this information and
make recommendation, it will. Councilman Saul stated that he
would like to meet as a Council of the Whole to discuss this matter
of a reduced Planning Commission and establishment of a Board of
Adjustment to get the matter resolved. It was noted by Councilman
Traynor that a Council of the Whole meeting could not be called as
sufficient notification of such meeting could not be made.
MOVED BY TRAYNOR, SECONDED BY STEVENS THAT THE AGENDA BE AMENDED
TO CONSIDER CLAIMS FCR DAMAGES. CARRIED.
MOVED BY TRAYNOR, SECONDED BY STERLING TO REFER THE CLAIMS OF
WILLIAM F. UPHAM AND MIDORI TANABE TO THE INSURANCE CARRIER OF
THE CITY. CARRIED.
Verbatim Transcritt:
Due to the fact my work load down at the plant has increased and
the fact that everything' seems to be getting tied up into Committee
meetings and there are more meetings than I can attend, at this
time I would like to resign from the Council and turn in my
resignation. I would like to submit as my successor a name for you
to think about Mr. George Hill, who was very active and very use-
ful to this City. And I feel anyone appointed to the Council
should be a person who at least had enough courage to run for
election and show his interest in the City. At this time I would
like to resign from the Council due to personal reasons and the
fact my job is taking more time than I can give to this job. I
enjoyed working on the Council and with all the City employees and
the Mayor and I'm sorry I have to leave but due to these reasons I
feel I must resign.
Mayor Todd:
Art, I'm sorry to hear that your of that opinion and you can't hang
around here and continue the good work you've done in the past on
the Council and I am very sorry to see this happen. I appreciate
your comments.
Councilman Traynor:
I would like to say one thing. I've had Mr. Stevens setting on my
right hand here for the last two years, good or bad, he has been
on my right hand and I would like to say I hate to see him go. I
appreciate the part he played at our end of the table down there.
Mayor Todd stated that it was now up to the Council to appoint a
replacement as they see fit. Councilman Traynor called for an
executive session of the Council immediately following the meeting
to discuss what procedures to follow in this matter.
Mary Lehto, Record Chronicle questioned if elected officials were
subject to executive session, she further stated that she thought

that discussion on the nominees were of a private nature. She
added that if the Council so wished, she would prepare an article
asking for nominees to submit their resume's to the City. Council-
man Traynor agreed. Councilman Gardner stated that he didn't think
that an executive session could be held on elected officials.
George Hill asked if the Investment Committee had made its report.
Councilman Traynor answered there was no report this month. Mr.
Hill stated that there had not been a repert to his knowledge since
November.
Councilwoman Harris noted that the Community Affairs Committee
would not be meeting this week.
Mayor Todd distributed a letter written by himself addressed to
the Editor of the Highline Times, Mrs. Catherine Harris and all
Councilmen. Councilwoman Harris read the letter re: statements
purportedly made by Mrs. Harris to a writer for the Highline
Times as published in the Wednesday, January 23, 1974 issue.
Councilman Gardner stated that he was not aware that everything
coming before the Council was going to go to a committee. 'PI
thought only things that we did not have enough information on."
Mayor Todd stated that there is a bog -down in committee of matters
that could and have been handled prior to this time by prompt
Council action. He further stated that he "thinks it is time to
get down to serious business of running the City and not attempting
to run each other."
Councilman Gardner referred to an article in the Record Chronicle
re: the zip code being a frustration to the Mayor. He stated that
it has been a frustration to many people. "If all people in the
City were to use the post office we would have been able to keep a
post office of the first class." He then referred to a letter from
Mr. James Symbol noting the amount of dollars that need to go thru
a post office to keep it first class. Mayor Todd stated that he
has contacted many people in his effort to gain a single zip code
for the City as have past Mayors and he is still trying. Council-
man Gardner suggested that a three man committee be established to
try and obtain a single zip code.
MOVED BY STEVENS, SECONDED BY TRAYNOR THAT THE MEETING ADJOURN.
