Dear Mr. Taylor:
Subject: Nonconforming Sign at South 158th Street
This letter is in response to your letter dated October 10, 1986, and our
telephone conversation of October 31, 1986. The Longacres sign at South
158th Street is a nonconforming sign since the advertisement on the sign is
for a location other than the premises on which the sign is located. The
street project to widen the intersection and add a signal light at West
Valley Highway and 158th Street requires to relocation of the Longacres
sign located on the southeast corner of the intersection.
The first issue deals with whether the nonconforming sign can be moved to
the proposed location in your letter. Section 19.23.030 of the Sign Code
lists the following three criteria when a nonconforming sign must conform
to code standards.
19.23.030(A) - There is a change in the use of the land, building or tenant
space within a building that a sign identifies.
This criteria does not apply since there is no change in land use,
building or tenant space within a building that the sign identifies.
19.23.030(B) - There are substantial alterations or enlargements to the
site or building exterior upon which the nonconforming sign is located
requiring issuance of a license or permit from the City of Tukwila.
The need for the sign to be altered is due to the City street improve-
ments and is not due to substantial alteration or enlargement of the
site or building exterior.
19.23.030(C) - There is a change in the letter style, size, color, back-
ground, message or sign structure which requires manufacturing of a new or
modified sign face or structure.

In your proposal, there is no change in the lettering, size, color,
message or sign structure. The change occurs in a new footing for the
sign, which will conform to code location requirements.
Based upon the above findings, the sign can be moved and retain the non-
conforming status as an off - premises sign. You will need to obtain a sign
permit before the sign can be moved.
The second issue involves whether an additional sign can be attached to the
freestanding sign. In reviewing the Sign Code, an additional sign would be
permitted so long as the total sign area of the freestanding sign did not
exceed size requirements (see Attachment A).
My delay in writing this letter has occurred due to my illness. I hope
this delay has not inconvenienced you. If you should have any further
questions regarding the Sign Code, please feel free to call me at 433 -1847.

Dear Morrie:.
It is my understanding that the widening of South 158th Street
will necessitate relocating the existing Longacres sign.
Longacres has my permission to temporarily relocate the sign
on my property to a location 20 feet east and ten feet south of
its current site. When this parcel of property develops, I
will specify that Longacres may share a free standing sign.
City of Tukwila officials may contact me to confirm this
understanding.
