SPECIAL MEETING SUBJECT FLAG SALUTE AND CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS DISCUSSION LID #26 M I N U T E S X 7 9 Tukwila City Hall Council Chambers Mayor Todd introduced Renton City Councilman Dick Stredicke, who led the Pledge of Allegiance, and called the meeting to order. GARDNER, STERLING, TRAYNOR, DAVIS, HARRIS, SAUL, JOHANSON City Clerk Shirlee Kinney read the legal public notice of the meeting. Steve Hall, Public Works Director, presented a brief background on LID #26 which is former LID #23. LID #23 had been voted down late last year and several requests recently have been received to re -form the LID. The City of Tukwila set up petitions for the LID which were circulated and received by the City June 13, 1974. The petitions were tallied and received 69.4% favorable votes which were sufficient according to R.C.W. 35.43.120 and on June 17, 1974, Ord. #868 was approved to form LID #26. Steve Hall then reviewed the area of LID #26 on the map. Mr. Glen Justice, 16452 51st Ave. So., stated his pro- perty was on 164th, would it be involved? Steve Hall replied yes, in ULID #6. Mr. Ernest Onorati, 5102 So. 163rd, asked if any area is excluded out of this. Steve Hall replied there is a portion excluded North of 160th extended from 51st down to 53rd which is already served by a major interceptor. Mr. Onorati asked about the portion to the East. Steve Hall stated it is included in the LID down to I -5 right of -way. Mr. Justice stated he was told he would be charged back 200 feet on his property. Why? Steve Hall explained the method of computing assessments by the square foot and by the zone and termini methods. Mr. Justice stated he is beyond the reach of the sewer system due to the grade, would he have to pay anyway? Steve Hall replied he would pay only the square foot charge. Mrs. Ethelmae Cole, 16030 Slst Ave. So., stated her pro- perty is at 16030 and 16036 and there is no way it can be served by hooking into 51st. If the sewer goes in, she will have to go to 160th. Why is she being charged for the frontage when she cannot hook it. She stated she is also still mad about the rockery Val Vue knocked out and has not been replaced. Steve Hall agreed there is access on 160th and suggested she call him the next day and he would contact Val Vue about the rockery. Mr. George Leeds, 5207 So. 164th, asked how soon would the work begin. Steve Hall stated it will be winter construction because construction drawings have yet to be received, bids must be called for and approved, etc. Mr. Onorati asked why the difference between Tukwila and King County requirements to hook up and the difference in charges. Steve Hall stated it depends upon the individual ordinances in effect. Within the cost of an LID in Tukwila, there is a stub fee. There is a regular connection charge of $75 plus $20 inspection fee for residences. Mayor Todd stated revenue bonding obliga- tions also make a difference. Mr. Onorati asked about the time limit to hook into the LID. With King County, you may never have to hook in, but there is a 90 day limit in Tukwila. If the McMicken group does not hook in, the system is useless. If you do not hook up, you will be charg- ed the connection fees anyway. Special dispensations are provided in the case of bad weather unless a health condition is involved. Mr. Onorati asked what the health conditions are with this. Steve Hall replied the King County Health Department would have that infor- mation. Mr. Onorati stated he called and was told they did not know of anything. He stated his point is if the McMicken people do not hook in, it will affect the sew- age problem, although he does not think there is one. We will have accomplished nothing with the LID. Mrs. Pack, 5149 So. 164th, stated there is sewage leak- ing into the street and down the street and in the back of her property where her dog had dug a hole. It smells really bad. Mr. Dick Kirsop, 16816 53rd Ave. So., stated there is drainage from the area by his house which smells pretty rank most of the year and he can testify there is a health problem involved. Mr. Justice stated he believed the problem would be eliminated if McMicken will hook in. Mr. Kirsop stated once the sewers are in, the Health Department will be able to apply more pressure. Mr. Justice stated he did not know of any pressure to be brought about. Mr. Kirsop stated the complaints to the Health Department will have some real meat when the sewers are available. They would be able to force people to hook in or else force them out of their houses. Mr. Justice stated the area should be condemned and forced to hook up 100 Mr. Al Pieper, 17083 53rd Ave. So., stated he has dis- cussed the health problem with the Health Department. He was told you do not have to hook up, but if there is a sewer out there and if there is a problem, they will red tag your house and if you still refuse, you will go to jail. Mrs. Pack stated there are some who have hooked on to the storm drain outside of the City limits. Mr. Justice asked what assurance is there that we will not have to go all through this again in 5 or 10 years. Mayor Todd stated we would have to rely on the construc- tion engineer's ability to provide for the growth in the area and other factors. Mr. Justice stated he paid $1,000 recently for a new septic tank as required by the Health Department. They do have authority. Mrs. Dharlene West asked about the schedule for paying assessments. Can you make time payments? Val Vue laid the sewer in the street and we were notified to pay within 30 days without interest. That sewer is not usable now. Why should we pay now before it is accept- able for us to use to save the interest? Steve Hall stated the City of Tukwila will complete and accept the facility first, then a final tally of the costs on the final assessment roll, have a public hearing, and then we will request our financial advisors to set up a bond- ing program. You can pay cash in 30 days or on the ten year period annually. Interest is about 7% or 8% now. Tukwila City Council Special Meeting July 29, 1974 Page 3 DISCUSSION Cont. 7 8/ City Treasurer Mae Harris stated after the final assess- ment roll, you can pay the total without interest in 30 days or pay any portion of it; one year later, you will get a bill, pay 10% and make payments over the next 10 or 12 years. Mrs. Cole asked if she would be assessed across Slst. Steve Hall replied she would be assessed on the frontage of her property. The charge will be either on 51st or on the back or the average of both. He stated he would check with Yoshida to avoid duplication of charges. Mayor Todd stated there is still time to register pro- tests after the preliminary assessment roll. Mrs. Audrey Kirsop asked if the line would go through on 53rd or along the right -of -way. Steve Hall stated it would run along the back part of the property at the freeway fence. The area will be served by gravity. The engineers are required to take photos of the area before work is begun and to restore it to its original condition. Mr. Leeds stated you are using the health problems to accelerate the procedure. Mayor Todd stated the mains and stubs will be available at the same time and the minute they are accepted, you can hook up. Councilman Sterling asked Mrs. Cole if she had paid an assessment on a previous LID. Mrs. Cole stated she had not, but Val Vue had installed a stub which she cannot use and knocked down the rockery. Mr. Ed Bauch, 16603 53rd Ave. So., stated when LID #23 was formed, the City gave us a price in writing. This time we have been told the cost will be about 10% higher and we have not received any written notices of the costs. Steve Hall stated if the bids come in over 10% of the original costs, then we are required to go back to the people in the LID to see if they are willing to pay for it and have it installed. Mrs. West asked how the rights -of -way are acquired and how they are paid for. Mayor Todd stated an appraisor will negotiate a fair market value with the property owner. If the settlement is not acceptable, then it goes into condemnation where the court decides a settle- ment. Mrs. West asked when would she know the route of the right -of -way. Steve Hall replied the engineer chooses a right -of -way agent but the routes are now fairly well fixed as they are. Mr. Onorati stated these rights -of -way could be widened and used for pedestrian and bicycle paths. Mayor Todd stated the right -of -way may be used only for sewers. Councilwoman Davis asked how soon will the roads be re- stored and is there something in the agreement covering this. Mayor Todd stated we cannot answer to the time in restoring the streets because of the labor strikes going on now. Under these conditions, the contract may not be enforceable. It is of benefit to the contractor to complete the work as soon as possible though. Steve Hall stated we will have careful control over the streets which will be kept graded or graveled during construction. The streets will be overlaid in the spring. Mr. William Gorjance, 16604 53rd Ave. So., stated there has been a history of slides in his area; who will be Tukwila City Council Special Meeting July 29, 1974 Page 4 DISCUSSION Cont. liable if the line breaks. Mayor Todd replied Val Vue will acquire the lines and assume the responsibility. Mr. Gorjance asked about the line if the slide origin- ates from the freeway. Councilman Johanson stated Val Vue would repair the damage and go to the State Highway Department for redress. In any case, the lines must be maintained from a health standpoint. Councilman Gardner stated the preliminary assessment roll was sent out a year ago on LID #23. Are we re- quired to send out a new preliminary assessment roll? Mayor Todd replied yes. Steve Hall stated it is the same as the last one. Mayor Todd asked the audience if they had received a new preliminary assessment. The group replied no. Mr. Onorati stated he would like to have a map, a state- ment of monthly costs and a copy of the preliminary assessment roll. Councilwoman Harris asked if LID #26 contains the same property as LID #23. Steve Hall replied no. Council- woman Harris asked if some of the homeowners have changed. Mr. Onorati stated some have changed and there is one new house. Councilwoman Harris asked if there are increases over 10% over last year. This is a new LID and we should hold a public hearing, send out a new preliminary assessment roll and start all over with it. Mayor Todd stated if the costs are 10% or less, a new preliminary assessment roll is not necessary. Steve Hall stated according to Attorney Parker, there is no need to begin this LID all over again since it commenced with a petition and not by resolution as LID #23 was. Councilwoman Harris asked City Treasurer Mae Harris if the homeowner does not pay cash for his assessment, is he required to get his own financing? Mae Harris re- plied at the end of the 30 day period, all cash payments are credited against the final assessment roll and the remainder is financed by bonds. A ten year period re- tired the bonds with interest. The homeowner is billed once a year for one -tenth of the principle plus interest on the unpaid balance. Mr. Pieper stated it is administered exactly like real estate taxes. Councilman Gardner asked what amount will be applied to the LID from grants. Steve Hall stated 90% on the mains by E.P.A. and D.O.E. Councilman Gardner asked if Val Vue will pay 15% on the rest. Steve Hall replied yes. Mr. Onorati stated he read in the Highline Times that only $300,000 will be given by the Department of Ecology and that Val Vue will pick up only 5% of it. This comes to about $12.50 a foot. This is going to cost us a fortune. Councilman Gardner stated the north end adjacent to an existing sewer main is paying its share of $28,000. Mr. Kirsop asked Steve Hall to review the boundaries of LID #26 and to point out the lines which will be in- stalled under this contract. Steve Hall reviewed the maps. Councilman Sterling asked for an explanation of the 5% Val Vue will be paying will they pay directly or take care of the charges. Steve Hall replied they will amortize the cost through monthly sewer charges. Tukwila City Council Special Meeting July 29, 1974 Page 5 DISCUSSION Cont. ATTEST: Councilman Gardner asked if the City Attorney had stated it was not necessary to hold a public hearing on this. Mayor Todd stated yes, because of the petition method of forming the LID. Councilwoman Harris stated the roads in McMicken Heights are in bad shape now. What type of contract does Val Vue have with the firm that is building the road and when will it be re- established. Steve Hall stated nor- mally there is a deadline for completion except for extenuating circumstances such as the A.G.C. strike and resulting unavailability of asphalt. Mr. Pieper stated the monthly charges are a concern. The City of Tukwila sewer charges are $2.00 more than Val Vue. Why should people on one side of the street pay more for the same facility than their neighbors on the other side of the street. This is the reason the people felt it was unfair and cancelled LID #23. Steve Hall stated everyone will be paying to Val Vue for LID #26. Mayor Todd stated the charges should be the same. Councilman Gardner stated Metro charges will be increas- ed next year and he hoped the City will not have to pass on the increase to its customers.
