EXPIRATION OF PLAN REVIEW Applications for which no permit is issued within 180 days following the date of application shall expire by limitation. The Building Official may extend the time for action by the applicant for a period not exceeding 180 days upon written request by the applicant as defined in Section 304(d) of the Uniform Mechanical Code (current edition). Of Community Development From: Butch Goodrow Airsystems Products, Representative RE: South Town Auto Rebuild / Ventilation Application Plan Check Number M92 -0228 Dear Ken: This letter is in reference to the one you sent to me on the 30th of October, 1992 where you requested me to provide a written narrative of the operation taking place in each area of the building. After spending several hours in the shop, I have some information for you concerning your request. The paint mixing area incorporates factory assembled paint mixing machines (qty 2), in which the closed containers are used to mix colors & tinting to match factory type finishes. The paint storage area consists of storage cabinets & containers to isolate them from the rest of the shop area. The prep area (noted in the drawing) is a place where the workers sand, mask & blow off parts (ie. fenders, doors, grills, hoods, & bumpers) so they can be taken into the booth for priming & painting. The paint spray booth is the location all of the painting and priming operations are being conducted. The purpose of the exhaust ventilation system is to eliminate the dust and sanding dabree currently being pulled into the booth from the prep area. This action is causing unnecessary rework on their behalf which in turn cost the owner labor hours being wasted. The other purpose for the equipment is to meet the requirements of the Puget Sound Air Pollution Control Agency for a body shop prep area & reduce the amount of air -born dust within the shop as well as meet the Washington Indoor Ventilation Code WAC- 51.13. Due to the nature of work preformed in your client's business, some concern has been raised for current Building and Fire Code compliance of this operation. As City procedure, we do not approve permit work if that permit assumes to approve more non - compliance of a specific code. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: MICHAEL J. WEST, applicant Southtowne Auto Rebuild, Inc. 14864 Pacific Highway South Seattle, Washington 98168 1. General Information: 211 -77 -R Page 2 Location: Lying on the northeast corner of Pacific Highway South and South 150th Street. Existing zone: BC Requested Zone: CG STR: W 22 -23 -4 Size: 7500 square feet Water District: #38 Sewer District: Val Vue Fire District: #.18 School District: #406 2. The subject property was zoned BC at the time of the Highline Area Zoning Study and adopted by Resolution No. 34590 on December 11, 1967. Prior to that time the zoning on the subject property was L -F (Airports) and B -1 (Business District). Building and Land Development Division files show that there were no specific requests made for more intensive zoning on the subject property at the time of the last area zoning study. 3. The purpose of the request is to allow the attachment of a spray . booth to an existing non- conforming auto rebuild shop. The • booth is necessitated by State regulations and is designed to completely separate auto spray painting from the remainder of the shop. It meets the standards of the Federal Occupational Safety and Health Act and those of the National Board of. Fire Underwriters. 4. The established zoning pattern for properties fronting on this portion of Highway 99 is BC, Community Business, which is more restrictive than the proposed CG. Some non - conforming CG uses exist within the immediate area, but the majority of the businesses would be permitted in the BC zone. Properties backing up the business strip on Highway 99 are typically multi - family zoned and occupied by apartments or older residences. There was no opposition to the requested change from the community. 5. The Highline Communities Plan at its present draft stage desig- nates the highway- fronting properties in this area as "Highway - Oriented Business Area ". A specific zone classification has not been suggested by that study, but the CG zone most closely matches the plan description. The following County Code references refer to the CG (General Commercial classification): 21.30.010 Purpose'of Classification: 21.30.020 Permitted Uses: 211 -77 -R Page 3 "The purpose of the CG classification is to provide for the location of enterprises which may involve some on- premise retail service but with the outside display or fabrication, including manufacturing and processing in limited degree." "Principal uses permitted: Any retail use, new and used auto- mobile sales, assembly of appliances, automobile laundries, paint, electrical or plumbing shops, tire rebuilding, kennels." Section 21.30.020(21) of the King County Zoning Code requires that the intended use be in an entirely enclosed building. 6. The subject property is served by public water and sewer systems and has direct access to Metro Transit. The Washington Surveying and Rating Bureau designates this area as a Class 7 fire protection rating on a scale of 1 to 10 with one being high and 10 low. 7. Applicable Comprehensive Plan Principles and Policies: Policy B -36: "Distributive, business service and light fabrication types of uses should be located with access provided to express- ways or major arterial truck routes so that traffic will not pass through residential areas. These uses should be located in the fringes of central business districts and the larger urban business areas or adjacent to industrial areas except where special circumstances dictate s separate location." 8. The present operation appears to be crowding a 7500 square foot parcel to the extent that on -site employee parking is not feasible, sand customer parking backs out onto Highway 99. The proposed structure will not replace existing parking however, and the applicant has proposed a drive - through system which will eliminate backing out and a scheduling system which will reduce the storage of damaged cars to a minimum. The shop employs 3 men and the proposed expansion does not involve an increase in employees. The "P- suffix" (Ordinance No. 2424) will provide King County with the opportunity to review plans submitted by the applicant in regard to the placement of buildings, landscaping and parking for any proposed development. Because of the low density of development directly east of the site, on- street parking for employees does not appear to be a serious problem at this time. 9. The Building and Land Development Division has advised the applicant that the P- suffix will allow greater flexibility than standard Code requirements for setbacks and parking, but will also require site plan approval and reasonable measures to upgrade the safety and appearance of the site. 10. Approval of this application will constitute a "major action" under the provisions of R.C.W. 43.21C and W.A.C.197 -10. The applicant submitted an environmental check list with the application. After reviewing the environmental check list, the Manager of the Building and Land Development Division made a threshold determination that approval of this application will not have a significant adverse impact upon the quality of the environment and that an environmental impact statement is not required. The Building and Land Development Division transmitted a proposed declaration of non - significance to other agencies with jurisdiction on January 18, 1977. After the elapse of fifteen days following the transmittal and after reviewing comments submitted by agencies with jurisdiction and by other parties, the. Manager of the Building and Land Development Division adopted the proposed 211 -77 -R Page 4 declaration as a final declaration of non-significance. At the public hearing on this application► a representative of the Building and Land Development Division reported that having considered the comments and testimony by agencies with jurisdiction and by other parties, having visited the;;subject property; and having evaluated the natural, physical and social systems related to this application, the Building and Land. Development Division reaffirms its determination that approval of this application will not have a significant adverse impact on the quality of the environment and an environmental impact statement is not required. CONCLUSIONS: 1. Based upon the whole record, and according substantial weight to the determination of environmental significance made by the Division of Building and Land Development, it is concluded that approval of the subject action as recommended below, would not significantly affect the quality of the environment. All evidence of environmental, impact relating to the proposed action and reasonable alternatives to the proposed action have been included in the review and consideration of the subject action. 2. The change to CG is consistent with the present draft of the High - line Communities Plan. 3. The location of the property meets applicable Comprehensive Plan policies for a General Commercial area. 4. With the use of site plan approval under the .P- suffix designation, the present operation can be made more conforming to the County Code, and thereby upgrade the safety and appearance of the site. 5. The proposed addition will upgrade the employee health standard for the shop and will serve the public interest. RECOMMENDATION: Approve CG -P in lieu of CG, subject to the following conditions: 1. A'site plan approved by Building and Land Development Division showing that all storage of damaged vehicles or vehicles to be repaired be within an entirely enclosed building. 2. A letter from King County Division of Traffic approving the proposed parking, circulation and access to the site. 3. A letter from the King County Fire Marshal approving the plans.
