HomeMy WebLinkAboutOrd 0373 - Business License for Trade Stimulant Devices ) tt* /D06 CITY OF T WASHINGTON ORDINANCE NO. 373 7 3 AN ORDINANCE PROVIDING FOR THE LICENSING OF TRADE STIMULANT DEVICES, FIXING THE LICENSE FEES THEREOF, AND PROVIDING FOR PENALTIES FOR VIOLATION OF THE ORDINANCE. The City Council of the City of Tukwila do ordain as follows: Section 1. That it shall be unlawful to display, exhibit or expose for use, play or operation, or permit to be used, displayed or oper- ated, any punchboard, spindle game or similar device, whether used as a so- called "trade stimulant" or otherwise, without having a valid and subsisting "location owners' trade stimulant device license A separate license is required for each place of business and the same shall at all times be conspicuously posted and maintained therein. The City Clerk shall prescribe the form of such license, number the same, and shall indicate thereon the number of such devices which may be exhibited, exposed, used or played thereunder. Section 2. Wholesale Distributor License. It shall be unlawful for anyone to make or manufacture for display, exhibit for use, play or operation, by himself or by others or to engage in the business of selling, exchanging, or offering, or exhibiting for sale or exchange, any such device as described in Section 1 hereof, without having a valid and subsisting license so to do, hereby designated as "whole- sale distributors' trade stimulant device license which license shall be at all times conspicuously posted and maintained at the place of business of the distributor in Tukwila. The City Clerk shall prescribe the form of such license. Section 3. Wholesale distributor indemnity bond. As of January 1, 1963, each applicant for a wholesale distributors' trade stimulant device license shall secure and file with the City Clerk, and main- tain in full force and effect, an indemnity bond, approved as to sufficiency of the surety by the Mayor and City Clerk, and as to form by the City Attorney, wherein the surety on such bond agrees to in- demnify the City of Tukwila against any loss, losses or damages not exceeding the aggregate sum of $10,000.00, which said licensee and his servants or agents acting alone or in collusion with others, may cause to the city by failure to comply with this chapter as the same shall be amended from time to time, for failure to account for all monies and property due and payable under this chapter to said city. Such bond may be cancelled by the surety by thirty days notice in writing thereof to the City Clerk. Section 4. Salesmens' license required. It shall be unlawful for any business for which a wholesale distributors' trade stimulant device license is required by the provisions of this chapter, for any- one, in person, to offer to sell or sell or solicit the sale of any punchboard, spindle game or similar device, or to act as or represent himself as being salesman of any such device without having on his person a valid and subsisting license to do so, to be known as a trade stimulant device salesman's license, and it shall be unlawful to refuse to exhibit said license upon the request of any customer, the City Clerk or his deputy or any police officer. Application for a trade stimulant device salesman's license shall be made to the City Clerk on forms approved by him. The application shall be accompanied by a written statement from the holder of a wholesale distributor's trade stimulant device license that the applicant is or will be engaged, as the case may be, in the business of said holder as a salesman of punchboards, spindle games, or similar devices and re- questing that the applicant be granted a trade stimulant device salesman's license. Each applicant for a trade stimulant device salesman's license shall furnish the Chief of Police with a set of his finger- prints, to be taken at the Police Department on forms provided and in a manner described by the Chief of Police. The fingerprinting of the applicant and written statement herein before required in this section, shall not be required for renewal of a trade stimulant device sales- man's license. The City Clerk shall notify the Chief of Police of all applicants for such license and the Chief of Police shall notify the City Clerk of any conviction of the applicant of any offense in- volving moral turpitude or intent to defraud, committed within fif- teen years preceding such application. The City Clerk may refuse to issue a license to any applicant so convicted. Section 6. Fees for license. The license year shall be the calendar year. All license fees shall be payable on an annual basis and where the license is issued on or subsequent to July 1st of any year, the fee therefor shall be one -half the annual fee, which annual fee shall be as follows: Per Annum Location owners trade stimulant device license 25.00 Operators trade stimulant device license 100.00 Wholesale distributors sale stimulant device license 100.00 Trade stimulant device salesman's license 5.00 Provided, however, in addition to the above license fee, the City Clerk shall be furnished information by the above -named persons to allow computation of the remaining fees, which shall be an amount equal to five percent (5 of the potential value or yield of any such device. Such value shall be determined by multiplying the number of tickets or slips used in or on such device, by the money purchase price of each ticket or slip, irrespective of the method of attachment of each to the device. Everyone coming within more than one of the above classi ficationn shall pay the full license fee required of each of the par- ticular classification, provided that no operator's trade stimulant device license shall be required from a licensed location owner for operating such devices in his own premises, whether or not the device is owned by such licensee. Section 7. Name and address of operator and wholesale distributor required on each device. It shall be unlawful to sell, exchange, dis- play, or exhibit for use or operation in the City of Tukwila, any such device described in Section 1 hereof, unless the same shall have in- delibly printed, painted, stamped or impressed thereon, the name, address and telephone number of the wholesale distributor thereof, and if rented, leased, displayed or exhibited by an operator, the name and address and telephone number of the operator shall be indelibly printed, painted, stamped or impressed thereon. It shall be unlawful for anyone under the age of twenty —one years to play or operate any device such as described in Section 1 hereof. Section 9. Unlawful for Wholesale distributors to buy or advance fee for location license. It shall be unlawful for a wholesale distributor to buy or advance a fee for a location license and unlawful for a location licensee to accept the fee from a wholesaler or operater. Section 10. Penalty for violation. Any violation or failure to comply with any of the provisions of this Chapter shall subject the offender to a fine in any sum not exceeding $300.00; and any machine not so licensed may be subject to confiscation by the Chief of Police of the City of Tukwila and destroyed.
