order.

1977 MINUTES OF THE COMMITTEE OF THE WHOLE MEETING BE APPROVED AS
PUBLISHED. CARRIED.
Kjell Stoknes, Director of Office of Community Development, intro-
duced Randy Peterson and his assistant as representatives of King
County Public Works Department, stating they would make a presenta-
tion on the Bow Lake Transfer Station that is in the planning stage.
He said they had been working on the plans since 1974. He showed a
model as to how the new transfer station would look and work upon
its completion. He said the refuse shredded as it is dumped into
the trailers and then it would be taken to Cedar Hills. People would
pay by weight for the refuse they were dumping. He said construction
is contemplated for this summer. The present transfer station will
have to be closed while construction is going on. It will take
about one year to construct. The transfer stations in Renton and
Algona will be used while this one is closed. He said the dust would
be controlled by a nozzle spray system in the top. Mr. Stoknes said
the representatives had come to present the plan only and there will
be a work session at the Planning Commission on this at a later date.

CONSIDERED AT THIS TIME. CARRIED.
Deputy City Attorney Larry Hard said the Office of Finance Director
could be added at any time. He said some cities create a Finance
Director who takes over the duties of the City Treasurer and leaves
the City Clerk office as is, or an office of Finance Director can be
created and have it take over the duties of Treasurer and City Clerk.
He said he thought this was legal, he could find nothing that says
a Finance Director could not do this. Council President Hill said
you could take the financial work from the City Clerk and still leave
her duties as they are. Councilman Van Dusen said in accordance with
the discussion they have had the Council wanted to put all of the fin
ancial duties under the Finance Director. He said they had planned
to take all of the finances from the City Clerk and leave her with he'
other duties. He said it seems there should be two people under the
Finance Director; one in charge of expenditures and one in charge
of revenues. Deputy City Attorney Hard said it is possible to draft
the ordinance in that manner. The financial responsibility would res
with the Finance Director and in terms of reporting you would deal
with one person. He said a new department would be created a
Finance Director with two people under that department head. The
office of City Clerk would be continued with the fiscal duties
removed. The Finance Director could have the City Clerk do other
duties if he wished to assign them. Councilman Traynor said the
City has an elected Treasurer and we want to keep her until the end
of her term of office but they want to get the Finance Director in
before that time. He asked how do we get the financial duties away
from the Treasurer and into the hands of the Finance Director in
order to get him going before January. Deputy City Attorney Hard
said the Council as an executive body has the power to take away all
but the minimum duties that she is charged with due to an elected
term. He said you cannot take away the elected powers. He said it
is possible to draft an ordinance that way. Joanne Davis, audience,
said she agreed that an elected Treasurer has an elected duty to
fill her job until the end of her term. If you have another person
come in how is a smooth flow going to take place? She asked why
didn't they have the present Treasurer have an additional five or
six months so she can help or assist someone coming in? Council
President Hill said the letter they had received from the legal

section of AWC said that as soon as the 0.M.C. was adopted the
position of elected Treasurer would not exist. He said he would like
to see a Finance Director hired before the 10th of January so he
could get established.

Deputy City Attorney Hard said the legal advice offered by AWC regard
ing the position of Treasurer has not been held up in court. He
said he thought it was possible to give the Finance Director all of
the fiscal responsibilities that the City Clerk has if they wanted to
hire someone for that job prior to January 10, 1978. Councilman
Van Dusen said maybe that is the best way to go, the City Treasurer
has said she would work with the Finance Director after he is hired.
Councilman Traynor said he thought there should be a proper transi-
tion. He said the Council was eager to get the City's finances
going in a profitable manner. He said it appears they cannot get
into it until January 10. *CARRIED.
Joanne Davis, audience, requested the City Attorney be present at
the Planning Commission hearings on the Comprehensive Plan. She said
there are some points of law that need to be ironed out, and the
presence of the City Attorney would be useful. She said she had
asked some questions at the Planning Commission meeting and the
minutes of the meeting had not reflected her questions. Kjell
Stoknes, Director of Office of Community Development, said whenever
he has questions on legal matters or anticipates a legal question
will arise he sent the information to the City Attorney ahead of time.
If he thinks the City Attorney should be present he asks for him.
Mrs. Davis said she would like to request legal counsel be present
at the Planning Commission meeting. Deputy City Attorney Hard said
he would be glad to come to any meeting the City wants him to attend.
He said he worked closely with Mr. Stoknes and tries to give him con-
templated answers to questions that may arise. He said maybe the
Planning Commission should ask for him to be there. Councilman Saul
said the Planning Commission can request the City Attorney as desired.
The Comprehensive Plan is important. Councilman Traynor agreed if
the Planning Commission wants to have the City Attorney present they
can make the request. Council President Hill said the Planning
Commission is an advisory group and he thought the Council should not
send someone to their meetings if they did not need them. Mr.
Stoknes said he would like to avoid legal costs. He concurred that
the Planning Commission should ask for legal counsel if they thought
it necessary. Mrs. Davis said if the legal questions are answered
at the time of the hearing they will not have to be hashed over at a
future date. She said her question at the Planning Commission meetinc
was not answered and did not appear in the Minutes of the meeting.
Mr. Stoknes said they tried to cover all angles and ask legal ques-
tions as necessary. He said if it is a private question and not the
concern of the Planning Commission then the private citizen should
seek their own legal counsel. Council President Hill said he thought
the Council should not sit here and say how the Planning Commission
should operate. Frank Todd, audience, asked if the Planning Commis-
sion had a quorum. Mayor Bauch said there are four members; there
will be a recommendation of three members next Monday night at the
Regular Council Meeting.
June Leonard, Director of Renton Area Youth Services (RAYS), was
introduced by Council President Hill. She outlined the services
rendered by her agency in working with troubled youth and their
families. She stated youths could be referred to RAYS by the schools,
the courts, the family, or self -help request. She said they had a
new program called Drug Information School that has been very succ-
essful. She said they provided counseling services to the individual
and to the family. She outlined the professional capabilities of
her staff. She said they furnish reports to the City showing
services rendered, but name identification is not furnished. She
said fourteen youths had been referred to her agency by the Tukwila
Schools and one by the police during 1976.

Peter Berliner, Director of Highiine Youth Service Bureau, outlined
the services extended by his agency. He said they had long term and
short term counseling and employment assistance. Councilman Pesicka
said part of the schools in Tukwila are in the Highiine School
District. Mr. Berliner said the services of his office were
available to the City of Tukwila if they chose to use them. He said
the funding comes from King County who pay about 50% of their funding,
He said if there are a number of referrals to their agency from
Tukwila, they will be asked to contribute to the cost.
Catherine Harris, audience, stated in 1975 the City Council initiated
the contract with RAYS. The budget for 1976 renewed this contract.
She said RAYS provides many services to youth and their families.
She read from a report of the House of Representatives, Office of
Program Research, and stated that Mr. Fleming, City Attorney, had
stated the success of RAYS was based on cooperation. She said
as of September 10, 1976 there had been no referrals to the agency
from the Tukwila Police Department and the municipal judge was not
aware of the City's contract with the agency. She said in September
1976 she had written to Mayor Bauch informing him the program was
being obstructed. She said she thought the City Council should be
inquiring into the reasons this agency was not being used. Council
President Hill said speakers during Council meetings were allotted
five minutes and there was a long agenda. He stated he felt the
matter of the use of RAYS was an administrative problem and not a
Council problem.

The meeting was called back to order by Council President Hill with
Council Members present as previously listed.
Kjell Stoknes, Director of Office of Community Development, presented
an overview of the proposed acquisition of Lookout Park. He said the
owner is willing to sell the property at the appraised price, and is
willing to have the appraisal firm of Shorett Riley do the apprai-
sal. He is also willing to tie the land up until the Interagency
for Outdoor Recreation meets on grant applications in September
1977. Mr. Stoknes said the appraisal will cost approximately $500.

Mr. Todd introduced Mr. Kerin, an engineer with the firm of Philip
M. Botch and Associates. Mr. Kerin outlined his past experience
with federal environment projects. He said the Comprehensive Plan
indicates Mr. Todd's property is in the intended sewer service of
the City. He said septic tanks are not desirable in that area and
in a little while the area would be asked to hook up to the sewer.
Council President Hill said he understood the City of Renton will not
extend water or sewer to an areas until the area is annexed. Council-
man Saul and Traynor said they thought the area should be annexed
and then sewer service extended to the area. Mr. Kerin said the
area has been identified in the Comprehensive Plan and if septic
tanks are put in they are detrimental to the health. Frank Todd,
applicant, said now there is a seventh member of the Council he
would like them to consider his request for sewer connection at the
next City Council Meeting.

Prop. Res. Author. Councilman Van Dusen asked if the Dick Anderson Insurance Agency was
Mayor to execute asked about any plan they might have for a similar type of insurance
Deferred Comp. Plan for employees. John McFalrnd, Administrative Assistant, said he had
met with Mr. Anderson and others and they had selected the Hartford
Plan. He said he had asked an outside agency to review the plan and
they had felt it was a solvent company. Council President Hill said
the wording was the way the Council wanted it. Mayor Bauch said at
the time the Firemen withdrew from Social Security they had asked the
City to make provisions so they could invest the money they would
receive from Social Security. He said the City has been notified
the money would be refunded within the month.

Councilman Traynor said the City has a lawsuit pending, trying to get
the City to pay part of a deferred compensation plan. He said
because of the union affiliation with certain groups of employees this
plan might be the subject of arbitration and the City might end up
paying for this program 100 He said not all arbitrators are fair
and the City might not have the final say as to whether or not we
pay into this. *CARRIED.

Councilman Traynor called attention to the fact that a lawsuit had
been filed against the City and Council Members by CHG International
as a result of the Council action on their request for a waiver
from a City resolution that stops development until the Comprehensive
Plan is completed.
John McFarland, Administrative Assistant, stated a seminar on
Decision Making would be held on the 18th and 19th of March for
Department Heads and the Council. He said the time would be announce(
Mayor Bauch said he had been invited to speak at the State LegislaturE
on Thursday, March 3, 1977 and present Tukwila's side of the story on
sales tax.
