WITNESSETH WHEREAS, the parties hereto warrant that they each own the parcels of property listed and described below such parties' name on Exhibit "A" attached hereto and incorporated by this reference: WHEREAS, the parties hereto also desire to grant to each other, their respective heirs, executors, administrators, agents or assigns a PERPETUAL, RECIPROCAL STORM SEWER EASEMENT, with a right of immediate entry and continued access to construct, improve, maintain and repair all appurtenant storm sewer structures located over, under, upon, and across the real property situated in King County, Washington described in Exhibit "B" attached hereto and incorporated by this reference; NOW THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND PROMISES CONTAINED HEREIN, THE PARTIES HERETO AGREE AS FOLLOWS: 1. Each party will maintain any private individual storm lines from his /her structure to the point where joint usage among the parties commences. 2. The cost of any repairs to the private individual storm sewer lines shall be the sole responsibility of each party and shall not be shared jointly. 3. All parties hereto agree and understand that City of Tukwila has no responsibility for the repair or maintenance of said individual private storm sewer lines. 4. The City of Tukwila retains the right to enter private properties as described in Exhibit "A" to inspect any and all storm system lines and appertenances discharging into the storm system located in South 151st Street. 5. The Grantor /Grantee shall retain the right to use the surface of the easement as long as such use does not interfere with the easement rights granted, but shall not, however, have the right to: a. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the constructed storm system within the easement. c. Dig, tunnel or perform other forms of construction activities on the property which would disturb the compaction or endanger the lateral support of the constructed storm system. 6. This Perpetual, Reciprocal Storm Sewer Easement and Maintenance Agreement shall be a covenant running with the land and shall be binding on all subsequent heirs, executors, administrators and assigns. IN WITNESS THEREOF, the parties hereto have executed this Agreement the date first abovewritten.
