Besco Roofing Dear Bruce: Cunt' 1.. !•nnllusen, Map,' We have received your letter of July 22, 1991, along with the letter from Gerald Mylan of Besco Roofing, also dated July 22, indicating that the roof on the Fletcher's Fine Foods building "will meet Class B" specifications once the previously described emulsion is added. Based on those writings, together with material you have previously submitted including, but not limited to, the attachments to my letter dated April 26, 1991, I believe that the Building Official will issue a final permit after he or his inspectors have the opportunity to review the completed work. Bear in mind that this is no guarantee. Only the Building Official has the authority to issue the permit. Finally, some advice in your future dealings with the City of Tukwila. You have verbally insulted and berated the Building Official, and threatened both him and my legal assistant that you would "sue everyone in the City" if your demands were not met. I always advise my clients to be even more careful, and more deliberate, when others threaten lawsuits. The delays in resolving your lawsuit with Fletcher's and Segale were caused entirely by persons or entities other than the City of Tukwila. We have treated this roof just like any other roof in the City and, in fact, have responded quite promptly in assisting you to settle a lawsuit that you otherwise clearly would have lost. You would do well to consider these words in any future dealings you have with the City. You certainly owe the Building Official an apology. N Please contact me if you have further. questions. VanLusen, dlayor Over the past three days, I have spoken individually with each of you regarding the roof certification issue that I understand to be the heart of the captioned lawsuit. We understand the current situation to be substantially as set forth below. After initial confusion regarding the roof specifications and related U.L. class, not now relevant to resolving the issue, BeSco installed a roof on Segale Business Park's Building No. 734 in which Fletcher's Fine Foods was and remains a tenant. In completing the roofing contract, BeSco mistakenly used a "road tar" emulsion, rather than a "roof tar" emulsion. In order to rectify the problem, and to satisfy all interested parties that the roof will qualify as a Class B assembly, BeSco now proposes to add an appropriate "roof tar" emulsion. BeSco's analysis is predicated on the following attachments: Page 2 April 26, 1991 1. Attachment A. Evanite Permaglas specification index showing that asphalt emulsion specification no. E -3SP -W is utilized on Class B roofs; 2. Attachment B. The lab report from Professional Service Industries, Inc. dated November 29, 1990, indicating that the existing roof "needs a top coat of Fibrated Asphalt Emulsion to meet the requirements of Evanite Permaglas specification E -3SP- W"• 3. Attachment C. The letter from Intec /Permaglas (which we understand from Mr. Selikoff to be Evanite Permaglas' successor) dated March 19, 1991, indicating that "it is acceptable to recoat the roof with new emulsion over the old "; and 4. Attachment D. A Zellerbach Paper Company packing list which I had understood Mr. Selikoff to say represented the materials necessary to apply the "roof tar" emulsion required for the roof to obtain a Class B rating. This must be incorrect, however, given the May 15, 1986 delivery date on this attachment. Mr. Selikoff has requested the City's assurance that the Building Department will issue the final building permit once the "roof tar" emulsion is added. Mr. Shaker has indicated acquiescence if, in fact, the "roof tar" emulsion is sufficient for a Class B rating. Ms. Pinard, like Mr. Shaker, would like to ensure that the roof as modified meets the Class B criteria and, additionally, that it have the prior approval of Segale Business Park's structural engineer. You are all experienced counsel and, accordingly, I am sure that you understand the somewhat awkward position in which the City finds itself. In order to issue the final permit, we will require (as we do with all roofing projects) the contractor's certification and warranty that the roof assembly meets or exceeds the U.L. criteria for Class A or Class B roofs. Given the fact that this determination is at the heart of the captioned litigation, however, we think it appropriate for you all to review this material and inform us of your agreement or objection. It would appear that the bill shows that roofing asphalt was used, and not road tar as I had been told previously . by a representative from Sigale. Other than that 1 don't think the bill changes anything, because nobody has provided evidence or, a signed statement that the actual roof that was installed was • done so in accordance with an approved manufacturer's specification sheet for a Class E rated. roof. RECORD OF TELECOM DATE: 4/17/91 FROM: Duane Griffin, Bldg Off1 SUBJ: Fletcher's Meat Reroof - Bldg Permit #4324 I talked to John Early, Manager of Technical Services, Intec/Permaglas Roofing & Waterproofing Systems, 1-800-541-6230o on 4-17-91 and asked the following questions regarding his role in this issue: Was he involved in the actual purchasing, selling, or installation of the roofing material? Not that he was aware of. What is his involvement now? No involvement that he's aware of. What was the purpose of him writing his March 19, 1991, letter to Bruce Selikoff7 He didn't remember sending the letter but when I read it to him he said it was a standard statement he would make concerning their recommended maintenance of a Pern)aglas roof. Is he saying in his letter that Intec/Permaglas smooth surface roof membranes should be installed over other product name roofing materials, or only over Intec/Permaglass systems? He said he would be referring to Intec/Permaglass systems, again as a recommended maintenance procedure. Is he saying that a coating of Intec/Permaglas emulsion makes an unrated roof into a Class B roof? He sai.d absolutely not! He then reiterated what other roofing industry reps have told me ^- that each approval for a testing lab's rating classification is based on the specifications for all the individual components shown on the spec sheets. In other words, rating approvals are proprietary in naturev not generic, and cannot be mixed and matched. He said that their manufacturing warrantee would be voided by the use of materials other than the specific ones shown on the specification sheets. Can he offer me any advice as how to get a statement from the installer that he installed a Class B roof, Spec sheet _ v manufactured by 7 He said that they require similar legal type confirmation from contractors/installers prior to issuing a manufacturer's warrantee on a roofing job. When I asked about the different types of asphalt used on built- up roofs he said there are three types. Type II, III* & IV. He gave a quick explanation of what the suggested use of each type is but basically it deals with the melting points, and what roofing materials each type should be used with based on average temperatures, slope of roof, and adhesion qualities. When I. asked him the difference between road asphalt and roofing asphalt bor. said they were entirely different and what's used in roofing is "blown asphalt". I think the main issue, from the City's perspective, is that a roof was installed that was supposed to be rated, but based on the documentation submitted did not completely meet any UL specification sheet. My understanding of the UL approval system is that when they test proprietary type products or materials the product must contain all and only the materials as tested, not a mixture of materials from different companies. To date nobody from the roofing company involved has or will sign the city' s standard statement that requires the installer to certify the roof•was installed in accordance with a manufacturer's spec 1 sheet. FISHER ROOF INFO: 1. • On their original contract document Be Sco •Roofing said, "This roof . systen► is a• Conglas Roof Specification No. ND- 24C -SS or • equal.. This is a 15 year Class B Roofing assembly ". 2. • BeSco letter, dated June 1, 1987, addressed to me, seems to allude . that they. put on the above roof, then found out it was only a Class C roof, and the owner stated an unwillingness to pay until the roof was coated with 9 gallons of Cori -Glas emulsion and 3 pounds of chopped glass per square. a. In this letter they also say, "Please find the Con -Glas specification RI -24A -ECG which shows with this above coating, that this roof covering phould be a Class A. ". b. Attached to this letter was a small hand written note that said "The attached spec sheet is for the top coating only. (signed) Robert Larsen", and a copy of the Conglas Spec Sheet RI -24A -ECG. On this spec sheet they had circled in red ink the quantity data of certain items on the Material Requirements list, and had also crossed out the name Conshield and substituted the name BeSco for the name of the Aluminum coating. 3. In my Memo For Record, dated 7/14/87, I refer to conversations I .had with Mr Larsen from BeSco, and a Mr Musil, who was a roofing consultant working for BeSco, regarding the .above referenced letter. My memo states: " :[ told Mr Larsen that I would require our normal statement from him (see attached noti'we to Roofing Contractor Ltr) . In addition I told him I would not accept the RI- 24A -ECG Spec changing th; type of Aluminum Coating from Conshield to Besco. Mr Musil also stated to me, during a telecon I had with him, that Conshield Aluminum Coating should be used and that he would tell Mr. Larsen that. It is my understanding that. Mr Larsen will .finish the job & provide me with a statement and new spec sheet at or before the time he calls for a final inspection. ". 4. In a letter dated 12/11/87, from Jerry Mylan of BeSco Roofing to me, he stated: We BeSco Roofing Inc. are going ahead as agreed, with the'Segale & Fletcher Meats Building. I will notify the City when weather permits us to complete roof with gravel surface. It is our understanding that the application of gravel on this roof meets the Spec. "A" which exceeds the Spec. "B ", required in our contract and permit. See attached letter with spec." The letter that was attached was dated 12/3/87 and was from Mr Musil to Mr Mylari. In his letter Mr Musil stated: "The roof specification that you contracted for with the tenant was a Con -Glas ND -24 -SS which is only a Class C type roof. To make this a Class A type roof the new Con -Glas roof specification, number should be ND -24 -G on page 68 of the 1986 manufactures book. To complete this roof specification you will have to add pea gravel over the first three plies that you have installed." 5. On 4/5/88 I received a call from Ms Finard, attorney for Sigale, who said she was calling to update me on recent developments regarding the status /litigation between Sigale & Besco roofing company, She said that Besco had suggested that they would put a layer of gravel on the roof and that would qualify the roof as a Class B roof system. Sigale contacted the structural engineer of record, however, and was told the roof wasn't designed to hold that much weight. I asked Ms Pinard if she could provide me a copy of that letter and she said she would. She also said she had contacted a Bud Sields, 827 -5117, from Conglass and he is someone I could contact if a fix of some sort was proposed. I received the written confirmation of this conversation the next day (4/6/88). 6. The next action I'm aware of on this project came when a Bruce Selicoff, 622 -7205, contacted this office. The following is a quote of my memo, dated 2- 11 -91, that is in the file: "Mr Selicoff said he had recently been retained to work on the Fletcher Meat reroof project (Bldg Permit 4324). He had previously talked to Dave Larson and had faxed the attached correspondence to us. He thought he had everything under control and we would be able to final the permit based on the info he had provided. After we talked for awhile he became aware that he. did not have the same information and documentation on the project that I have in the folder, and that there are still quite a few unanswered questions, i.e., the Evanite Permaglas product that he submitted the spec sheet on is what he thought they had put on the roof - but this is a product that has never even been discussed before and is not what the previous correspondence says was used. At the end of our discussion he said he understood and agreed with my concerns and he would do some more research on the subject," 7. Before the above telecon had taken place I had contacted the P51 .Testing •Lab `technician who had done the test• and report of the sample of the roof that had been brought to them for analysis He had told me .he had run an analysis of a roof plug that had been brought to their office and issued what amounts to a generic report, in that it indicates the type of material that makes up the 'sample .but not the manufacturer. My understanding is that each manufacturer has their product tested using certain types of their. own product and the UL approval is based on the fact that those. specific products will be used and applied as tested, not mixed and matched with products from different companies. 8. On 3/20/91 Mr Selikoff faxed me a copy of a letter from a John Earley, Intec /Fe.rmaglass Roofing and Waterproofing Systems, Corvalis, Oregon referring to the recoating of the roof with their emulsion coating. I tried to contact Mr Early to find out what he was actually referring to in his letter and what the intent of it was, but nobody answers the phone at the number I have. 9. In the meantime Mr •Selikoff called inc again and said he had a hearing date scheduled for Friday, 3 /29/91, and if he didn't have this matter settled•by that time he wouldn't have any choice but to start lawsuit' action .against the city. 10. After the above phone I contacted the City Attorney's office to make an appointment to discuss this matter with him. In October of 1987 Segale Business Park agreed in writing that it would approve any "fix" for the Building 734 roof which meets the following two criteria: 1) It must have the approval of the City of Tukwila, and . any codes with which the City requires compliance; and 2) It must have the prior approval of our structural engineer, Dean B. Ratti (E.g. the building must be capable of supporting the fix without harming the structure, its ability to withstand snow load, etc.). In December of 1987, BeSco the roofer who last applied material to the Building 734 roof, proposed the application of pea gravel to the subject roof. We have attached a copy of Mr. Ratti's letter of December 29, 1987 analyzing this proposal and you will note that he did not approve same. At this time, BeSco has proposed the application of a different material. Once we have received specific information about . this material, we will submit the proposed "fix" to Mr. Ratti for his analysis. We completed this roof last year and the owner will not except the completed job until we coat the roof with 9 gallons of Con -Glas emulsion and 3 -lbs of chopped glass per square. After this has set install 1 gallon of BeSco aluminum per square. Please find the Con -Glas specification RI -24A -ECG which shows with this above top coating, that this roof covering should be a Class A. The roof slope is 0 -1/2 ". We are submitting this letter and information for your approval before we spend the large amount of funds out of our pocket just to complete our contract and resolve this problem for everyone. The owner has approved this work and I would like to get the city of Tukwila's approval in writing that this change would be approved by the city if this work was completed. We want to be assured before we start, that the city of Tukwila will accept this roof covering with these changes as meeting the city code. The city of Tukwila approved the origional roof covering specification on May 16th 1986 under the permit # 4324. Reinstall sheet metal edging. 1-l. This roof system is a Conglas Roof Specification No. ND- 24C -SS or equal. This is a 15 year Class B Roofing assembly. In all cases mechanical equipment will be raised such that roofing may run continuously under all such equipment. I. A heavy bead of plastic roof cement shall be applied around the base of each leaded or unleaded metal projection after the new roof system is installed. 3. General A. On completion of work, the buildings and grounds shall be left in a neat, clean condition acceptable to the Owner. D. Extreme care shall be used to prevent asphalt material from making contact with or resting or remaining on eaves, facia boards, any painted or stained surfaces, brick walls, sidewalks, lawns, shrubs, etc., and the Contractor shall be responsible for the cleaning of any such surface and restoring the area to its prior condition. E. No material shall be applied when moisture can be dectected on the roof or when moisture can be detected on any materials to be installed on the roof. 4. Miscellaneous Roofing Items A. All conduit support blocks shall be replace with Wolmanized 2x4 blocks cut of the same size and shape. If additional blocks are required to properly support the conduit, they shall be installed. The conduit shall be securely fastened to each support block. B. New pipe leads shall be installed replacing the existing leads. C. Four mechanical unit supports need to be secured, canted, flashed and a metal cap installed. The support shall be properly secured to the deck. After a two inch cant has been installed around each support and flashing is completed in accordance with the specifications, a galvan- ized metal cap shall be installed between the mechanical unit and each support. The mechanical unit shall be properly secured through the metal cap to the support. D. There are two 4x4's approximately twelve feet long supporting an internal cooking system. The Tenant has stated that they will be replaced with new treated wood. The new supports are to be properly flashed using two inch cants and the specified flashing procedures. 5. City Engineering Review The Tukwila Building Department will require that an engineer inspect the building or drawings to determine whether these buildings will support the extra weight of the new built -up roofing applied over the existing built -up roofing. Report cost shall be paid by Tenant. 6. Building Permit Cost Cost of plan check and building permit fees shall be paid by Tenant. 7. After making repairs to the existing roof surface called for in the specifications, the new roofing application can successfully be installed without adverse effects to its serviceable life resulting from the existence of the present roof surface. King County Superior Court Cause No. 87 -2- 00617 -4 .Dear Mr. Shaker: .This. letter will acknowledge receipt of your March 15, 1988 letter transmitting Charles Meyer's March 14, 1988 letter regarding the above- referenced matter. First, allow me to address Mr. Meyer's letter. Mr. Meyer seems at best confused about the.. representations made by Segale Business Park (SBP) in October, 1987. Reference is made 'to Mario A. Segale's letter to Morley Jasman, dated October 30, 1987 and setting forth the agreed criteria for any "fix" of the roofing job on Building 734. A copy of this letter is attached for your reference. You will note that Segale Business Park NEVER approved the use of gravel on the Building 734 roof as a solution. Instead, SBP provided objective criteria for evaluating any proposed "fix ". SBP has honored this commitment and Mr. Meyer's accusation of a 180 degree reversal is at the very least insulting. Mr. Meyer continues his letter by asserting that the roof on Building 734 is "three years'old, and has withstood all of the tests of time." Of what significance in this assertion? • P.O. BeSco April 5, 1988 Page 2 Mr. Meyer also asserts that the application of the originally specified roof coating would make the Building 734 roof a Class B roof. The specifications for this project were BeSco's. There is nothing in BeSco's specifications which suggests or condones the use of road asphalt on the roof. These specifications indicate that after applying unspecified and untested road asphalt to a roof, the roof may achieve a Class "B" rating by being "frosted" with the originally specified material. Finally, in order to avoid any misunderstanding and to provide information upon which our structural engineer may make his analysis, we would appreciate receiving specific information regarding the material which BeSco proposes to apply to the Building 734 roof. While we can read the language "originally specified coating" we are not roof experts and in order to make certain that we convey the correct proposal to Mr. Ratti and that Mr. Ratti has information sufficient to perform his analysis, we would appreciate BeSco forwarding specifications for this material on an order of specificity similar to those sent with BeSco's previously proposed "fix ". In response to your letter and in keeping with SBP's commitment,:.. we will forward BeSco's current proposal to our structural engineer as soon as we receive specifications upon which Mr. Ratti can make an analysis. In the meantime, you might suggest to BeSco that they approach the City of Tukwila with such specifications to inquire whether this application will meet part 1) of the two pronged criteria outlined in Segale Business Park's October 30, 1987 letter. I think the main issue, from the City's perspective, is that a roof was installed that was supposed to be rated, but based on the documentation submitted did not completely meet any UL specification sheet. My understanding of the UL approval system is that when they test proprietary type products or materials the product must contain all and only the materials as tested, not a mixture of materials from different companies. To date nobody from the roofing company involved has or will sign the city's standard statement that requires the installer to certify the roof was installed in accordance with a manufacturer's spec sheet. FISHER ROOF INFO: 1. On their original contract document BeSco Roofing said, "This roof system is a Conglas Roof Specification No. ND- 24C -SS or equal. This is a 15 year Class B Roofing assembly ". 2. BeSco letter, dated June 1, 1987, addressed to me, seems to allude that they put on the above roof, then found out it was gniy a Class C roof, and the owner stated an unwillingness to pay until the roof was coated with 9 gallons of Con -Glas emulsion and 3 pounds of chopped glass per square. a. In this letter they also say, "Please find the Con -Glas specification RI -24A -ECG which shows with this above coating, that this roof covering should be a Class A. ". b. Attached to this letter was a small hand written -'note that said "The attached spec sheet is for the top coating only. (signed) Robert Larsen ", and a copy of the Conglas Spec Sheet RI -24A -ECG. On this spec sheet they had circled in red ink the quantity data of certain items on the Material Requirements list, and had also crossed out the name Conshield and substituted the name BeSco for the name of the Aluminum coating. 3. In my Memo For Record, dated 7/14/87, I refer to conversations I had with Mr Larsen from BeSco, and a Mr Musil, who was a roofing consultant working for BeSco, regarding the above referenced letter. My memo states: "I told Mr Larsen that I would require our normal statement from him (see attached notice to Roofing Contractor Ltr). In addition I told him I would not accept the RI -24A -ECG Spec changing the type of Aluminum Coating from Conshield to Besco. Mr Musil also stated to me, during a telecon I had with him, that Conshield Aluminum Coating should be used and that he would tell Mr Larsen that. It is my understanding that Mr Larsen will finish the job & provide me with a statement and new spec sheet at or before the time he calls for a final inspection. ". 4. In a letter dated 12/11/87, from Jerry Mylan of BeSco Roofing to me, he stated: We BeSco Roofing Inc. are going ahead as agreed, with the Segale & Fletcher Meats Building. I will notify the City when weather permits us to complete roof with gravel surface. It is our understanding that the application of gravel on this roof meets the Spec. "A" which exceeds the Spec. "B ", required in our contract and permit. See attached letter with spec." The letter that was attached was dated 12/3/87 and was from Mr Musil to Mr Mylan. In his letter Mr Musil stated: "The roof specification that you contracted for with the tenant was a Con -Glas ND -24 -SS which is only a Class C type roof. To make this a Class A type roof the new Con -Glas roof specification number should be ND -24 -G on page 68 of the 1986 manufactures book. To complete this roof specification you will have to add pea gravel over the first three plies that you have installed." 5. On 4/5/88 I received a call from Ms Pinard, attorney for Sigale, who said she was calling to update me on recent developments regarding the status /litigation between Sigale & Besco roofing company. She said that Besco had suggested that they would put a layer of gravel on the roof and that would qualify the roof as a Class B roof system. Sigale contacted the structural engineer of record, however, and was told the roof wasn't designed to hold that much weight. I asked Ms Pinard if she could provide me a copy of that letter and she said she would. She also said she had contacted a Bud Sields, 827 -5117, from Conglass and he is someone I could contact if a fix of some sort was proposed. I received the written confirmation of this conversation the next day (4/6/88). 6. The next action I'm aware of on this project came when a Bruce Selicoff, 622 -7205, contacted this office. The following is a quote of my memo, dated 2- 11 -91, that is in the file: "Mr Selicoff said he had recently been retained to work on the Fletcher Meat reroof project (Bldg Permit 4324). He had previously talked to Dave Larson and had faxed the attached correspondence to us. He thought he had everything under control and we would be able to final the permit based on the info he had provided. After we talked for awhile he became aware that he did not have the same information and documentation on the project that I have in the folder, and that there are still quite a few unanswered questions, i.e., the Evanite Permaglas product that he submitted the spec sheet on is what he thought they had put on the roof - but this is a product that has never even been discussed before and is not what the previous correspondence says was used. At the end of our discussion he said he understood and agreed with my concerns and he would do some more research on the subject." 7.. Before the above telecon had taken place I had contacted the PSI Testing Lab technician who had done the test and report of the sample of the roof that had been brought to them for analysis. He had told me he had run an' analysis of a roof plug that.had been brought to their office and issued what amounts to a generic report, in that it indicates the type of material that makes.up the sample but not the manufacturer. My understanding is that each manufacturer has their product tested using certain types of their own product and the UL approval is based on the fact that those specific products will be used and applied as tested, not mixed and matched with products from different companies. 8. On 3/20/91 Mr.Selikoff faxed me a copy of .a letter from a John Earley, Intec /Permaglass Roofing and Waterproofing Systems,. Corvalis, Oregon referring to the recoating of the roof with their emulsion coating. I tried to contact Mr Early to find out what .he was actually referring to in his letter••and what the intent of it was, but nobody answers the phone' at the number I • have. 9. In the meantime Mr Selikoff called me again and said he had a hearing'date scheduled for Friday, 3 /29/91, and if he didn't have this:matter settled by that time he wouldn't have any choice but to start lawsuit action against the city.. .10..After the above•phone I contacted the City Attorney's .office °to make.an.appointment.to discuss this.matter with him. • The first time he was available was.Friday morning, at which time. We completed this roof last year and the owner will not except the completed job until we coat the roof with 9 gallons of Con -Glas emulsion and 3 -lbs of chopped glass per square. After this has set install 1 gallon of BeSco aluminum per square. Please find the Con -Glas specification RI -24A -ECG which shows with this above top coating, that this roof covering should be a Class A. The roof slope is 0 -1/2 ". We are submitting this letter and information for your approval before we spend the large amount of funds out of our pocket just to complete our contract and resolve this problem for everyone. The owner has approved this work and I would like to get the city of Tukwila's approval in writing that this change would be approved by the city if this work was completed. We want to be assured before we start, that the city of Tukwila will accept this roof covering with these changes as meeting the city code. The city of Tukwila approved the origional roof covering specification on May 16th 1986 under the permit # 4324. This request was submitted without anyone knowing this specified roof was only a Class C. The above change should close out this outstanding problem. Four mechanical unit supports need to be secured, canted, flashed and a metal cap installed. The support shall be properly secured to the deck. After a two inch cant has been installed around each support and flashing is completed in accordance with the specifications, a galvan- ized metal cap shall be installed between the mechanical unit and each support. The mechanical unit shall be properly secured through the metal cap to the support. D. There are two 4x4's approximately twelve feet long supporting an internal cooking system. The Tenant has stated that they will be replaced with new treated wood. The new supports are to be properly flashed using two inch cants and the specified flashing procedures. 5. City Engineering Review The Tukwila Building Department will require that an engineer inspect the building or drawings to determine whether these buildings will support the extra weight of the new built -up roofing applied over the existing built -up roofing. Report cost shall be paid by Tenant. 6. Building Permit Cost Cost of plan check and building permit fees shall be paid by Tenant. 7. After making repairs to the existing roof surface called for in the specifications, the new roofing application can successfully be installed without adverse effects to its serviceable life resulting from the existence of the present roof surface.
