For the reasons set forth in more detail below, I have concluded that Farwest must be allowed to install the storage tanks as an accessory use to their paint mixing facility. Farwest Paints operates a paint mixing facility in an area that the City of Tukwila has zoned M -1 (light industrial). At the time the facility was constructed and began operation, paint mixing was an outright permitted use in the zone then in effect. Some time after establishment of the paint mixing use, the City amended the zoning on the property to provide that paint mixing activities were no longer permitted. Paint mixing facilities are currently permitted only in an M -2 zone in which heavy industrial uses are allowed. Under these circumstances, it is clear that Farwest Paints' mixing facility is a legal nonconforming use at its current location. Farwest has recently proposed the addition of new storage tanks to hold bulk deliveries of various paints, resins, and paint solvents. Currently these materials are stored temporarily in 55 gallon drums located on the site. The new storage facilities would include 7,000 gallon storage tanks located within an open concrete vault. Farwest has requested an opinion from you and you have requested an opinion from me concerning whether this is an alteration or expansion of the existing nonconforming use and thus prohibited under the Tukwila Municipal Code. In Ferry v. Bellingham, 41 Wn. App. 839, 706 P.2d 1103 (1985), the Washington Court of Appeals considered a situation somewhat analogous to Farwest Paints. In the Ferry case, the L. Rick Beeler November 11, 1986 Page 2 Bellingham Board of Adjustment authorized the operation of a crematory in connection with an existing funeral establishment that was operating as a legal nonconforming use. A resident challenged the Board's findings that the installation of the crematory constituted a permitted accessory use to the funeral parlor. On appeal to the Court of Appeals, the Court set forth the following principle relating to the right to exercise accessory uses to a nonconforming use: A valid nonconforming use carries with it the right to the exercise of those accessory uses which are considered customary and incidental to the principal use. Whether a use is viewed in the perspective of a presently permitted use or use required to be permitted despite a present prohibition in the ordinance, there is no difference as to the extent to which it can be supplemented by customary accessory uses. The exercise of the right to engage in such an accessory use does not constitute a prohibited change of use where the accessory use does not achieve the status of an additional coequal use but remains subordinate to the previously existing nonconforming use in scale, volume and intensity. Of this there can be no doubt. Storage facilities are generally and customarily associated with manufacturing uses. The storage facility in question here will be used to store materials which are an integral part of the manufacturing process carried on at the main plant. In rooms or areas accessible to the public, storage of flammable/ combustible liquids shall be limited to quantities needed for display and normal merchandising purposes but shall not exceed 2 gallons per square foot of floor area actually being used for merchandising Class I, II or III -A liquids. 14. Containers under 30 gallon capacity shall not be stacked more than 3 feet or two containers high, whichever is greater, unless on fixed shelving or otherwise satisfactorily secured. 15. Containers over 30 gallons shall not be stored more than one container high. All containers shall be stored in an upright position. 16. The sprinkler system shall be designed and installed in accordance with UBC Standard No. 38 -1 and UFC Tables 79.200 -C, 79.200 -D -1 and 79.200 -D -2. In rack sprinklers shall also comply with UFC Standard 81 -1. (Density for High -Piled stock, extra hazard commodity). 17. Flammable or combustible liquids shall not be dispensed or mixed in liquid storage rooms unless such rooms comply with the electrical, heating and ventilation requirements of UFC 79, Division VIII. 18. Flammable /combustible liquid storage room(s) shall be designed and constructed in accordance with the requirements for a Group H, Division 2 occupancy and other requirements of UBC Section 902(c) and UFC Sec. 79.203. 19. Flammable /combustible liquid storage rooms shall be provided with adequate drainage.
