the meeting of the Tukwila City Council to order.

MOVED BY STERLING, SECONDED BY SAUL, IN THE ABSENCE
OF THE COUNCIL PRESIDENT, TO ALLOW MAYOR TODD TO OPEN
THE BIDS. CARRIED. Mayor Todd opened a bid from
Vanco Recreation, Inc. for a total bid of $3,415.06
for log -type playground equipment. Steve Hall, Public
Works Director, stated there would be a recommendation
for bid award at the next regular Council meeting.
City Clerk Shirlee Kinney read the call for bids
notice for a Rustic Log Cabin for which bids will be
received in the Office of the City Clerk up to the
hour of 5:00 P.M. on May 29, 1975 with bid opening
scheduled for 7:30 P.M. on May 29, 1975 in the City
Council Chambers.
Mayor Todd introduced the two new officers of the
Police Department and read a brief background on each.
The Mayor and the City Council welcomed both gentlemen
to the City of Tukwila.

Mayor's letter The letter was not read and no action was taken by
Council Procedures the City Council. A copy of the letter is on file in
Ordinance Deputy the City Clerk's office.
City Attorney Ordinance
Councilman Johanson read Mayor Todd's letter dated
April 28, 1975 addressed to the taxpayers of Tukwila
stating the reasons he was not going to respond to the
Council's ultimatum regarding the payment to the
Council's attorney.
Mayor Todd stated the information requested by Council
Order #5 was deferred to the City Treasurer, whose
records will provide a response. Copies of the Treas-
urer's report will be provided to all Council Members.
Mayor Todd stated the information regarding inventory
and job duties as requested by Council Order #4 is
nearly ready and should be presented at the next
regular Council Meeting.
Mr. Gary Van Dusen asked to have this letter read.
Mayor Todd read his letter addressed to the City
Council dated April 25, 1975 stating he had not re-
ceived direction from the Council regarding going to
bid on the City's insurance and that he had used "the
rule of necessity as my authority to bind coverage to
protect the City's property."
Mrs. McLester stated in the Mayor's letter, he asked
for Council direction in preparing the bids. She
wanted to know if the Council gave Steve Hall direction
in preparing bid specifications for equipment, lightin€
etc. Mayor Todd stated the Council was made aware of
the status of insurance in January, 1975 and for two
months, they took it upon themselves to prepare to go
to bid. The final communication between himself and
the Council as indicated in the Minutes is that they
were going to come up with the specifications. He
stated these are unusual circumstances, but he was
trying to cooperate.
Mayor Todd read the Proclamation designating May 10
as Fire Service Recognition Day by the International
Association of Fire Chiefs. Mayor Todd announced the
Tukwila Fire Station Open House scheduled for May 10
from 10:00 A.M. to 6:00 P.M. at 444 Andover Park East.
Mayor Todd stated a law suit had been filed in King
County Superior Court under No. 795390 against the
City of Tukwila by Mr. McAdoo for payment of fees due
him to date. Attorney Parker stated he filed an ans-
wer to the Complaint today.
Councilwoman Harris requested Agenda item 7.a. be read
at this time. Councilwoman Harris read the Mayor's
letter addressed to the Council dated April 28, 1975,
stating he had directed Attorney Parker to file an
action in Superior Court as necessary to resolve these
two issues.

he and the City Clerk be provided with copies of the
letters to be read.

Councilwoman Harris read a letter from Mayor Todd
dated April 28, 1975 stating that in the future,
Department Heads will attend meetings of the Council
or of the Committees upon the request to the Mayor's
office by the Council President or Committee Chairman.
This is intended to make more productive use of the
Department Heads' time.
Councilwoman Harris read a memo from Kjell Stoknes,
Planning Director, to herself dated April 28, stating
pursuant to the Mayor's letter, he would not be attend-
ing future committee meetings unless requested to do
so through the Mayor's office.
Councilwoman Harris read a memo from Steve Hall,
Public Works Director, to Councilman Gardner dated
April 29, 1975 stating in conjunction with the current
directive from Administration, he would request that
his attendance at future committee meetings be request-
ed through the Mayor's office.
Councilwoman Harris stated it is very much a shame
that this City is not able to operate in the manner
of any other city or any other level of government.
In order to have a greater understanding of legisla-
tion, it is necessary to the committees to meet with
whatever staff members it is a standard operating
procedure. She regarded this as another attempt to
circumvent the Council's attempt to have good, thought-
ful legislation in the City and it is contrary to the
Council Procedures Ordinance. She felt it was another
wedge to drive between the staff and the Council. We
need to have free and easy communciation between the
staff and the legislative body for the benefit of the
people in the community. Mayor Todd stated he saw
nothing in any of the correspondence which circumvents
due process of legislation. The reason his letter was
written was that certain staff members had approached
him that they were constantly attending evening meet-
ings and in some cases when they attended, they were
not spoken to and in other cases when they were con-
sulted, their expert advice was disregarded. There
is no deterrent intended by anyone. If anyone's pre-
sence is desired, then make the request to him and
there should be no problem at all in seeing that the
person(s) attends. Councilwoman Harris stated these
staff people are being paid handsome salaries and the
Council Members also work during the day and find it
difficult to meet in the evenings at times. Mayor
Todd stated there is no reason why these people have
to respond to eight bosses. They have to have one
boss and a chain of command in order to operate effi-
ciently. Councilwoman Harris stated the staff needs
to meet with the Council as a committee. They are
working for the people of Tukwila, as all of us are
supposed to be. It is common practice everywhere to
have staff meet with Council whenever necessary to
further the proposed legislation. She stated she did
not know where the "eight bosses" came from or who
invented it, but nothing the committees are doing is
contrary to any governmental policies. She asked if
Mayor Todd would be making judgments as to whether a
staff member should or should not attend. Mayor Todd
replied no, it is only requested that if the staff
member is required to be present at the committee
meeting, the request be directed through his office
and the staff member will attend on that basis.
Councilman Sterling stated as a member of the Public
Works Committee, he would go on record to request the
presence of the Public Works Director at all Public
Works Committee meetings.

Discussion continued. Councilwoman Davis stated the
committee meetings are published meetings, they are
open to the public, City business is always discussed
and the Department Heads are always included in the
discussions. She stated she felt this letter of
Mayor Todd's was a real insult.
MOVED BY DAVIS TO CONTINUE WITH THE AGENDA.
It was noted the Comprehensive Sidewalk Plan was re-
ferred to the City Council from the Planning Commis-
sion. MOVED BY HARRIS, SECONDED BY DAVIS, THAT THIS
ITEM BE REFERRED TO THE COMMUNITY AFFAIRS COMMITTEE.
CARRIED.
Police Chief John Sheets explained the agreement
between King County and suburban cities, including
Tukwila, has been approved and has been reviewed and
approved by the King County Law Justice Planning
Office. He gave a brief background of the agreement
which originated in 1974. This is a project to help
hold the rise in residential burglaries and the amount
of the losses by film and lecture series, etc. We
need to make the public more aware of the problems
we are facing with these crimes. Discussion continued
regarding use of the grant funds. MOVED BY DAVIS,
SECONDED BY SAUL, THAT THIS ITEM BE REFERRED TO THE
PUBLIC SAFETY AND HEALTH COMMITTEE. CARRIED.
Councilman Sterling commended Chief Sheets in securing
these grants on behalf of the City and because this
money has been made available for the betterment of
the community.
Mayor Todd reviewed the requested of Barney Ruppert,
Building Director, to purchase a table saw in lieu of
the budgeted floor buffer. MOVED BY HARRIS, SECONDED
BY SAUL, TO REFER THIS ITEM '1'U THE PUBLIC WORKS
COMMITTEE. CARRIED.
Steve Hall, Public Works Director, read his letter
addressed to the Mayor dated April 23 regarding his
recommendation to accept sanitary sewer gravity por-
tions of the Southcenter South development. He stated
we have not received the complete payment for profess-
ional services from Harstad Associates and he further
recommended final acceptance not be granted until the
payment is made. MOVED BY HARRIS, SECONDED BY JOHAN-
SON, THAT THIS ITEM BE REFERRED TO THE PUBLIC WORKS
COMMITTEE. CARRIED.
MOVED BY STERLING, SECONDED BY SAUL, TO AMEND THE
AGENDA TO INCLUDE ITEM 8.e. CARRIED. Councilman
Sterling stated as a result of the special meeting
held April 30, this discussion was to appear on the
Agenda. It was proposed to mail out a flyer to ask
the citizens for input on the bus and then we would
have a public meeting on May 28 providing a represen-
tative from Metro could be here for further discussion
of the results of the mail -out. There will be certain
costs for preparing and mailing the questionnaires.
Councilwoman Harris stated there are funds that the
Council could transfer some monies out of for this
project. Councilman Sterling stated the following had
volunteered to serve on the committee: Marilyn Patton,
Viola Lutes, Doris Phelps, Ed Bauch and himself.
Councilman Sterling requested Mayor Todd to contact
the proper person at Metro to appear at the public
meeting. Councilwoman Harris requested Mayor Todd to
make the appointments of the volunteers to the Citizen
Ad Hoc Committee. Mayor Todd replied he would make

NON DEPARTMENTAL. Chief Crawley stated those funds
are needed for the four new men who are now on board
and also to meet the expense of some new State regu-

appurtenances from the existing lift station to Ando-
ver Park West and on Andover Park West from Minkler
Boulevard to Strander Boulevard, all within the corp-
orate limits of the City of Tukwila, as provided by
Ordinance No. 776 and levying and assessing the amount
thereof against the several lots, tracts, parcels of
land and other property shown on the Roll, by title

objected to this being only the first reading of the

Councilman Johanson stated Mr. Dow could not be avail-
able for the meeting this evening and the Executive
Session is deleted from the Agenda. He suggested a

that the Council hold a Special Meeting for this
purpose. Councilwoman Harris suggested May 8 at
the City Annex. MOVED BY JOHANSON, SECONDED BY SAUL,
TO SET A SPECIAL MEETING ON MAY 8, 1975 AT 7:30 P.M.
AT THE CITY ANNEX.* Attorney Parker recommended the
Council give notice for a Special Meeting and an
Executive Session. Councilwoman Harris stated no
notice is required, we will abide by the 24 hour
notice required to the press present. *CARRIED.
Mr. Van Dusen asked why everything had to be referred
to a committee, although he stated he did understand
the purpose of the committees. If we pay these high
salaries that someone had alluded to, then why call
in a Department Head to discuss something like chang-
ing a floor polisher to a table saw in the budget at
a committee meeting. He assumed the staff members
knew what they were doing. Regarding the bids recently
on an asphalt paving machine, there was an additional
item included with the bid and the Department Head had
explained the additional piece of equipment would be
very helpful to the crew. It went into committee
when it could have been discussed and a decision could
have been made that night. Tonight Chief Sheets
brought up an item, an ordinance, regarding unattended
children which is not a State law. We have a provis-
ion for an emergency clause and could have voted on
this ordinance tonight. He felt that ordinance should
not have gone into committee.
MOVED BY TRAYNOR TO DISCUSS MR. SIMOND'S LETTER ON
THE AGENDA AND TO HAVE A REPORT FROM THE APPROPRIATE
COMMITTEE. Councilwoman Harris stated the subject is
being retained in committee because there was a re-
quest to check with the adjacent property owners for
their comments on the situation. She stated the next
Community Affairs Committee is May 7 at 5:30 P.M. at
the City Annex and this subject will be discussed.
The public is encouraged to attend.
Mr. Lee Phillips stated the original letter to the
City was dated 1973 and he hoped this would not be
continued in committee for two years.
Mr. Regel referred to a newspaper article which he
felt was not in good taste, but he agreed in part with
the reporter that the City government is in bad shape
with the Mayor suing the Council, the Council sueing
the Mayor, the City employees are sueing the City and
he stated he felt it was very discouraging. Mayor
Todd stated he would agree, except for one point
the employees have not as yet sued the City at all.
Mr. Regel stated the City employees have good wages
and he could not understand these grievances.
Steve Beaty, reporter with the Record Chronicle, asked
the status of the legal advertising contract and bid
award. Councilwoman Harris stated it would be discuss-
ed in her committee on Wednesday, May 7.
Councilman Saul announced the Bicentennial Clean Up
Day set for Saturday, May 17. He requested the Council
fund the Public Works Department with some money to
hire the dumpsters necessary for the clean up. Mr. Ed
Bauch explained these projects in the Cities of Kent,
Renton and Auburn cost approximately $6,000 and he
briefly explained what these clean ups consist of in
those Cities. The Committee plans to have four
dumpsters available in different locations in the City

dump and $18 for any subsequent dumps. We will be
publishing the names of volunteers who have pickup
trucks for heavy articles or for the elderly citizens
to call upon. He estimated the cost at $500.

FROM THE MAYOR'S BUDGET FOR ADMINISTRATIVE ASSISTANT
TO THE PUBLIC WORKS DEPARTMENT* Discussion regarding
the transfer ensued with Steve Hall suggesting the
funds be transferred into the Professional Services
Account within Public Works Department. Councilwoman
Harris stated if the transfer company will be billing
the City for its services after the clean up, then we
will have time to amend the budget ordinance by a
transfer ordinance.
Mrs. McLester asked if there would be publicity on
this to all the citizens. Councilman Saul stated the
newspapers would be advertising it and flyers will be
going out.
Mr. Van Dusen asked if we are going to be cleaning up
junk in our own basements and back yards or are we
going to make some effort to clean up the vacant lots,
ditches, etc. He stated his own priority would be
for the latter.
MOVED BY HARRIS, SECONDED BY JOHANSON, TO AMEND THE
MOTION TO INCLUDE PREPARATION OF AN ORDINANCE FOR THE
NEXT COUNCIL MEETING TO TRANSFER THE FUNDS FOR $500
MORE OR LESS FROM SALARIES AND WAGES, ADMINISTRATIVE
ASSISTANT IN THE MAYOR'S BUDGET TO PROFESSIONAL SER-
VICES IN THE CITY STREET FUND. Mayor Todd stated
he did not feel this was legally correct. Attorney
Parker suggested the Council pass a Motion to hire
the firm which will place them in a position to collect
the money in whatever amount is necessary to cover the
expenses of the project. Mayor Todd stated his point
is that there will not be enough time to get the money
into a fund by ordinance before the actual project
takes place and the debt is incurred. Steve Hall,
Public works Director stated he needed some authority
to spend the funds out of the City Street budget.
*SECOND TO THE AMENDMENT WITHDRAWN. Mayor Todd
called for another Second to the Motion after discuss-
ion on the proposed amendment took place. AMENDMENT
TO THE MOTION FAILS FOR LACK OF SECOND.
*VOTE ON ORIGINAL MOTION FAILED WITH SAUL VOTING YES.
MOVED BY STERLING, SECONDED BY GARDNER, TO AUTHORIZE
THE PUBLIC WORKS DIRECTOR TO ISSUE A PURCHASE ORDER
TO PAY FOR THE DUMPSTER COST. CARRIED.
Council President Traynor announced the Open House at
the new Fire Station on Saturday, May 10, and commented
the new mini pumper /aid car is really worthwhile. He
stated he wanted to see everyone attend.
Mrs. Nancy Moore stated the matching funds through the
Bicentennial Commission are now available until May
31, 1975.
Steve Hall reported the cut -off date regarding LID #27
protests is May 7 and after that date, Harstad Asso-
ciates can start to work on the design. A change to
the Comprehensive Plan will follow as soon as possible.
Steve Hall reported that auto mechanic Walt Hansen
is doing very well following open heart surgery.

Council President Traynor read a letter from Mayor
Todd regarding planned use of the Federal Revenue
Sharing funds for acquisition of the Helen Walkup
property for a senior citizens center and community
center. Mayor Todd stated Ms. Walkup is very
receptive to this idea and he would propose if it is
built, to name the project the Helen Walkup Community
Center. Ms. Walkup has done a lot of work for and
with the community over many years.
