WHEREAS,'Owners warrant to the City that they are persons owning a fee - simple interest or having substantial beneficial interest in the following described real property located in Tukwila, King County, Washington ( "Property ") : i 2. WHEREAS, Owners warrant to the City that their interest in the Property includes full power to enter into'agreemerits and covenants which will run with the land, and 3. In the event such sidewalk improvement should be ordered by the Cit» ?ursuant to the creation of a local improvement district, the Owners understand that the determination of benefit received and calculation of the assessment for the real property herein described may be,adjusted to account for any sidewalk improvements contributed by the Owners prior to the form- ation of the local improvement district, having general benefit to the district. 2. In the event such sidewalk improvement should be ordered by the City pursuant to the creation of a local improvement district, the Owners agree to defend and save harmless the City of Tukwila as to any loss, damage or delay suffered by the City as a result of any protest to the formulation of such improvement district, filed by or on behalf of the then owner of the real property described herein. 3. Nothing herein shall be considered as limiting the right of the Owners,, pursuant to the provisions and procedures of RC"Y 35.44.080, to object to the amount of the assessment then proposed to be levied against said real property. 4. Nothing herein shall be considered as in any way limiting the authority of the City of Tukwila to determine the necessity for public improvements nor the manner or method of providing the cost of construction of same. :2 5. In lieu of tl.Crovisions of Paragraphs 1 thr }jh 4 above, at such time in the future as said sidewalk public improvement is determined by the City to be needed and is ordered by the City to be constructed, Owners will not oppose the ordered improvement. The Owners shall furnish plans and specifications designed in accordance with requirements of the Tukwila Municipal Code and the Public Works Department for said project at their sole expense. Upon review and approval of said plans and specifications by the City of Tukwila Public Works Department, the Owners shall construct said sidewalk improvement and shall provide upon completion of said improvement the final document requirements to the Public Works Department of the City of Tukwila in accordance with the Tukwila Municipal Code (i.e., as- builts, plans, etc.). 6. If the construction of said sidewalk improvement has not been substantially completed within twelve (12) months from the date that the City gave Owners the order to construct the improvement, the City shall have the right to complete said construction. Owners shall reimburse City for all labor, material and other costs incurred in such work. 7. This Agreement shall be recorded in the records of King County and the covenants hereof shall be deemed to attach to and run with the Property and 'shall be binding upon the Owners, their heirs, successors and assigns, and shall apply after - acquired title of the Owners of the Property. 8. This Agreement may be amended or modified by agreement between the Owners and the City; provided such amended agreement shall be approved by the legislative authority of the City. Nothing in this Agreement shall prevent the City Council from making such further amendments to any ordinance, including the Zoning Ordinance, as it may deem necessary in the public interest. 9. This Agreement is made for the benefit of the City and for the benefit of the Owners of property within 300 feet of the property, and either the City or any such' property owner may institute and prosecute any proceeding ,at law or in equity to enforce this Agreement. To date the City has developed a set of contract plans for James Christensen Road fronting the east edge of your property. The James Christensen Road plan does not include the construction of sidewalks adjacent to your property. The design concept has received preliminary approvals from the Transportation Committee only, but the final plan for construction has yet to be adopted by the full Council. Also, the City is now developing a comprehensive central business district sidewalk plan, to be adopted through the Council in the coming months. At this time the City is not in the position to state where or if sidewalks fronting your property on Andover Park East or Christensen Road are to be built. We are awaiting adoption of the comprehensive sidewalk plan through the Council before these determinations can be made. Enclosed you will find a draft sidewalk agreement, allowing a delay of obligation for the sidewalk construction on Andover Park East and Christensen Road until such time as the comprehensive sidewalk plan is adopted. Of course, at the time of the comp plan adoption you should anticipate that sidewalks, if required, will be built per the comp plan requirements at your cost? Requested is your review and finalization of the sidewalk agreement (enclosed), and return to our office within the next (10) calendar days. Also, as required by Sections 3301 and 3305(a) Exception, the one -hour corridor construction should include the reception offices on the first and second floors and all openings into one -hour construction should be protected by 20 minute assemblies as required by Section 3305(h). 2. Verify that ceiling construction over corridor is of one -hour fire- resistive construction as required by Section 3305(g) . Provide roof and floor diaphragm nailing, ie. , joist toenailing to ledger, joist and blocking nailing. 3. Verify floor design live load and joist spacing at computer and file rooms. 4. Maximum allowable span for plywood subfloor (panel index 32/16) is 16" o.c. Table No. 25 S -1 second floor plan indicates joist spacing @ 24" o.c. and details indicate 16" o.c. spacing. Verify span and panel index. 5. Verify depth of footing "C ". 12" footing depth appears to be insufficient to resist beam shear forces. 6. Specify minimum concrete cover requirements per UBC 2607(g) 1. 9. 12" TJ135 @ 24" o.c. (roof) and 20" TJ135 (floor) do not appear to be adequate to carry the calculated floor and roof loads. 10. Indicate diaphragm chord reinforcement and provide splice detail for precast panels. Ordinance 1. Indicate construction type, occupancy classification and whether the building is to be sprinklered. 2. If building is to be 1 hour fire resistive construction verify that columns are to be enclosed. 3. It appears that corridor 204 is to be 1 hour fire resistive construction per UBC Section 3305(g) and openings to be protected as outlined in Section 3305(h) . 4. Door #219 does not appear to meet the regulations for Barrier Free Facilities, Section 402 "accessible opening" definition. 5. Verify whether the site parking, existing stairs, elevator and water closets are to meet the requirements of the Washington State Regulations For Barrier Free Facilities as required by Section .003. 6.
