MINUTES
Mayor Bauch, presiding, led the Pledge of Allegiance and called the
Tukwila City Council meeting to order.

Councilman Saul asked about the bill for $404.00 to Sprague Co. for the
repair of lamp poles. Steve Hall, Public Works Director, explained that
occasionally there is a traffic accident involving a light pole. The
City has the pole repaired and, when ever it is possible, the City bills
the person that caused the damage. MOTION CARRIED.

SYSTEMS BE REJECTED AND THAT STAFF REVIEW AND GIVE THE COUNCIL AN ESTIMATE
ON THE COST TO DO THE INSTALLATION IN- HOUSE.
Councilman Gardner asked if the City would still have to go out for bids
on the required materials. Steve Hall, Public Works Director, stated
that according to R.C.W. 35.23.352 they would not.
Councilman Hill asked if the project can be done for the Engineer's
Estimate which was $14,732.00. Steve Hall replied no, as the cost of
materials and labor has increased considerably in the past year. He
stated that he would get the cost of materials and the electrical
contractor, estimate the City Staff's labor and return the information
to the Council. MOTION CARRIED.

THE FIRE DEPARTMENT COMPUTER SYSTEM AND OPEN BIDS AT 7:00 P.M. ON THE
7th DAY OF MARCH, 1977. MOTION CARRIED.
Floyd Robbins, Principal from the Tukwila Elementary School, speaking
on behalf of the students, staff and patrons of the South Central
School District thanked the City Government and all of its componants
for all of the many things they have done for the school. He sighted
examples of the services the Mayor, Police, Fire and other City Officials
have given the school. He noted the installation of the Big Toy installed
on the playground and how much it was being enjoyed. He stated that
this is a very good example of people working together.

Mayor Bauch referred to a request from Frank Todd for a sewer line
extension to serve a parcel of property presently in King County. The
site is between the present City boundary and Interstate 5, South
of South 178th Street. City Clerk read the letter from Steve Hall,
Public Works Director, concerning this sewer extension request. Steve
Hall states that he has discussed this with Mr. Todd and has advised
him of the following requirements:
1. Execute a developers agreement between the City of Tukwila
and Frank Todd.
2. Enter into an agreement with King County allowing us the franchise
to serve the area outside the City corporate limits.
3. Process an environmental questionnaire through Tukwila Office of
Community Development.
4. Approve plans and specifications for construction of system to
City standards.
5. Upon approval of installation, dedicate system to City of Tukwila.
He further states that an 8" sanitary sewer line would be adequate for
this facility and the surrounding areas.
City Clerk read Memorandum from Kjell Stoknes, OCD Director, concerning
this request for sewer line extension. Kjell Stoknes made the following
conclusions:
1. No commitments should be given by the City for providing utilities
to this property until the City's comprehensive plan for the area is
adopted.
2. Since the City is interested in controling land use in this area,
I would recommend that the City encourage its being annexed into the
City. One of the items the City can use to encourage annexation is
to deny use of City utilities to the property until the property is
annexed to the City.
3. If utility services are granted to this property and if King County
authorizes a rezone to a higher use, this in my opinion will be trend
setting for the entire hillside in that area. I don't believe the
City should put itself in a position to allow this to happen.
Councilman Hill questioned telling an applicant, no matter who it is,
that they have to annex to the City so the City can tell them what to do.
Kjell Stoknes, OCD Director, stated that his intent is to say that with
a utility commitment the City does not control the long range land
use on the property. He is suggesting that the Council not make a
commitment on land use by a utility agreement. At times, making a
commitment for utilities has been precedent setting which leads to
higher land use. The property is presently zoned for single family
and the need, right now, is for single family land use. He cautioned
not making this a decision by default but, make a land use decision first.
Councilman Pesicka asked if Steve Hall's recommendation was followed for
a Developers Agreement wouldn't it take care of this concern?
Kjell Stoknes stated that right now King County controls the land use
and they can rezone it.
Frank Todd, applicant, commented:
1. The area in question is in Water District #75 so Tukwila is not
concerned with the water service.
2. Not all of the land proposed to be served by this sewer is outside
of the City and he asked if the City is denying him the right to use
the property by rejecting a sewer hookup application.
3. The land he proposes to develop in the County can be served by
septic tanks.

Councilman Hill questioned the rationale in this being sighted as R -1
property. It lies between Industrial Zoning and the freeway and may
be more suited to apartments.
Kjell Stoknes stated that the single family suggestion is from the
Citizens Group that worked on the Comprehensive Plan. He sighted two
problems with the development of the area and those are slope and
soil stability. He further stated that, as far as the property within
the City boundaries, it is the City's responsibility to provide services.
Frank Todd stated that they do not propose to develop all of the land.
They are planning to leave the steep slope area in open space.
Mayor Bauch commented that all surrounding jurisdictions (Renton, Kent,
Auburn) refuse to extend sewers into unincorporated areas contiguous to
the City boundaries unless they annex.
Councilman Traynor noted that signs have appeared, expressing opposition
to annexing to Tukwila, in an unincorporated area where the City
extended sewer service. Maybe, property should annex first before
spending City money and staff time on services.
Frank Todd reminded the Council that he is not proposing that the City
spend any money, the City will gain considerably from this. He stated
that he did not know of any place in the law book where it prohibits
a person outside of the City from using the sewer system. The Tukwila
Municipal Code says that anyone wishing to hook up to the sewer
system in an area outside of the City has to get permission from the
Council.
Council questioned the boundary lines of the whole area and that
portion within the City boundaries. This was clarified by Mr. Todd.
Councilman Hill noted that the question before the Council is whether to
allow the sewer extension or not.

REQUEST GOING BY STEVE HALL'S FIVE GUIDELINES IN THE LETTER OF FEBRUARY
2, 1977.
Councilman Gardner questioned the development of this property having
an affect on LID #27. He stated that King County has requirements
concerning runoff.
Frank Todd agreed that the County does have an Ordinance and that they
will be building to County specifications.
Councilman Traynor noted that Mr. Todd did not say that they were going to
build homes on the property, he said that if they were to build homes
they did not need the sewer line, they could put in septic tanks.
Chris Crumbaugh, Segale Business Park, stated that Segale Business Park
is against apartments any where in that area.
Councilman Gardner reminded the Council again that this area (R -1 property)
was left out of LID #27.
ROLL CALL VOTE: 3 YES HILL MS. PESICKA, VAN DUSEN. 3 NOS GARDNER,
SAUL, TRAYNOR. MAYOR BAUCH BROKE THE TIE BY VOTING NO. MOTION FAILED.
City Clerk read the letter of resignation from her position on the
City Council submitted to Mayor Bauch by M. Catherine Harris.
Mayor Bauch stated that when he received the letter he contacted the
City Attorney,it was his opinion that a Councilperson does not resign
to the Mayor but to the appointing authority. The alternatives are:
1. Ask Mrs. Harris to submit a letter of resignation to the Council.
2. If she misses three meetings, declare the seat vacant.
3. Or, accept the letter as a letter of intent and declare the seat
vacant.

Mrs. Harris has indicated to Attorney Hard that this letter is all she
is going to write and it is a final letter.
MOVED BY VAN DUSEN, SECONDED BY TRAYNOR, THAT THE COUNCIL ACCEPT THIS
LETTER OF INTENT AND DECLARE THE COUNCIL SEAT OPEN. MOTION CARRIED.
Councilman Hill announced that anyone interested in the position may
submit a letter to the Council. He stated that all letters will be
opened at the Committee of the Whole meeting of February 14, 1977.
Attorney Hard stated that the person appointed to this position will
be eligible for the pay increase.
John McFarland, Administrative Assistant, explained the claim, involving
a police matter, had been submitted to the City. He has discussed this
with the City Insurance Broker who felt this was a question of legal
liability rather than insurance indemnity. He recommended disallowing
the claim as the City has met its legal obligations.

ITEM 7 -D (Seattle Rendering Works). MOTION CARRIED.
Kjell Stoknes, OCD Director, explained that this item was just informational
to the Council regarding the results of the Environmental Impact Statement
and the conditions that are going to be placed on the issuance of the
building permit. There are nine conditions that the applicants have
agreed to. The Puget Sound Air Pollution Control Agency states that the
air cleaning equipment the Rendering Works is going to install will
be effective, that is why 'smell'is not one of the conditions.
Council asked questions concerning the air cleaning equipment and odors.
Kjell Stoknes stated that the analysis received from the Air Pollution
Control Agency was that with the added facility you would not be
able to detect the smell at the property line.
John Phillips, Attorney for the Rendering Works, explained some history
on what has occurred. The impact statement was done as required. There
are two major concerns with this facility; the stink and the looks (which
go together) and the possibility of sewage water flowing into the river.
The Department of Ecology is looking over the water flowing into the river
and the Puget Sound Air Pollution Agency controls the smell issue. The
Rendering Works is operating today within all of the City ordinances.
The owner is spending over a million dollars to comply with the laws
of the air pollution control agency, to improve the visual impact and the
efficiency of the plant. The time delays that have occurred have
cost the owner a lot of money. Now,contracts are running out and
the owner has to get the equipment ordered and the plant builtimmediately
as cost just keep going up.
Councilman Hill again expressed concern over the possible increase in
odor.
Mr. Wesley Benefiel, Owner of the Rendering Works, stated that all he
can do is go by the manufacturers and they say their equipment will do
the job. Air Pollution Control agrees that the system will work.
Attorney Phillips stated that the Environmental Impact Statement was
circulated to many businesses and citizens and only one letter was
received back. Mr. Benefiel will be after the manufacturer if their
equipment doesn't do what they say. Also, the Air Pollution Control
Agency will continue to monitor any complaints.

Councilman Traynor asked, since the City is involved in a lawsuit, what
happens if the LID does not go through? Attorney Hard explained that
part of the lawsuit has been appealed by the property owners but
they have not filed a bond which is required to stop the construction.
They have been notified that the City is proceeding. There is a remote
possibility that the boundaries will have to be changed but the LID
will still be there. MOTION CARRIED.

Deputy City Attorney Hard read an ordinance of the City of Tukwila
establishing certain sewer charges to comply with the Federal Water
Pollution Control Act, as amended.
Steve Hall, Public Works Director, requested that this Ordinance be
placed on its second reading. He explained that this is the industrial
cost recovery charge being passed on to the Cities by Metro to comply
with Federal laws. The charge is to be billed to certain industries
and, if the users don't pay this, the City will have to. We have only
two business that fall under this requirement right now Shasta Beverage
and General Meats.

Councilman Traynor expressed concern that this resolution is opening
the door for another bill for the City. He would like assurance that
the employees would fund and not the City. Councilman Van Dusen suggested
this be written into the resolution. MOTION CARRIED.
Deputy City Attorney Hard read a resolution authorizing the Mayor to
execute a Deferred Compensation Plan for the employees of the City
of Tukwila.

Councilman Hill suggested that the resolution be worded for employee
participation only. Attorney Hard stated that the format for this
resolution is based on the suggestion of the Hartford Insurance Agent. He
believes the Council could make some changes but hasn't looked into it.
Councilman Van Dusen asked if it is possible to reconsider puting this in
the Committee of the Whole. Mayor Bauch reminded Council that there is
a motion on the table. He stated that Council is the one that controls
the purse strings. Benefits are not increased without a vote of the
Council. When the Firefighters withdrew from Social Security Council
made a statement to them that they would set up a non -City participating
plan. Now, the Firefighters are expecting Council to do so.
Councilman Traynor stated that the City has two contracts that say they
can go to binding arbitration which can overrule any decision made at
the Council table. Also, when the Firefighters withdrew they knew the
City was not going to contribute any money now, the Firefighters have
filed a lawsuit.

Deputy City Attorney Hard read a resolution authorizing the Mayor to
execute an agreement with Val Vue Sewer District for the purpose of
establishing latecomer charges for connection to City of Tukwila
sanitary sewer facilities constructed under LID #24.

Frank Todd, audience, asked if this sewer facility, proposed to be
connected to the City's sewer system, is outside the City limit.
Steve Hall, Public Works Director, stated yes, it is entirely outside
the City limits.
Frank Todd asked if this area is in the City's planning area. Steve
Hall replied that it is within the planning area. Mr. Todd stated
that he ownes a piece of property in this area and asked how this
might affect any plans for rezone that he might have.
Councilman Traynor stated that this is another governmental agency asking
for a hookup to the sewer system, not a developer.
Mr. Todd noted that this sewer was financed through an EPA Grant and asked
if refusal to grant him a hookup for land within the City and land outside
the City could affect future grant possibilities. He stated fhat Val
Vue is asking for the same thing he did and he was refused. It was
stated that the City can not ask Val Vue Sewer District to annex. Mr.
Todd stated that the Council is asking him to. He was told that he is
one person one developer right on the property line.
Mr. Todd stated that he just came in asking for a sewer hookup, he
did not ask for a rezone.
Councilman Saul asked Mr. Todd if he is going to request a rezone. He
replied no, but can't guarantee that someone else won't.

Deputy City Attorney Hard read a resolution authorizing the Mayor to sign
an amendment to the labor agreement between the City of Tukwila and
Teamsters Local Union No. 763 for the year 1977.

Mayor Bauch made the following announcements:
1. City Hall will be closed Friday, February 11, 1977 in honor of
Lincoln's birthday.
2. City Hall will also be closed February 21, 1977 which is President's
Day. The regular Council meeting will be held Tuesday the 22nd.
February 22, 1977 there will be a Public Meeting on the proposed
design of the streets and sidewalks.
3. The Police Officer's Guild will hold their Spaghetti Dinner, February
14, 1977, 5:00 8:00 P.M. at the Presbyterian Church.

Mayor's Report, 4. He discussed the ICMA Work Shop and asked Council approval to

5. He announced that the City Architect is ready to discuss the
final plans for City Hall.
MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS

OF THE CITY HALL PLANS. MOTION CARRIED.
City Attorney's Deputy City Attorney Hard discussed the three legal items that are
Report active at the present time.
1. Firefighters Local No. 2088 vs. City of Tukwila
This lawsuit has been filed and it basically involves two things:
a. That the Firefighters are entitled to all the money being
refunded by Social Security.
b. That they are entitled to have the City make contributions in

Last week was the oral argument before the Court of Appeals and
now we are waiting for the decision.
3. Wells vs. City of Tukwila
The settlement conference will be held February 16th and we may
have it resolved then, if not we will have it tried.
No Smoking Signs Councilman Traynor requested that the "No Smoking" signs be posted again.
Meetings Councilman Van Dusen reminded the Council that the Public Safety
Committee will meet Wednesday at 4:30 P.M. and that there is a
Special Meeting that evening at 7:00 P.M. to discuss the salary plan.
Sewer Extension, Frank Todd asked Council to please reconsider his request to get into
Frank Todd the Tukwila sewer system.
