CALL TO ORDER Councilman Johanson called the Committee of the Whole
Meeting of order.

Steve Hall, Public Works Director, explained that these
bids include four schedules and the City will take com-
binations of A and D and B and C. He stated that the
qualifications and recommendations will be checked into
and presented to the City Council at the meeting on

February 3 and the low bidder will be notified by tele-
phone. Mr. Hall stated the project will be fully funded
by King County Parks and Don Koll Northwest.
Councilman Johanson introduced Mr. William Bjork of the
State Gambling Commission who was attending the meeting
to answer any questions that the City Council or audience
might have concerning present gambling laws. Councilman
Johanson stated it was his understanding that there were
two new rulings coming up concerning gambling as related
to card room playing and he thought for the sake of
clarity it would be wise to consider first the laws as
related to card room playing. Mr. Bjork stated that
reference was being made to some rules that were passed
at the last Commission meeting on the 9th and 10th of
January and will become permanent rules effective 30 days
after the filing. He stated they enlarged in more detail
the description of the commercial stimulii with respect
to punchboards and pull tabs authorized as commercial
stimulant to a private profit seeking bueiness or to be
utilized by a nonprofit charitable organization. From
the enlarged ruling he read "an activity authorized as a
commercial stimulant shall be deemed as not being used as
a nonprofit charitable organization and the gross receipts
less those paid out by expenses and federal and State
taxes or more than 50% of the total gross receipts from
the business during any calendar quarter." This in effect
allows them to record their total gross receipts from
punchboards and pull tabs and subtract that amount that
they have on record as being paid out for prizes. They
can also prorate the amount they have paid out in taxes.
When what is left exceeds 50% of their total gross busi-
ness then they are out of bounds, and they will be subject
to have license suspension during any one single quarter.
The statute does not allow punchboards and pulltabs to be
run as a business. He continued that the next rule
that the City Council had reference to was in regards to
card playing. The Commission by statute is authorized
to issue licenses for social card games for private profit
seeking businesses or to modified charitable nonprofit
seeking organizations. When licenses are issued to
private profit seeking businesses it can only be issued
as a commercial stimulant, not as a business itself. The
Commission goes on to set the fees as such that will de-
fray or partly defray the expenses of the game. The
statute does not allow the card room or social card game
to make a profit. The activity is only authorized to be
a commercial stimulant. He stated it is hard to know
what to let that operator charge so for the present time
the Commission allows them to charge up to $1 per half
hour to play in a game and that is the maximum. Mr. Bjork
explained that a Class D license allows social card games
where the patrons do not pay to play, but they may place
small wagers. The profits from holders of Class D lic-
enses are also checked closely by the Commission. He
stated that it had been their experience that social card
games increased the profits of businesses about 15% so
it is known that card games are a good commercial stimu-
lant. There are audits and spot checks and violation of
the law means the business can have their license revoked
and also place their other licenses in jeopardy. Council-
men Saul and Johanson asked questions of Mr. Bjork regard-
ing how closely the books of such establishments are
audited and he replied that they make quarterly
and are subject to having audits made at any time and also
spot checks, and this is especially so if there are any
complaints or suspicion that the law is being violated.
Joe Gasparavich, manager of the card room at the Riverside
Inn, asked Mr. Bjork if they could give free breakfasts
to partrons of the card room prior to the opening of the
card room at 1 p.m. and consider it as an expense of

operating the card room. Mr. Bjork answered that it
would not be a legal stimulant insofar as operating a
card game and would not be a deductible expense. Mr.
Gasparavich asked if they open the restaurant on Sunday
and have to have other employees to operate facilities
in order to operate the card rooms on Sunday are these
deductible expenses, since the restaurant is normally
closed on Sunday. Mr. Bjork answered only those directly
related to the card games and the lights and heat would
have to be prorated as related to the square footage
that was involved in the card playing area. Councilman
Sterling asked why they would open the card games for
Sunday if they are not making a profit from them, when
the restaurant is normally closed on Sunday.
Mr. Hodge representing Foster Golf Links, Inc. presented
letter dated January 20, 1975 to City Council and Mayor
of City of Tukwila stating that they had reviewed the offer
made by the City of Tukwila in their letter dated Novem-
ber 19, 1971 in the amount of $2,355,000 and stated they
would accept the offer with the stipulations set forth
in the letter of acceptance dated January 20, 1975.
Mr. Hodge specified that the sale was for the real
property and buildings and does not include the personal
property such as tractor, mowers, and truck that have
been acquired recently and since negotiations for the
sale have commenced. Councilman Johanson asked that this
matter be put on the agenda for the City Council Meeting
be be held February 3, 1975.
Steve Hall, Public Works Director, stated that an area
where Andy's Diner will be located is concerned and
needs to be connected to sewerage and drainage system
covered by LID #19. Mrs. Nelson, audience, requested
that a later comers agreement be entered into. She
stated that she felt that any expense should be charged
to the developer. She stated there was about 2 acres
that will eventually be used. Councilman Gardner asked
if the final assessment had been settled. Steve Hall
replied that it would be a direct cash reimbursement
to each owner. Councilman Johanson stated that it would
be similar to that done on LID #5. Steve Hall stated
that it is legal that they be charged at the rate they
are being connected and it is up to the City Council to
decide. Councilman Saul asked if the City could charge
the developer. Steve Hall replied that you cannot charge
them any more than the equivalent and the extension could
be made to the entire area. Councilman Sterling suggested
that the matter be referred to the City Attorney for him
to look over the wording of the LID. He continued that
he did not see how the people should have to pay any more.
Mrs. Nelson, audience, asked if the City of Renton, Bur
lington, or Andy's Diner had talked about this. Steve
Hall replied that they have not indicated their thoughts
on the matter. Councilman Johanson stated that he was
sure the committee would want to discuss this and he
requested that the matter be on the agenda for the
February 3 meeting of the City Council.
Councilman Johanson stated that the matter of possible
negotiation with the Independent Water Company be on the
agenda for the City Council meeting on February 3. He
continued that it was his understanding that at one
time the City had thought of purchasing the Independent
Water Company. Steve Hall stated that they had agreed
to split the cost half and half with the Independent
Water Company and that the City was now making 10 over
cost and they are not having to do any work for them. The
City does not read the meters, Mrs. Nelson said, and the
City of Seattle bills the eight customers for which they
are paid $40 and the Company pays the City of Tukwila 10

stated they are going to have to raise their rates
according to the rate increase enacted by the City
Council at their last meeting.
Councilman Johanson stated that this matter was still in
the committee and would be discussed at a later date.
Steve Hall stated that the regular Council meeting and

February 18, 1975 due to the fact that Monday, February
17, 1975 is observed as a holiday for Washington's
birthday.
Steve Hall, Public Works Director, stated that he had
contact and meeting with the City of Renton, Burlington
Northern, and several other property owners regarding a
corridor study involving an access road into the vicinity
of Sunset Highway. He stated the estimated cost is
$28,000. He stated that the City of Tukwila would be
expected to spend $1,000 on the project. He stated he
would like to have something discussed on it so he could
report the feelings of the City Council on the matter.
Councilman Johanson requested that the item of Corridor
Study be on the agenda for the February 3 meeting of
the City Council.
Ed Bauch, audience, stated that he had attended a meeting
on Thursday of the Bicentennial Committee and the idea of
a city clean -up suggested by the goals established by the
City Council at their January 11 meeting was accepted as
a good idea. He stated he had been made chairman of the
clean -up committee. The suggestion was that April 26
would be a good date for citizens to bring their trash,
debris, clippings, etc. to the curb if the City would pick
it up and pay the cost of transporting it to a land fill
in order to encourage the drive. Mr. Bauch also stated
that the City park land by Strander Bridge and
Christensen Road had been discussed by the committee; they
had looked at the property and a log cabin that might be
available. He stated that the committee is going to the
Park Commission and Planning Commission before a proposal
is made on this. Councilman Johanson asked that these
items be put on the agenda for the next City Council meet-
ing.
