The total number of fire extinguishers required for your establishment is calculated at one extinguisher for each 3000 sq. ft. of area. The extinguisher(s) should be of the "All Purpose" (2A, 10 B:C) dry chemical type. Travel distance to any fire extinguisher must be 75' or less. (NFPA 10, 3 -1.1 and UFC 10.301b) Extinguishers shall be installed on the hangers or in the brackets supplied, mounted in cabinets, or set on shelves (NFPA 10, 1 -6.6), and shall be installed so that the top of the extinguisher is not more than 5 ft. above the floor. (NFPA 10, 1 -6.9) Extinguishers shall be located so as to be in plain view, "(if at all possible), or if not in plain view, they 'shall be identified with a sign stating, "Fire Extinguisher ", with an arrow pointing to the unit. Let me assure you that we operate as complete and separate entities and have done so since Peoples Escrow was incorporated in 1968. We are registered with the State of Washington, H.U.D., V.A. and numerous federal regulatory agencies as separate agencies. In order to conduct certain phases of our business profitably, (namely compliance with H.U.D. regulation 4000.2(e)) separate identities were established. It should be noted that we do not now, nor will we in the future, share any facilities. We operate under separate budgets, management, and board of directors. It was our intent to use a common bathroom facility. However, in order to do this and comply with H.U.D. regulation 4000.2(e), the access doors to the common hallways adjoining the bathroom facilities must have locks on them. This is based on our attorneys interpretation of H.U.D. 4000.2(e). We realize that our occupant load per code is approximately 42 people. Peoples Mortgage has 12 employees and Peoples Escrow has 3 employees. Please realize that as a marketing operation, our salespeople are in the field 70% of the time. We currently have 6 of our 12 employees in outside sales. Customer traffic is very limited and very brief in duration. At peak times, our capacity (employees and customers for both Peoples Mortgage and Peoples Escrow) never exceeds 20 - 22 people. Lunches are staggered and most Peoples Mortgage employees go out of the building for lunch. I've solicited input from the President of Peoples Escrow, Arlene E. Kazala, for further clarification. (05 - Reprinted to replenish stock.) 1 4000.2 REV -1 3. Closing Costs. These charges may be paid by any party to the transaction, including the borrower and seller. They must be itemized on the mortgage settlement sheet and are limited as follows: (a) Credit Reports. The actual cost of the reports. (b) Property Surveys. Surveys are not required by HUD. .(hen the mortgagee requires a survey, its cost may be charged to the borrower. (c) Title Examination and Title Insurance. HUD does not require submission of title evidence when the mortgage is insured. If the mortgagee requires title examination and /or title insurance, its cost may be charged to th'e mortgagor. (d) Attorney's Fees. Fees for such things as prepara- tion of the mortgage documents may be charged to the mortgagor only if the service was performed by someone other than an employee of the mortgagee. (`e) ; Closing Fees. If the mortgagee or its employee acts as the closing agent, no fee other than the origination fee described in paragraph 7- 3.a.2. may be charged. Additionally, an employee of the mortgagee may not collect fees for closing loans for his /her employer and charge those fees to the mortgagor, even though he /she may do so in some capacity other than th,e mortgagee's employee. If :however, the closing agent has no identity of interest with the mortgagee and is an independent individual or concern engaged by the mortgagee to: close ' the loan, its fees may be charged to the mortgagor. A subsidiary .of the mortga9ee, es- tablished for the sole purpose of closing loans for the mortgagee, does not qualify under this definition.:. However, a subsidiary which r.egularly,. closes loans for several different mortgagees :. with separate and adequate facilities and office staff would qualify. The office manager /director who is responsible for the day -to -day operations of the subsidiary must be separate and apart from the parent company. The positions of higher management in both the parent company and the subsidiary, 1.e., president, vice - president, etc., board members and stockholders can be the same individuals for both -5 4/82 C 4000.2 REV -1 1 (7 -3) concerns so long as the day -to -day activities of the subsidiary are the responsibility of an office manager /director per the above. The fee charged to the mortgagor is limited to the actual cost to the mortgagee. Broker's Fees. Broker's fees may be paid by the mortgagor to a broker engaged by him, independently of the mortgage transaction, to obtain mortgage financing. These fees are prohibited, however, if the broker represents the mortgagee or if the mortgagee has any financial interest in the broker or his business. (f) (9) Recording Fees and Taxes which are customary or required in the area. (h) Tests or Treatments required by HUD (such as tests of water supplies, soil percolation tests for individual sewer systems, or testing for or treating insect infestations) may be paid for by any party to the transaction. Discounts. Reasonable and custanary charges in the nature of discounts may be collected from the borrower only under the following conditions: (1) The borrower is an operative - builder constructing homes for sale who executes the mortgage in his own name. (2) The borrower is constructing, repairing or rehabilitating a home for his /her own occupancy.
