called the meeting of the Tukwila City Council to order.

OF THE COMMITTEE OF THE WHOLE MEETING OF OCTOBER 28,

City Clerk Shirlee Kinney explained the dates to call
for bids and to open the bids. Steve Hall, Public Works
Director, explained there is a tight time schedule on
this and with Council agreement, bids could be awarded
prior to the budget hearings on December 2, 1974.

FOR SOUTH 180TH STREET SANITARY SEWER INTERCEPTOR, THAT
BIDS BE RECEIVED AT CITY HALL UP TO 5:00 P.M. TO BE
OPENED AT 7:30 P.M. IN THE COUNCIL CHAMBERS ON NOVEMBER
25, 1974. CARRIED.
City Clerk Shirlee Kinney read the notice of public
hearing and stated copies of the preliminary budget will
be available to the public on Thursday, November 7. The
public hearing is set for December 2, 1974 at 7:00 P.M.
and may be continued from day to day.

Councilwoman Harris stated she would like 1973 expendi-
tures provided along with the preliminary budget for
comparison. Mayor Pro Tem Traynor suggested setting
the Council of the Whole meeting on November 11 as the
time to determine preliminary budget hearings with each
department.
Gary Kucinski, Planning Director, read a letter from
Squire Investment Co. dated October 21, 1974 regarding
two parcels of land to be included in the proposed
annexation area of Fire District #1. Mayor Pro Tem
Traynor read a letter to the Council from Gary Kucinski
dated October 31, 1974 explaining this area would be
considered as a separate request from the present pro-
posed annexation. Gary Kucinski stated he has now
learned that the Boundary Review Board may modify the
boundaries of the proposed annexation area if they feel
this is a logical inclusion.
Attorney Parker read his reply in the form of a legal
opinion to Councilwoman Davis's request. A copy is on
file in the City Clerk's office. Steve Hall read his
letter dated October 31, 1974 to the Council.
Councilman Sterling arrived at the meeting at 7:20 P.M.
Councilwoman Davis stated her concern was not with the
dinner as an informal dinner, but that City business
might be discussed during this time which would prevent
Council Members from attending at all. She also stated
perhaps a few citizens might not be able to attend the
dinner due to the $5.50 charge. She suggested the Memo
be revised in some way or retracted with another Memo.
Mrs. Eleanor McLester stated she would like to have the
original Memo read. Mayor Pro Tem Traynor read the
Memo dated October 22, 1974 addressed to all Departments
and Members of the City Council from Doris Phelps, stat-
ing "We have made arrangements at Gasperetti's for
dinner at 5:30 P.M. on Thursday, November 7, to get our
heads together before the Boundary Review Board's Public
Hearing regarding the Allentown /Duwamish annexation.
Please let me know by October 31, 5:00 P.M. how many
reservations to confirm for your Department or for your-
selves. Dinner will be $5.50." Councilman Johanson
stated he appreciated Steve Hall's letter and that his
concern was that any City entity gathering as a group
where possibly policy for the City is concerned would
be a violation of the Open Meetings Act. Any discussion
of policy might not be what the entire City Council may
want and the legislative body of the City is responsible
for the policy of the City. City Treasurer Mae Harris
stated that breaking bread together has traditionally
been an occasion for good will; she felt that all of
us in the City should get together more often for things
like this to gain a better understanding of each other.
If we can just wash out all of the City business from
the discussion, she felt it would be a wonderful idea.
Mayor Pro Tem Traynor stated he agreed.
Steve Hall read his letter dated October 21, 1974
addressed to Council President Traynor, stating City
Light has refused to grant an easement for sanitary
sewers to the City of Tukwila in consideration of
$4,000 that was originally proposed by City Light.
He recommended the revision of the size of the easement
at a cost of $6,646.22 now be accepted. He explained
the difficulties of condemnation proceedings. Council-
woman Harris asked if a resolution is necessary to
accept this proposal. Attorney Parker replied the

NEW BUSINESS
Letter re: Group City Clerk Shirlee Kinney stated she placed this on the
Health Coop employees Agenda to be considered by the Council since it would

sterilization Group Health insured employees. She then read the let
coverage ter dated October 15, 1974 from Schwarz, Shera Assoc-
iates, Inc. explaining the coverage. Mayor Pro Tem
Traynor stated the Council has been negotiating recently
with several employee groups and feels that this matter
should be taken up when the Group Health contract comes
due. Councilman Sterling asked about the other medical
plan for employees. Shirlee Kinney stated Washington
Physicians Service does not provide coverage for contra-
ception and sterilization. MOVED BY HARRIS, SECONDED BY
DAVIS, TO POSTPONE THE MATTER INDEFINITELY. CARRIED.

PUBLIC WORKS DIRECTOR'S RECOMMENDATION. CARRIED.
Steve Hall read his letter dated October 30, 1974
addressed to the Council President regarding a profess-
ional services agreement with Dames E Moore as consul-
tants on soil conditions. Councilman Johanson asked
about the schedules for construction of the LID and
Steve Hall replied. Councilwoman Harris asked if a
resolution would be necessary to employ Dames Moore.
Attorney Parker stated this is part of the original
contract with Wilsey Ham and the Council may accept
this recommendation by Motion. Councilman Gardner point-
ed out the extra expenses will be covered in the cost of
the LID. MOVED BY TRAYNOR, SECONDED BY SAUL, TO CONCUR
WITH THE RECOMMENDATION OF THE PUBLIC WORKS DIRECTOR
REGARDING LID #24 PROFESSIONAL SERVICES AGREEMENT.
CARRIED.
Steve Hall, Public Works Director, read his letter dated
October 23, 1974 requesting a resolution for Council
approval to authorize the Mayor to sign the City /County
Agreement for the project through the State Department
of Highways. MOVED BY TRAYNOR, SECONDED BY STERLING,
THAT THE CITY ATTORNEY PRESENT A RESOLUTION FOR COUNCIL
APPROVAL FOR THE REGULAR MEETING OF NOVEMBER 18, 1974.
CARRIED.
Mayor Pro Tem Traynor stated he has not yet received
Committee meeting schedules from the Public Works Commit-
tee or the Finance E Personnel Committee. He stated
when these are set up, a resolution will be adopted to
formally set the meeting times, places and dates. Coun-
cilman Saul stated he would resign as chairman of the
Finance Personnel Committee due to many other prior
commitments. Mayor Pro Tem Traynor suggested that
Committee meet and elect another chairman.
MOVED BY HARRIS, SECONDED BY JOHANSON, THAT PROPOSED
ORDINANCE BE READ BY TITLE ONLY. CARRIED. Attorney
Parker read proposed ordinance amending Chapter 19.36
of the Tukwila Municipal Code by adding thereto a section
authorizing the Building Director to issue citations to
violators by title only. MOVED BY HARRIS, SECONDED BY
SAUL, THAT ORD. #896 BE ADOPTED AS READ. CARRIED.

NANCE BE READ. CARRIED. Attorney Parker read proposed
ordinance approving and adopting a Shorelines Master Pro-
gram for the City of Tukwila.
Mayor Pro Tem Traynor read a letter from Mayor Todd
dated October 25, 1974 stating after meeting with the
Fire and Police Chiefs he recommended the Ordinance and
Resolutions be repealed and the matter be dropped this
year. MOVED BY DAVIS, SECONDED BY SAUL, THAT PROPOSED
ORDINANCE BE READ. CARRIED. Attorney Parker read pro-
posed ordinance repealing Ordinance No. 882 and Resolu-
tions Nos. 448 and 449.
MOVED BY TRAYNOR, SECONDED BY STERLING, THAT PROPOSED
ORDINANCE BE READ. CARRIED. Attorney Parker read pro-
posed ordinance transferring funds from the Contingency
Fund to the Parks E Recreation Fund to cover costs of
the Recreation Program. Richard Hunt, Recreation Super-
visor, requested this proposed ordinance be considered
an emergency ordinance because the funds are needed
immediately, especially those for the part -time recrea-
tion leader. Councilwoman Davis stated she was unclear
as to what the emergency is. Richard Hunt explained
new programs are underway at this time with more new
programs starting very soon. The most important thing
is to advertise for someone to fill the recreation
leader's position for after school and evening programs
as soon as possible. He stated since the Department is
using the Tukwila Community Club two or three times
each week, he felt it necessary to reimburse them for
expenses and he explained the equipment to be purchased
in the amount of $2,000.00. Councilwoman Harris asked
if the County is running their programs at Showalter Jr.
High. Richard Hunt stated the County's programs have
been dropped for the South Central District. Mayor Pro
Tem Traynor stated it is very difficult to get programs
going with no funds and there is no sense in dropping
some of these programs just when they are getting start-
ed. He stated the programs his family is involved in
now are very good ones. MOVED BY GARDNER, SECONDED BY
SAUL, THAT PROPOSED ORDINANCE BE DECLARED AN EMERGENCY
ORDINANCE. CARRIED. MOVED BY TRAYNOR, SECONDED BY SAUL,
THAT PROPOSED ORDINANCE BE READ FOR THE SECOND TIME BY
TITLE ONLY. CARRIED. Attorney Parker read proposed
ordinance transferring funds from the Contingency Fund
to the Parks E Recreation Fund to cover costs of the
Recreation Program by title only, and amending proposed
ordinance title to include "and declaring an emergency."
MOVED BY SAUL, SECONDED BY STERLING, THAT ORD. #897 BE
ADOPTED AS READ. CARRIED. Councilman Johanson stated
the intention of the order of reading ordinances is for
proper deliberation by the Council and it would be pro-
per to so declare an emergency just to catch up as the
Council did tonight. Not all the emergencies will be
catastrophic.

to cover terms of ordinance transferring funds from the Contingency Fund
Firefighters contract to the Current Fund to cover expenditures required by
the terms of the contract with Firefighters Local 2088.
Steve Hall, Public Works Director, stated he submitted
a written report to Councilman Gardner. Councilman
Gardner read the letter, a copy of which is on file in
the City Clerk's office. Councilman Sterling asked if

there is any indication from the utilities companies
when they will be ready to implement construction.
Steve Hall replied construction would begin in April.
Councilman Sterling asked if all three phases are
scheduled beginning in April and if all three could be
completed by the end of 1975. Steve Hall replied yes.
Councilman Johanson requested an update from Attorney
Parker regarding the status of the law suit between
Sammamish Commercial Co., Mario Segale and the City of
Tukwila. Attorney Parker stated it is scheduled to go
to trial on November 20, 1974. He stated there will
possibly be a postponement because both he and Mr.
Hennessey have previously scheduled cases on that day.
Mrs. McLester asked which street would be improved
first on the program schedule. Steve Hall replied
56th Avenue and 147th Street. Mrs. McLester stated
her streets will be torn up in 1975 for sewers and
then again in 1976 for undergrounding. Is there any
way to get the two projects together? Steve Hall
stated it is not alway possible due to the funding to
combine these efforts and it is very unfornate as well
as inconvenient.
Mayor Pro Tem Traynor stated he was pleased at the
efficient and business -like manner in which the Council
conducted its business through the long Agenda this
evening. City Treasurer Mae Harris agreed and also
stated she wished to apologize to the Council for not
being in attendance at the last Regular Meeting for
the Treasurer's Report.
Councilman Gardner announced a meeting at Seattle Center
on November 14 and November 16 for a RIBCO environmental
fair.
