The Special Meeting of the Council to discuss proposed
Board of Adjustment Ordinance was called to order at
7:21 P.M. Councilman Saul served as Clerk Pro Tem.
GARDNER, STERLING, HARRIS, SAUL, JOHANSON. MOVED BY
GARDNER, SECONDED BY HARRIS, TO EXCUSE ABSENT COUNCIL
MEMBERS TRAYNOR AND DAVIS. CARRIED.
Gary Kucinski, Planning Director, reviewed previous
Ord. #860 and other matters related to the Board of
Adjustment to bring the Council up to date. He also
explained some of the responsibilities of the Board.
Questions were raised on Section VII and Gary Kucinksi
stated the authority of this Section is subject to the
provisions of the Title 18 of Tukwila Municipal Code.
Revisions to this Section were discussed.
Councilman Johanson arrived at 7:26 P.M.
Discussion continued on the duties of the Planning
Commission which are being delegated to the Board of
Adjustment under this proposed ordinance. Gary Kucinski
stated if the paragraph regarding variances is literally
interpreted, the intent is quite clear. Councilwoman
Harris stated as a member of the Planning Commission at
the time the Board was conceived, the Board's purpose
was to relieve the Planning Commission of the require-
ment to hear variances and other similar appeals. She
explained how this present proposed ordinance is differ-
ent from a previous draft. Discussion continued on the
form and contents of the proposed ordinance, Ord. #860
and Ord. #871. Councilwoman Harris suggested a combin-
ation of the three Ordinances.
Councilman Gardner asked how the Board of Appeals fit
in. Gary Kucinski stated they deal with the Building
Code which is completely separate from the Zoning Code.
Councilwoman Harris questioned the authority of the
Board of Appeals since it was not created by legislativE
action and that its decisions could be challenged on
that basis. Gary Kucinski stated the Building Code
adopted by the Council calls for a Board of Appeals.
Councilman Saul and Councilman Johanson agreed that the
bulk of the power should remain with the Planning Com-
mission.

MOVED BY JOHANSON, SECONDED BY GARDNER, THAT THE SPEC
8:00 P.M. 8:05 P.M. IAL MEETING ADJOURN TO THE CITY HALL ANNEX DUE TO A
CONFLICT WITH PLANNING COMMISSION MEETING. CARRIED.
Councilman Sterling called the meeting back to order
with Councilman Saul absent due to his attendance at
the Planning Commission meeting. The change in loca-
tion of the Council's Special Meeting was posted at
City Hall. MOVED BY GARDNER, SECONDED BY STERLING, TO
APPOINT HARRIS AS CLERK PRO TEM. CARRIED.
Gary Kucinski stressed that the proposed ordinance is
valid and that the functions are legitimate for the
Board of Adjustment, and he agreed with Council the
members of the Board would need some expertise. City
staff will be making recommendations to the Board too.
Councilman Sterling suggested some type of seminar for
the new members of the Board regarding the Code. Dis-
cussion continued on further clarification of the ord-
inances. MOVED BY HARRIS, SECONDED BY JOHANSON, TO
PLACE PROPOSED ORDINANCE ON THE AGENDA OF THE OCTOBER
7, 1974 REGULAR COUNCIL MEETING. CARRIED.
ADJOURNMENT SPECIAL MEETING ADJOURNED.
