VanDusen, Mayor MEMORANDUM Ross Earnst, Director Of Public Works Ron Cameron, City Engineer December 12, 1988 DeVaney Interurban Avenue Southwest Sidewalk Requirement Section 11.64.010 allows a certificate of occupancy for new construction to be issued without sidewalk construction if the applicant has made alternate arrangements with the Public Works Department and they are approved by the Planning Director. I recommend "stretching" this section to allow DeVaney's permits to be issued immediately for the following reasons: 1. Interurban is scheduled for construction - with sidewalks between 1991 -1993 and Mr. DeVaney has agreed to pay for proportionate (per foot) sidewalk costs at the time of construction. 2. Construction of sidewalk now (which Mr. DeVaney will do) would result in a possible traffic obstacle as the full street improvement is not there. 3. His agreement provides for the sidewalk improvement meeting the Tukwila Municipal Code purpose and intent. 4. The "waive" portion of this TMC section appears to be for relieving a property owner of the construction responsibility which is not occuring in this case - Mr. DeVaney agrees to providing a sidewalk. I explained this to Mr. DeVaney and that he should be able to pick up permits Monday with a sidewalk agreement revision of proportion cost share when Interurban Avenue is constructed. He will initial a sentence saying he will pay the City for sidewalk costs of the future City project. Tenant Improvement (88 -351) Dear Ms DeVaney: This is a follow -up to our conversation yesterday regarding the Planning Department's requirement to install a landscape irrigation system as a condition of the building permit. Prior to the building permit being signed -off for final inspection, which authorizes occupancy of the building, the landscape irrigation system must be installed and inspected by the utility inspector. Enclosed is a utility permit application which needs to be completed and returned to the Building Division with four (4) copies of your landscape irrigation system plan. Public Works will then review your plans and send you a letter notifying you that a permit is required. I will then prepare your permit which you will need to obtain prior to any installation of the landscape irrigation system. Nothing herein shall be considered as limiting the right of the Owners, pursuant to the provisions and procedures of RCW 35.44.080, to object to the amount of the assessment then proposed to be levied against said real property. 4. Owners will not oppose the ordered improvement. Upon review and approval of said plans and specifications by the City of Tukwila Public Works Department, the Owners shall construct said sidewalk improvement and shall provide upon completion of said improvement the final document requirements to the .public Works Department of the City of Tukwila in accordance with the Tukwila Municipal Code (i.e., as- builts, plans, etc.) 6. If the construction of said sidewalk improvement has not been substantially completed within twelve (12) months from the date that the City gave Owners the order to construct the improvements, the City shall have the right to complete said construction. Owners shall reimburse City for all labor, material and other costs incurred in such work. 7. This Agreement shall be recorded in the records of King County and the convenants hereof shall be deemed to attached to and run with the Property and shall be binding upon the Owners, their heirs, successors and assigns, and shall apply to after - acquired title of the Owners of the Property. 8. This Agreement shall be amended or modified by agreement between the Owners and the City; provided such amended agreement shall be approved by the legislative authority of the City. Nothing in this Agrewement shall prevent the City Council from making such further amendments to any ordinance, including the Zoning Ordinance, as it may deem necessary in the public interest. 9. He stated that the Planning Department recommends approval subject to the conditions as stated in the staff report. Dear Sir: The attached set of building plans have been reviewed by The Fire Prevention Bureau and are acceptable with the following concerns: 1. The total number of fire extinguishers required for your establishment is calculated at one extinguisher for each 1,500 sq. ft. of area. The extinguisher should be of the "all. purpose" (2A, 20 B:C) dry chemical type. The travel distance to any extinguisher must be 75' or less. (NFPA 10,3 -1.1) (UFC 10.301) Extinguishers shall be installed on the hangers or in the brackets supplied, mounted in cabinents, or set on shelves (NFPA 10, 1 -6.6), and shall be installed so that the top of the extinguisher is not more than 5 ft. above the floor.
