While I was doing this, the Special Inspector arrived on the site. As the pump truck had not arrived, I left the site for a short time to do another inspection, and returned at about 10:00 a.m. At this time they were about to start pumping concrete. I observed the concrete being placed for a time, then watched the Special Inspector take three cylinders. The first lift was rodded 35 times each with a piece of deformed rebar. The second lift was rodded 14 times in one cylinder 47 times in the next (this cylinder was now 1 -inch from full) and 20 times in the last cylinder. The third lift was done an two cylinders and the nearly full cylinder was filled, and then tape on the side. No slump test was taken. I requested that Norm Bray come to the site and he questioned Mr. Rose, (the Special Inspector) as to his certification. Mr. Rose produced a City of Seattle Certification for structural concrete. I advised Mr. Rose that I wasn't pleased with his method of taking cylinders and requested that he take three more. Norm asked Mr. Rose what the slump was and he stated "about 4 inches ". Norm asked if this was at the truck or at the end of the hose. Mr. Rose stated "mostly at the hose ". We walked away and I advised Norm that no slump test had been done. I stayed on the site and observed most of the pour. I also observed Mr. Rose take the additional three cylinders and he didn't do much better this time. It appears he doesn't know haw to preform this task. Mr. Rose never did a slump test while I was an site. I advised the job Superintendent that I had a problem with thaw Special Inspector; but we would handle it. It should be noted that the concrete appeared good and the work crew did a very good job placing it. MEMORANDUM June 9, 1988 Page 2• It was now 1:00 p.m. and I had to leave the job site to do other inspections, however, the job was nearly done. Norm Bray contacted Arnie Pitzen of Otto Bosenau and Associates, Inca advising him of the problem, and that we did not want Mr. Friedrick Rose back inspecting any jobs' in Tukwila. .Mr. Pitzen, stated he would .talk with Mr. Rose. At issue is whether there is adequate fire lane access to the south and west sides of the proposed building. The Shimatsus also own the property immediately to the south of the proposed new development, which property is subject to a long -term lease and which has an existing commercial development. Fire lane access for the north and west sides of that building is currently provided over the northerly 17 feet of the leased property. Shimatsus have the right to grant to the State of Washington an access easement over that same 17 -foot strip. That easement has been prepared, is in the process of being signed, and will be recorded in the very near future, according to William D. Stites, attorney for the Shimatsus. We will be supplied with a copy of that easement showing recording information as soon as possible. The specific question is whether, in light of the above facts, acceptable fire lane access to the proposed development is being provided. Because the existing development to the south could and presumably would be abated if the same strip should be unavailable for fire lane access for that building, and because it is extremely unlikely that the State of Washington will ever not need its access, it seems certain that the 17 -foot access strip will remain forever unobstructed and available as a fire lane for the proposed development. However, since the documents presently in existence, in our opinion, do not Mr. Nick Olivar April 20, 1988 Page 2 absolutely guarantee that to be the case, Larry Hard wrote to the attorney for the Shimatsus and I have enclosed a copy of his letter of March 16, 1988. The developer, Robert Schofield, has also been aware of all of the questions concerning the fire lane, and I will see that he also receives a copy of this letter. We now have received a copy of Larry's letter on which William Stites has acknowledged and agreed to the terms thereof. As you will see from reading that letter, the Shimatsus, through their lawyer, have now agreed that should the use of this fire lane ever be lost, the City may determine the new development to be not in compliance with the fire code and subject to appropriate enforcement measures, including abatement of use. Under these circumstances, we believe that it is extremely unlikely that the existing fire lane access will ever be lost, and that the City is fully protected by the property owner being put on notice and agreeing to the possible consequences of the loss of that fire lane.
