Geotechnical Engineering and Geology Bob Storseth 15610 SE 24th Bellevue, Washington 98008 Subject: Dear Bob: June 23, 1986 Fostoria Park Building F Tukwila, Washington E- 2664 -1 On June 18, 1986, the writer visited the subject site to examine a parcel across the street. This parcel is located on the northwest corner of South 133rd and 44th Avenue South. It is fairly level along 44th Avenue South and then slopes up to the west and is covered with grass, trees and a few buildings. Bob Storseth would like to place the surcharge material that will be removed from the project site onto this particular site. The owner, Mr. Johnson, is concerned about the effect of placing this fill on this site. We have not performed any subsurface explorations on Johnson's site. Our opinions are based on visual observations and our knowledge of the local soil conditions. It is our opinion there will be no adverse impacts from placing the fill on this site provided it is placed in a workman like manner. If the level portion of the site is underlain by soft soils, as it most likely is, the placement of the fill will initiate some settlements before any building takes place on this site. This will he beneficial for future development. Prior to placing the fill the site should he stripped and cleared of any organics, trees and any other deleterious materials where the fills will be placed. The fill should be placed in horizontal lifts and be compacted to about 90 percent of maximum density ASTM D- 1557 -78 (Modified Proctor). We would also suggest placing several settlement markers prior to fill placement to monitor settlements. We also suggest that the placement of the fill be monitored and tested by representatives of Earth Consultants, Inc. and settlement readings be taken periodically by ECI. A minimum of two hours will be charged for each site visit. Review of field data and consultation by senior professional staff will be according to the hourly rate listed above. 2. Overtime rates of 1.4 times the regular rate for technicians will be charged for overtime hours if client's requirements make overtime work necessary. Portal to portal travel time is charged at the above hourly rates. SAMPLES — All samples of soil and rock will be disposed of upon submission of our report unless otherwise directed by the client. Upon request, we will deliver samples to the client, shipping charges collect on delivery, or we will store them for an agreed charge. BILLING — Fees and other charges will be billed on a monthly basis as work progresses and the amount of each invoice shall be due upon presentation and is past due 30 days after the date of such billing. A service charge of 11/2% per month shall be charged on all accounts not paid within 30 days. All expenses incurred for liening or collecting any delinquent amount, including but not limited to reasonable attorney fees, witness fees, charges at current billing rates for time spent by Earth Consultants, Inc. personnel, document duplication, and court costs, shall be paid to Earth Consultants, Inc. in addition to the delinquent amount. TERMINATION OF SERVICES — In the event that the client requests termination of the work prior to completion, we reserve the right to complete such analyses and records as may be necessary to protect our professional reputation and to complete a report of work performed to date. A termination fee to cover the costs incurred thereof may be made at Earth Consultants, Inc.'s discretion up to 100/0 of the charges incurred up to the date of termination. RIGHT OF ENTRY — Unless otherwise agreed upon, the client will furnish right -of -entry and locate utilities on the land for Earth Consultants, Inc. to perform borings, surveys and other explorations. We will take reasonable precautions to minimize damage to the land or utilities from use of equipment. Our fee does not include the cost of restoration of normal land damage which may result from our operations PUBLIC LIABILITY INSURANCE — We maintain Vehicle and Public Liability Insurance for bodily injury or property damage of $1.000.000 with an aggregate limit of $1,000,000. 11 the client requires further insurance coverage. this can be obtained with the additional cost borne by the client. WARRANTY AND LIABILITY — Earth Consultants, Inc. will perform its services within the scope presented to the client with the degree of skill, care and current standards of practice in the engineering profession. No warranty. expressed or implied, is made or intended in our proposals, reports or contracts. For any damage or any design defect, error, omission or professional negligence, our liability will he limited to a sum not to exceed $50,000 or our fee, whichever is greater. In the event the client does not wish or is unable to limit our liability to this sum, Earth Consultants, Inc. will waive this limitation to a maximum coverage of $1,000,000 upon the client's written request within 5 days after this agreement is fully executed, provided the client agrees to pay for this Waiver of Limitation of Professional Liability Charge, an additional sum equivalent to 5% of the total fee, or $350, whichever is greater. The maximum amount of our liability for a single - family residence shall not exceed our fee. The increased liability coverage is not applicable to single-family residences. Johnson and Fostoria Park Associates to clear and fill a portion of the property owned by Frank C. Johnson as shown on the attached plot drawing. Fostoria Associates agrees to place approximately 15,000 yards of fill material at their cost, and with no liability to Frank C. Johnson. The material will be placed in the general area outlined on the plot plan and will be dressed to function as pre-load. Fostoria Associates additionally agrees to clear the area, as shown on the plot plan, of overgrown ground cover. All fill material will become the property of Frank C.
