Councilman Traynor arrived at the meeting at 7:40 P.M. /p 7 TUKWILA CITY COUNCIL Tukwila City Hall COMMITTEE OF THE WHOLE MEETING Council Chambers Council President Hill called the Committee of the Whole Meeting to order at 7:36 P.M. APPROVAL OF MINUTES MOVED BY VAN DUSEN, SECONDED BY MS. PESICKA, THAT THE OCTOBER 25, 1976 MINUTES OF THE COMMITTEE OF THE WHOLE MEETING BE APPROVED AS PUBLISHED. CARRIED. Steve Hall, Director of Public Works, pointed out with a map on the blackboard the area served by Water District No. 38. He stated he would like to see if the City Council wished to establish a philosophy as in the past, and if so he would like to pursue it to a conclusion as soon as possible after the election of annexation of the greater Foster area so Water District 38 and the City of Tukwila may more effeiciently service common areas to the benefit of the citizens as well as the Water District and the City. Mr. Hall said the water rates were about the same. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT MR. STEVE HALL BE DIRECTED TO PROCEED AS HE WAS DIRECTED IN THE FIRST PLACE TO GO AHEAD AND SWITCH THESE SERVICES. CARRIED, WITH MS. HARRIS VOTING NO. Steve Hall, Director of Public Works, read letter from Water District 75 dated October 13, 1976 and then referred to his letter dated October 22, 1976 to Mayor Bauch as to the cost to the City of water and standby time for emergency storage. He said the reverse flow condition is also under consideration for an emergency fire bypass flow into the Segale Business Park area from the City of Tukwila. In discussing this matter with the City Council Mr. Hall said he would like to bring this matter to a conclusion so there will be a clear contractual agreement between Water District 75 and the City of Tukwila as to the cost of water and use of water through this intertie. Council President Hill asked about the cost of water if there is a fire and millions of gallons of water is used. Steve Hall said it is paid for by revenue money it is not going to cost anyone more money. Mario Segale, audience, said he would like to have Mr. Hall point out the location on the blackboard. Mr. Hall reviewed the intertie from the time of its proposal. He said the City, Water District 75 and Mr. Segale were all in agreement. Mr. Segale said Tukwila is getting water stroage and the benefits of the tank and Water District 75 is getting quite a bit of line in for free. Councilwoman Harris said she thought it was a breach of contract when the original contract said the water was to flow both ways and when it was installed it did not. Steve Hall said he agreed, but it is cheaper to correct this now rather than take them to court which the City would likely have to do. He added he would like authorization for the City to work with Mr. Segale and Water District 75. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT ADMINISTRATION BE AUTHORIZED TO PURSUE THE AGREEMENT WITH WATER DISTRICT 75 AND MR. SEGALE. CARRIEE MOVED BY HILL, SECONDED BY MS. PESICKA, THAT ITEM 5 ON THE AGENDA BE CONSIDERED BEFORE ITEM 4. CARRIED. Steve Hall, Director of Public Works, referred to letter dated November 1, 1976 from Mr. Mario A. Segale regarding LID #27. He stated LID #27 was formed in the hopes of finding a solution to what the City felt were major drainage problems in the industrial /commercial area. Once the LID was formed it was in the hands of the City. It was the City's responsibility to bring the project to a timely completion. His letter stated he was aware that a two year delay in completion of the project will result in an increase in project costs. He said he had repeatedly contacted the Public Works Department to urge the progress of LID #27. Council position concerning surplus property owned by Wash. State High- way Dept. Prop. Res. Stating City's Priorities as it relates to Housing Community Dev. Block Grant Applications problem or another. In conclusion he said the LID is not being imple- mented in a reasonable amount of time. The delay will result in an increased cost of the project. He stated he felt the City must bear the burdens resulting from inaction, or provide the drainage it desired if it does not wish to implement the LID. Steve Hall reviewed the progress of LID #27, stating the State Highway Department was the main source of delay. He said in a month they will be ready to go to bid; the start of construction will be in March and then it will be 6 9 months for completion. Mr. Hall said that once the LID is formed it cannot be stopped. Steve Hall, Director of Public Works, stated he would like to inquire of the Council their philosophy regarding surplus property and the retainage of surplus property at the intersection of Southcenter Blvd. and 52nd Ave. So. He said in his letter to Mr. Ed Ball of the Washington State Highway Department he had indicated what he considered the necessary right -of -way to cover a possible future two -way left -turn lane or stack lanes on Southcenter Blvd. for access to 52nd Ave. So. Council President Hill said he felt the City could use the 10 feet involved, perhaps as sidewalks. Councilman Traynor said he was opposed to the City giving away any property, it would be ideal for use as sidewalks, trails, or bike trails. MOVED BY TRAYNOR, SECONDED BY MS. PESICKA, THAT THE PUBLIC WORKS DIRECTOR BE DIRECTED TO PURSUE THE ACQUISITION OF SURPLUS PROPERTIES FROM THE STATE. CARRIED. RECESS MOVED BY MS. HARRIS, SECONDED BY MS. PESICKA, THAT THE COMMITTEE OF 9:20 P.M. 9:25 P.M. THE WHOLE MEETING RECESS FOR FIVE MINUTES. CARRIED. The meeting was called to order by Council President Hill with all Council Members present as previously listed. Proposed Ordinance Sgt. Mathews explained the need of the proposed ordinance, amending relating to Ordinance No. 989 of the City of Tukwila, ralating to "Disorderly "Disorderly Conduct" Conduct," by adding a provision that a person may be guilty of disor- derly conduct if such person fails to leave any public or private premises or places, after being requested to leave by the owner thereof or an authorized agent of the owner; and declaring an emergency. He continued this ordinance is necessary for the preservation of the public welfare, peace and safety and it should take effect immediately upon its passage. He said it is a trouble preventer, at the present time the City has nothing to cover this type of situation. Council- woman Harris asked if disorderly conduct is the proper category to put this in. In a court such a situation might be determined to be discrimination. Discussion continued with Sgt. Mathews explaining different situations that could arise that would be considered disorderly conduct. MOVED BY VAN DUSEN, SECONDED BY TRAYNOR, THAT THE PROPOSED ORDINANCE REGARDING DISORDERLY CONDUCT BE ON THE AGENDA OF THE NOVEMBER 15, 1976 CITY COUNCIL MEETING. Mayor Bauch stated those present knew that the intended use of the ordinance is valid when they are talking about persons failing to leave bars, etc., but it does not limit itself to that. He said what if this was used on a type of person who is different than the majority and the owner says he does not want him there. We have to be careful about this; if the owner wants a person to leave and he does not he will be subject to arrest. Sgt. Mathews said if the police were to mak( an arrest the owner would be the complaining party. *CARRIED, WITH MS. HARRIS VOTING NO. MOVED BY SAUL, SECONDED BY VAN DUSEN, THAT THE PROPOSED RESOLUTION STATING THE CITY'S PRIORITIES AS IT RELATES TO HOUSING AND COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATIONS PURSUANT TO THE HOUSING COMMUNITY DEVELOPMENT ACT OF 1974, BE ON THEAGENDA OF THE NOVEMBER 15, 1976 CITY COUNCIL MEETING. She said there are several age groups that need attention, such as the mid -teen age group, and the program needs to have a closer look with an eye to reconsideration. She said she did not think the Thorndyke Senior Activity Center was the No. 1 priority when the Council was considering the budget. Council President Hill said in the Council's planning there was a senior citizens program and this is part of it. *CARRIED. Mayor Bauch said as of this afternoon there are 41 absentee ballots out. He said out of the 41 absentee ballots it will take two "yes" votes to pass the Foster Golf Course. He continued it is fairly certain that it has passed. Mayor Bauch said he had a meeting with the Park Board planned for tomorrow and they were going to discuss the golf course. He said he also had a meeting with the Aliment family and their attorney to see what the next step would be. He said he was going to make certain recommendations to the Park Board, such as the establishment of a golf course ad hoc committee; with one person from the Park Board, one from the City Council, and one from Staff. He said he had designated Mr. Stoknes to be Staff Coordinator on the golf course. It would be too much for the Park Board to assume all of the responsibility of the details of the purchase, it is an administrative problem. He said there has been no purchase agreement on the golf course, there is no need to rush into it, there will be bargaining on the price. Mayor Bauch said he would present the recommendations of the Park Board to the Council next Monday evening. Councilman Van Dusen said the aim is to run it as a golf course, and the people were told it would be a recreational facility. Council President Hill said Mr. Aliment said he could rearrange the holes so there would be 18 holes and still have 8 to 10 acres for recreation. Mayor Bauch said the City has a serious problem on Cable TV. He said he would bring a package to the next meeting of the Committee of the Whole for the City Council to review. Mayor Bauch asked when the Council could schedule the budget hearings. Council President Hill said the Council would have an Executive Session on Wednesday, November 10, 1976 at 7:30 P.M. and after that time they could schedule the budget hearings. Councilwoman Pesicka said with respect to the undergrounding many of her neighbors are complaining they do not know what they are to do and when they are to do it. Councilwoman Harris said she wished to make reference to the item on the front page of the newspaper which cited the case of police officers going 80 -85 miles per hour through residential areas and across Highway 99 in pursuit of a stolen car. She said she thought the life of anyone is worth more than a stolen car. She said she was also alarmed at the procedures used on youth at the police station. She said the techniques need to be examined. She said she would like to make a request that the Mayor pursue this goal and establish a police review board made up of citizens of Tukwila.
