MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE MINUTES OF THE REGULAR MEETING OF OCTOBER 4, 1976, BE APPROVED AS PUBLISHED.* Deputy City Attorney Hard, to clarify a statement in the minutes, explained that the number of cases handled through the Municipal Court are on the increase but that there had been a decrease in the number of hours spent by the City Attorney on court cases. He requested that the minutes be amended to show this. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE MINUTES BE AMENDED TO CORRECT THE REPORT OF THE CITY ATTORNEY. Mr. Crumbaugh is employed by M. A. Segale, Inc. and has attended many Council Meetings. Mr. Fred Shepherd, audience, stated that he wanted to compliment the City on how nice the play ground looks at the Foster Park site. He stated concern over the patrolling of the site. Mayor Bauch stated that the Tukwila Police cannot patrol the park as it is outside the City limits. Mr. Shepherd suggested notifying the groups using the facility and ask them to supervise the area after the games. Mayor Bauch stated he would discuss this with the Park Department. PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS Letter from Mayor Bauch to the Tukwila City Council was read concerning a pilot test program and encouraging their participation. The goal of the program is to strengthen the policy and decision making capabilities of local officials in cities and counties by providing them with some basic information on local government processes. Ms. Pesicka stated that participation in a program like this sounded like a good idea. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE MAYOR PURSUE THIS PROGRAM AND SEE IF THE CITY CAN PARTICIPATE. Letter from Mayor Bauch Funding for Valley Emergency Communications System Letter from Mayor Bauch Architec- tural Design of City Hall SECOND READING OF ORDINANCES Ord. #995 Providing for the transfer of funds to City Attorney Budget FIRST READING OF ORDINANCES Proposed Ordinance Adopting a revised Comprehen- sive Street Program Proposed Ordinance Setting longevity benefits for the employees of the City Proposed Ordinance Adopting the 1975 Edition of the Standard Specifi- cations for Municipal Public Works Construction 165'1 Letter from Mayor Bauch to the Tukwila City Council was read requesting approval of a budget for the remainder of 1976 for the Valley Emergency Communications System. Tukwila's prorated share of the budget is ten percent, which amounts to $994. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE COUNCIL ACCEPT THE MAYOR'S RECOMMENDATION AND PAY THE CITY'S SHARE OF THE BUDGET FOR THE VALLEY EMERGENCY COMMUNICATIONS SYSTEM. Mayor Bauch stated that this money would be paid from the Non Departmental /Miscellaneous Fund. He further stated that the 1977 Preliminary Budget contains $22,000 for operating costs and $9,000 for capital improvements. MOTION CARRIED. Letter from Mayor Bauch to the Tukwila City Council was read requesting that the Council authorize Mithun and Associates to expend $20,000 toward architectural design of city hall on the site the City now owns. f o ,yor Bauch stated thatlhis instructions to Mr. Mithun were to proceed the grant application. By the end of this week he will be that far, then have to stop until the grant is approved. This could take as much as 60 days and we will have lost this time toward design. Councilman Traynor stated that he has had a number of phone calls from citizens about city hall. After he explained the background to them they seemed to feel that if the City can get a grant then go ahead. He stated that it looks like this is a risk we are going to have to take if we hope to get this grant. Council President Hill said he agreed, we can't stop the architect. MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE CITY COUNCIL AUTHORIZE MITHUN AND ASSOCIATES TO EXPEND $20,000 TOWARDS THE ARCHITECTURAL DESIGN OF CITY HALL. MOTION CARRIED, WITH VAN DUSEN VOTING NO. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read an ordaince providing for the transfer of funds from Non Departmental /Miscellaneous Services to City Attorney to cover increased costs and amending Budget Ordinance No. 757. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT ORDINANCE NO. 995 BE ADOPTED AS READ. MOTION CARRIED, WITH MS. PESICKA AND VAN DUSEN VOTING NO. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE PROPOSED ORDINANCE BE READ. MOTION CARRIED. Deputy City Attorney Hard read an ordinance adopting a revised and extended Comprehensive Street Program in accordance with RCW 35.77. MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE PROPOSED ORDINANCE BE READ. MOTION CARRIED. Deputy City Attorney Hard read an ordinance setting forth longevity benefits for the employees of the City of Tukwila. MOVED BY HILL, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read an ordinance adopting the 1975 edition of the Standard Specifications for Municipal Public Works Construction as the code of the City of Tukwila; repealing Ordinance No. 643 and T.M.C. Chapter 13.12 and further repealing Section 14, Ordinance No. 342 and T.M.C. 14.12.160. Proposed Ordinance Amending Ord. #917 and TMC 20.04.050 relating to gambling activities RESOLUTIONS Resolution #557 Approving a three year Community Development Plan Resolution #558 Accepting the 1977 Wage Rates for the Fire Fighters Resolution #559 Repealing Res. #530 pertaining to acquisition of real property for park purposes DEPARTMENT REPORTS Mayor's Report 1655 MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE PROPOSED ORDINANCE BE READ. MOTION CARRIED. Deputy City Attorney Hard read an ordinance of the City of Tukwila amending Ordinance No. 917, Section 4, and Tukwila Municipal Code 20.04.050 tax levied- amounts designated relating to gambling and gambling activities. MOVED BY HILL, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read a resolution of the Tukwila City Council approving a three year Community Development Plan and one year program required for participation with King County in applying for funds pursuant to the Community Development Act of 1974. MOVED BY HILL, SECONDED BY SAUL, THAT RESOLUTION NO. 557 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read the resolution accepting the 1977 wage rates for the labor contract agreement negotiated with the Tukwila Fire Fighter's Union Local No. 2088. Hill questioned whether the percentage of the wage increase should be stated in the resolution. Attorney Hard stated that it is adequate as written. Hill informed the Council that the increase is 5.43 percent across the board and becomes effective January 1, 1977. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE RULE FOR SECOND READING BE SUSPENDED AND THAT RESOLUTION NO. 558 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE PROPOSED RESOLUTION BE READ. Traynor asked what piece of property this resolution covers. Mayor Bauch explained that Resolution No. 530 was for acquisition of the site referred to as the McAbee Property and that the property owners were not interested in selling at this time. MOTION CARRIED. Deputy City Attorney Hard read a resolution repealing resolution No. 530, adopted the 19th day of April 1976 pertaining to acquisition of certain real property for park purposes. MOVED BY HILL, SECONDED BY PESICKA, THAT THE RULE FOR SECOND READING BE SUSPENDED AND THAT RESOLUTION NO. 559 BE ADOPTED AS READ. MOTION CARRIED. Mayor Bauch read a letter from Police Officer Tom Kilburg to Police Chief John Sheets commending Tukwila Law Enforcement Explorer Post 999 and their advisor, Detective Bob Abbott, for their assistance in helping with the City of Tukwila's Crime Prevention Program. Treasurer's Report Attorney's Report Discontinuing of Tukwila Metro Bus Annexation of lower Foster Area, Special Election Committee of the Whole Meeting of October 25 Acquisition of Park Property, McMicken Area ADJOURNMENT 8:07 P.M. 656 Councilman Saul gave the following report from the City Treasurer: "During September, $1,450,000 worth of investments came due and were sold with a resulting revenue of $8,124.65 and $1,594,603.75 of surplus funds were invested Attorney Hard, reporting on the results of the LID #28 Lawsuit, stated that the trial started October 13th and ended October 18th. He gave a brief report on the procedures. The Judge ruled that everything the City did was proper and upheld all of the decisions of the Council, the Planning Department and the Public Works Department. Councilman Gardner noted that Metro is discontinuing the Tukwila bus service the first of the year. Mayor Bauch stated he hoped one of the Council Committees would study this problem and come up with a viable solution that would meet the needs but not cost a lot of money. Councilman Traynor requested this item be placed on the agenda for the Committee of the Whole Meeting of October 25, 1976, then be placed in a Special Committee. Mayor Bauch reported that the annexation has passed the Boundary Review Board review period and there were no protests. It is hoped that the Special Election date will be February 8, 1977 along with the School Levy. Councilman Saul requested two items be placed on the agenda for the Committee of the Whole Meeting of October 25, 1976. They are: 1. Park Board Recommendations 2. Discussion on a seminar with the City Council and the Department Heads. MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Mrs. Elanor McLester, 5118 South 164th, asked if the City is considering the purchase of recreation property in the McMicken Heights area. Mayor Bauch stated that the Council has set the acquisition of park property in that area as their No. 1 park priority.
