The denial appears premised upon the conclusion of logistical difficulty in using the about 480 square foot carport accessory to the residence. No such standard appears in your code to justify such a denial. Further, use of such a standard could well allow the City to deny building permits based upon ad hoc, personal judgments. This is violative of constitutional due process protections. The denial also appears premised upon the carport being more physically subsidiary to a nonconforming shop area. We object to this on the same grounds as discussed above. Additionally, we know of no code provision in TMC 18.20 that restricts accessory uses due to physical adjacency to a non- conforming shop. Certainly TMC 18.70.040 contains no such reference. The facts do not support a conclusion that this is an expansion of a nonconforming structure. The applicant has affirmed that the carport is accessory to his residence. Suspicion is no basis for using standards not in the code to deny the permit. The denial also is predicated upon adding together the size of all structures other than the residence to indicate exceeding the 1,000 square foot limit in TMC 18.12.040(1). r : + Ms..Moira Carr Bradshaw October 9, 1986. Page2 That code provision provides that "private garage or carport can not exceed 1,000 square feet. It does not state "private garage, carport and /or all other non - residential structures" can not exceed 1,000 square feet. The interpretation is thus contrary to law. Further, structures accessory to residential uses do not include non - conforming uses. The latter is governed by a different code section. Therefore, we file this appeal on the basis that the departmental decision is contrary to law, arbitrary and capricious, unreasonable and violative of applicant's due process rights. Markham 15436 - 42nd Avenue South Tukwila, WA 98188 Dear Mr. Markham: Subject: Markham Building Permit Application 15436 - 42nd Avenue South (CN -86 -319) The Planning Department has reviewed your building permit for a 480- square foot carport. Below is a summarization of its evaluation of your applica- tion. The carport is being proposed as an accessory structure for your single- family residence at 15436 - 42nd Avenue South per Tukwila Municipal Code (TMC) 18.12.040(1). • The subject single- family lot has an established nonconforming use located adjacent to the single - family home. Your nonconforming use is a wholesale floral business with some light manufacturing associated with the floral materials. • The nonconforming use is enclosed within a structure measuring approx- imately 1,450 square feet, and is subject to TMC 18.70.040 and .050, Nonconforming Use and Structures, respectively. • An existing carport, which measures twelve feet by 37 feet is located between the nonconforming shop area and the property line to the south. • The proposed carport would be located in an area adjacent to the shop behind the existing carport. A door from the shop would lead into the proposed carport. In reviewing the site plan submitted (Attachment A), the proposed carport's location would make it logistically difficult to use as an accessory resi- dential carport and is more physically subsidiary to the nonconforming shop area. It would be located behind both the industrial shop area and garage and the sole access would be through the existing carport, which has a width of 12 -1/2 feet. The City, in its administration of the Zoning Code, has interpreted that a residential use is intended to be limited in the square footage of accessory structures permitted on a lot. The total com- bined size of the existing accessory structures on your lot exceeds the amount of additional floor area that would normally be allowed for a resi- dential use. if: Mr. William C.
