REGULAR MEETING FLAG SALUTE AND CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS MINUTE APPROVAL ORDINANCES AND RESOLUTIONS Res. #443, Authorizing Mayor to execute an agreement re: Law E Justice Planning M I N U T E S 76 S Tukwila City Hall Council Chambers Mayor Todd led the Pledge of Allegiance and called the meeting of the Tukwila City Council to order at 8:20 P.M. GARDNER, STERLING, TRAYNOR, DAVIS, HARRIS, JOHANSON. MOVED BY TRAYNOR, SECONDED BY DAVIS, THAT ABSENT COUNCIL- MAN SAUL BE EXCUSED. CARRIED. MOVED BY TRAYNOR, SECONDED BY STERLING, TO POSTPONE APPROVAL OF THE JULY 1, 1974 MINUTES UNTIL JULY 15 COUNCIL MEETING. CARRIED. MOVED BY TRAYNOR, SECONDED BY JOHANSON, THAT PROPOSED RESOLUTION BE READ. CARRIED. Attorney Parker read pro- posed resolution authorizing the Mayor to execute an agreement with King County regarding Law and Justice Planning and the distribution of certain law enforcement assistance funds. MOVED BY TRAYNOR, SECONDED BY STERL- ING, THAT RES. #443 BE ADOPTED AS READ.* Councilwoman Harris asked for a brief synopsis of the agreement. Police Chief Sheets reviewed the proposal in which LEAA will handle funding for several suburban cities. The intentions are sincere for better long -range planning, but there are some drawbacks. This agreement is to as- sist us in our own long -range planning and we are able to withdraw from the agreement in the future if we are dissatisfied. Councilwoman Davis asked for the Chief's recommendation. Chief Sheets stated he would like to give it a try. It will not cost the City any money since the funds are taken from a block grant and the participating cities receive the remainder. Councilman Johanson asked about the 7% application. Chief Sheets stated there is 7% of the grant available for special improvement projects. Councilman Sterling asked what other cities are involved. Chief Sheets stated Tukwila is in the group of smaller cities because of population, such as Black Diamond. Kent and Renton will do their own planning. Councilman Sterling stated he objected to "big brother" telling us we need help and he will be glad to provide it for us. Is there any other source of funding available if we need it? Chief Sheets repliec no, the block grant is the only funding for the purpose of greater cooperation between communities. He stated he believes there are very good applications for func- tional cooperation with it. Mayor Todd stated if the City does not agree to this proposal, our chances of getting any new funding made available some time in the future will be restricted because we did not agree to cooperate with this. We will be caught short if we are not a part of this planning program or if we do not have our own long -range planning program. Chief Sheets agreed, stating we need to have more community hearings about the law enforcement programs which can only result in better understanding. Councilman Sterling stated he is confident the Tukwila Police can do their own long range planning. Councilwoman Davis asked who the repre- sentative for Tukwila would be. Mayor Todd stated he assumed it would be the Mayor from each city. Council- man Sterling stated he could see where this would be of help to the smaller cities which are less advantaged, but he felt Tukwila could do the job itself. Councilwo- man Harris read a memorandum from Dennis English, Legis- lative Assistant of the Operations and Judiciary Commit- tee, King County, to Councilman Paul Barden, Chairman of the Committee, dated June 18, 1974 regarding additional information about the planning program (a copy of the memorandum is on file in the City Clerk's office). Coun- cilwoman Harris also referred to Lines 18 through 21 of the Agreement which stated the small cities, under 10,00( population, will collectively select two representatives. *MOTION CARRIED, WITH STERLING VOTING NO. Proposed ordinance Amending Title 18 of the Tukwila Municipal Code CORRESPONDENCE AND CURRENT BUSINESS Letter of Council- man Johanson regarding recall Letter of Attorney Parker regarding recall DEPARTMENT AND COMMITTEE REPORTS City Treasurer's report of Investments AUDIENCE COMMENTS Eleanor McLester Anna Bernhard Eleanor McLester Tennis Courts 7" Mayor Todd read a memo from Gary Kucinski, Planning Dir- ector, stating the appropriate action for the Council is to refer the proposed ordinance to the Planning Commis- sion for public hearings and review. MOVED BY TRAYNOR, SECONDED BY JOHANSON, THAT PROPOSED ORDINANCE AMENDING TITLE 18 OF THE TUKWILA MUNICIPAL CODE GRANTING TO THE BOARD OF ADJUSTMENT CERTAIN FUNCTIONS WHICH HAVE PREVI- OUSLY BEEN PERFORMED BY THE PLANNING COMMISSION BE RE- FERRED TO THE PLANNING COMMISSION. CARRIED. City Clerk Shirlee Kinney read the letter of instruction to include Councilman Johanson's letter on the Agenda signed by Councilmen Sterling and Johanson. Attorney Parker read the letter addressed to him from Councilman Johanson (a copy of this letter is on file in the City Clerk's office). Attorney Parker read his reply to Councilman Johanson's letter, stating he did not appreciate taking his time away from the Sammamish case to reply (a copy of this letter is on file in the City Clerk's office). Councilman Traynor read the report of Investments for the month submitted by City Treasurer Mae Harris. Mrs. McLester asked if it would be proper to comment on Attorney Parker's letter of reply to Councilman Johanson. Mayor Todd stated he did not think it would be appropri- ate. Councilwoman Davis stated the citizens' comments should be heard. Councilman Johanson stated he felt it was public discussion. Mrs. McLester then addressed her comments to the City Attorney. She stated the City At- torney delivered the petitions to King County because the City Clerk had asked him to do so. If the City Clerk asked him to babysit, would he take that duty on too? She stated she felt the City Attorney would make a better mailman than a City Attorney. She stated when the City Attorney stated he did not want to become in- volved, he did in fact become involved when he deliver- ed the charges to King County. She stated he has used his time on the public recall petition. She stated he stated that Councilman Johanson's request for advice was appalling; Mrs. McLester felt the Attorney's involve- ment in the recall already is appalling. She stated he is completely involved by his previous actions. Mrs. McLester felt the Attorney's advice was incompetent, in- complete and inadequate to the total Council from the beginning from this citizen's point of view. Mrs. Bernhard stated that Mrs. McLester was not present at the Council meetings during the time those Council Members' actions resulted in the citizens' recall. How can she make these comments when she did not attend those meetings? Mrs. McLester stated she was commenting on the Attorney's letter only. Steve Hall, Public Works Director, reported the new ten- nis courts are almost ready and asked Mrs. Anne Altmayer to serve the first ball over the net on opening day. The City Council met with the Mayor in Executive Session to discuss the Police Contract for 1975.
