HomeMy WebLinkAboutOrd 0390 - LID #2 (Local Improvement District) - Assessment Roll LevyCITY OF TUKWILA, WASHINGGTON ORDINANCE NO. 390 AN ORDINANCE approving and confirming the assessments and assessment roll of Enlarged Local Improvement District No. 2, which has been created and established for the purpose of paying a part of the cost of carrying out certain improvements, betterments and expansion of the water distribution system of the City as adopted in Ordinance No. 319, and the assessments and assessment roll of Enlarged Local Improvement District No. 3, which has been created and established for the purpose of paying a part of the cost of carrying out a scheme or plan for acquiring and construct- ing a system of sewerage, including a system of sewers, outfalls, works, plants and facilities for sewage treatment and dis- posal, all to become a part of the water- works utility of the City as s%ecified and adopted by Ordinance No.320,nevying and assessing the amounts thereof against the several lots, tracts, parcels of land and other property shown on said rolls. WHEREAS, the assessment rolls levying the special assessments against properties located in Enlarged Local Improvement District No. 2 in the Town (now City) of Tukwila, Washington, created under Ordinance No. 319, and in Enlarged Local Improvement District No. 3 in the Town (now City) of Tukwila, Washington, created under Ordinance No. 321, have been filed with the City Clerk of the City of Tukwila, as provided by law; and WHEREAS, notice of the time and place of hearings thereon and of making objections and protests to said rolls was duly published at and for the time and in the manner provided by law, fixing the time and place of hearings thereon for the 16th day of September, 1963, at the hour of 8 :00 o'clock p.m. (PDST) in the Council Chambers of the City Hall, 59th Avenue south 147th, Tukwila, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said rolls; and WHEREAS, at the time and place fixed and designated in said notice, the hearings on said assessment rolls were duly held and the City Council continued the hearings until the 7th day of October, 1963, at the regular meeting of the City Council then to be held in the City Hall, WHEREAS, one formal protest to the assessment roll was filed prior to the time and place of the hearing by Mr. Lee R. Phillips against the assessments on Mr. Phillips properties tax lots 19 and 17, contained in Local Improvement District No. 2, and WHEREAS, at the time and place set for said hearing the City Council considered said written protest and, after hearing all of the statements of all the persons present to be heard, deter- mined that the protest of Lee R. Phillips, as to tax lot 17 should be denied, and Lee R. Phillips withdrew his objection to the assessment on tax lot 19. THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON DO ORDAIN as follows: Section 1. That the assessments and assessment roll of Enlarged Local Improvement District No. 2, which has been created and established for the purpose of paying a part of the cost of certain improvements, betterments and expansion of the water distribution system of the City as adopted and ordered to be carried out by Ordinance No. 319, as the same now stated, be and the same is hereby in all things and respects approved and confirmed in the total amount of $97,324.71. Section 2. That the assessments and assessment roll of Enlarged Local Improvement District No. 3, which has been created and established for the purpose of paying a part of the cost of carrying out a scheme or plan for acquiring and constructing a system of sewerage, including a system of sewers, outfalls, works, plants and facilities for sewage treatment and disposal, all to become a part of the waterworks utility of the City, as specified and adopted by Ordinance No. 320 and ordered to be carried out by Ordinance No. 321, as the same now stands, be and the same is hereby in all things and respects approved and confirmed in the amount of $64,719.15. Section 3. That each of the lots, tracts, parcels of land and other property shown upon the said rolls, is hereby determined and declared to be specially benefited by said improve- ments in at least the amount charged against the same and the assessments appearing against the same is in proportion to the several assessments appearing upon said rolls. There is hereby levied and assessed against each lot, tract, parcel of landand other property appearing upon said rolls the amount finally charged against the same thereon. Section 4. That the assessment rolls as approved and confirmed shall be filed with the Treasurer of the City of Tukwila for collection and that said City Treasurer is hereby authorized and directed to publish notice as required by law stating that said rolls are in her hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at any time within 30 days from the date of the first publication of said notice without penalty, interest or cost, and that there- after the sum remaining unpaid may be paid in ten (10) equal annual installments with interest thereon hereby fixed at the rate of 5 per cent per annum. The first installment of assessments on 3 said assessment rolls shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid after the first 30 -day period, interest upon the whole unpaid sum shall be charged at the rate of 5 1/2 per cent per annum and each year thereafter one of said installments, together with interest due on the whole of the unpaid balance, shall be collected. Any installment not paid prior to the expiration of the said 30 day period during which such installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at 5 1/2 per cent per annum and for an additional charge of 5 per cent penalty levied upon both principal and interest due upon such installment or install- ments. The collection of such delinquent installments will be enforced in the manner provided by law. PASSED by the City Council at a regular meeting thereof and approved by the Mayor of the City of Tukwila, Washington, this 21st day of October, 1963.
