HomeMy WebLinkAboutOrd 0382 - LID #5 (Local Improvement District)CITY OF TUKWILA, WASHINGTON ORDINANCE NO 352 AN ORDINANCE ordering the carrying out of the system or plan of additions to and betterments and extensions of the waterworks utility of the City of Tukwila, Washington, including the sys- tem of sewerage as a part thereof, as adopted by Ordinance No. 381, passed June 3, 1963, all in accordance with Resolution No. 165 of the City Council of the City of Tukwila, Washington; establishing Local. Improvement District No. 5; providing that payment of a part of the cost of said improvement be made by special assessments upon properties in said District, payable by the mode of "payment by bonds and providing for the issuance and sale of local improve- ment district warrants redeemable in cash and local improvement district bonds. WHEREAS, the City of Tukwila, Washington, by Ordinance No. 381, passed by the City Council and approved by the Mayor on the 3rd day of June, 1963, adopted a system or plan for making additions to and betterments and extensions of the waterworks utility of the City, including the system of sewerage as a part thereof, consisting of the construction and installation of cer- tain sewer collection lines, trunk sewer lines, and general facilities, estimated the total cost of said plan to be $819,000.00, and provided that payment therefor would be made (a) by assessments to be levied in the amount of not to exceed $412,000.00 against property specially benefited by the proposed improvement and included in a local improvement district to be formed, and (b) from the proceeds received from the issuance and sale of "Water and Sewer Revenue Bonds, 1963" in the amount of not to exceed $007,000.00 par value; and WHEREAS, by Resolution No. 165, adopted June 3, 1963, the City Council of the City of Tukwila, Washington, declared its intention to order the carrying out of the system or plan for making additions to and betterments and extensions of the waterworks utility of the City, including the system of sewer- age as a part thereof, as adopted by Ordinance No. 381, and fixed the 24th day of June, 1963, at a meeting of the City Council to be held in the Tukwila Community Hall at 8:00 o'clock p.m. (PDST) as the time and place for hearing all matters relat- ing to said proposed improvement and all objections thereto, and for determining the method for payment of said improvement; and WHEREAS, Harstad Associates, engineers for the City, have caused an estimate to be made of the cost and expense of the proposed improvement and have certified said estimate to the City Council, together with all papers and information in their possession touching the proposed improvement, a descrip- tion of the boundaries of the District, a statement of what portion of the cost and expense of the improvement should be borne by the property within the proposed District, a statement in detail of the local improvement assessments outstanding or unpaid against the property in the proposed District, and a statement of the aggregate actual valuation of the real estate, including 25% of the actual valuation of the improvements in the proposed District, according to the valuation last placed upon it for the purpose of general taxation; and WHEREAS, said estimate is accompanied by a detailed copy of the preliminary assessment roll showing thereon the lots, tracts, parcels of land and other property, together with the plans and assessment maps of the proposed improvement; and WHEREAS, due notice of the hearing upon said Resolution No. 165 was given in the manner provided by law and said hearing -2- was held by the City Council on June 24, 1963, and all written protests filed with the City Council on or before said date were duly considered and by it overruled and all persons appearing at said hearing were heard; and WHEREAS, the City Council determined it to be in the best interest of the City and of the owners of property within the local improvement district that said improvement, as herein- after described, be carried out and that a local improvement district be created in connection therewith, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN, as follows: Section 1. It is hereby ordered that the system or plan for making additions to and betterments and extensions of the existing waterworks utility of the City, as more particularly set forth in Exhibit "A attached hereto and by this reference made a part hereof and incorporated herein as if set forth in full, and described as "Collection System," "Trunk Sewers With- in L.I.D. No. 5 Serving as Both Trunk Sewers and Collection Lines Located Within L.I.D. No. 5," and "General Facilities," be carried out. Section 2. There is hereby created and established a local improvement district to be called "Local Improvement Dis- trict No. 5," the boundaries of such local improvement district being particularly described in Exhibit "B attached hereto and by this reference made a part hereof. Section 3. The estimated total cost and expense of said improvement is hereby declared to be $819,000.00. Not to ex- ceed $412,000.00 of the cost and expense of carrying out con- struction and installation of the "Collection System," described in Exhibit "B" attached hereto, side sewers where installed, and the equivalent reasonable cost of local 8 -inch sewer lines, if the same were constructed at the locations of the trunk sewers described in Exhibit "A" attached hereto as "Trunk SewersWithin L.I.D. No. 5 Serving as Both Trunk Sewers and Collection Lines Located Within L.I.D. No. 5" (in accordance with the provisions of RCW 35.43.040), shall be paid by assessments to be levied in the amount of not to exceed $412,000.00 against the property specially benefited by such improvement and included in the local improvement district herein established, embracing as near as may be all property specially benefited by such improve- ment. The excess cost, over and above the equivalent reasonable cost of 8 -inch local sewers to be assessed, as described in Ordinance No. 381, of the trunk sewers described in Exhibit "A" attached hereto as "Trunk Sewers Within L.I.D. No. 5 Serving as Both Trunk Sewers and Collection Lines Located Within L.I.D. No. 5 and the cost of the "General Facilities" as described in Exhibit "A" hereto attached shall be paid from the proceeds received from the issuance and sale of "Water and Sewer Revenue Bonds, 1963" in the amount of not to exceed $407,000.00; pro vided, however, that in the event Val Vue Sewer District, King County, Washington, shall construct the "Val Vue Trunk Sewers," as defined in Ordinance No. 381, the amount of such authorized "Water and Sewer Revenue Bonds, 1963" shall be reduced by $140,000.00 to not to exceed $267,000.00. Section 4. The nature of the improvement provided for herein is such that the special benefits conferred upon the property in the local improvement district herein created are not fairly reflected by the use of the zone- and termini method of assessment therefor, and it is hereby provided and ordered that the assessments shall be made against the property of the District in accordance with the special benefits that it will derive from the improvement without regard to the zone and termini method provided by statute. Section 5. Local improvement district warrants shall be issued in payment of that part of the cost and expense of the improvement herein ordered to be assessed against the property specifically benefited by such improvement and included in Local Improvement District No. 5, such warrants to be payable out of the "Local Improvement Fund, District No. 5," herein- after created, to bear interest from the date thereof at a rate to be hereafter fixed by ordinance not to exceed 6% per annum and to be redeemed in cash, and /or by local improvement district bonds herein authorized to be issued, said interest- bearing warrants to be hereafter referred to as revenue warrants." Such bonds shall bear interest at a rate to be hereafter fixed by ordinance not exceeding 6% per annum, shall be payable on or before twelve (12) years from the date of issuance, the life of the improvement ordered being not less than twelve years, and shall be issued in exchange for and in redemption of any and all revenue warrants issued hereunder and not redeemed in cash within a period not to exceed 60 days after the first publication by the City Treasurer of notice that the assessment roll for "Local Improvement District No. 5" is in her hands for collection. The bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property within said District, payable in ten (10) equal annual installments, with interest at a rate to be here- after fixed by ordinance not exceeding 6% per annum, under the mode of "payment by bonds," as defined by law and the ordinances of the City of Tukwila. In the case of default in the payment of any assessment when the same shall become due, there shall be added interest at a rate to be hereafter fixed by ordinance not to exceed 6% per annum and a penalty of 5% which shall also be collected. The exact form, amount, date, interest rate and denominations of said warrants and bonds shall be hereafter fixed by ordinance of the City Council. Said warrants and bonds shall be sold in such manner as the City Council shall hereafter determine. Section 6. There is hereby created and established in the office of the City Treasurer of the City of Tukwila, for Local Improvement District No. 5, a special fund to be known and designated as "Local Improvement Fund, District No. 5," into which fund shall be deposited the proceeds from the sale of revenue warrants drawn against said fund which may be issued and sold by the City and collections pertaining to assessments, and against which fund shall be issued cash warrants to the contractor or contractors in payment for the work to be done by them in connection with said improvement, and against which fund cash warrants shall be issued in payment of all other items of expense in connection with said improvement up to the maxi- mum amount of the cost of the improvement to be assessed. The foregoing Ordinance was PASSED by the City Council of the City of Tukwila, Washington, and APPROVED by the Mayor, at a regular meeting thereof this 1st day of July, 1963.
