Mayor Bauch, presiding, called the Regular Meeting of the Tukwila
City Council to order.
BOHRER, GARDNER, HILL, MS. PESICKA, SAUL, TRAYNOR, VAN DUSEN.
MOVED BY MS. PESICKA, SECONDED BY HILL, THAT COUNCIL GO INTO EXECUTIVE
SESSION. MOTION CARRIED.
Executive Session was requested by Deputy City Attorney Hard to
discuss LID #25 with Council. Mayor Bauch, all Council Members,
Steve Hall, Public Works Director, and Attorney Hard were present.
MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE EXECUTIVE SESSION
BE CLOSED. MOTION CARRIED.
After a 5 minute recess, Mayor Bauch led the Pledge of Allegiance and
called the meeting back to order with all Council Members present.

MOVED BY HILL, SECONDED BY MS. PESICKA, THAT THE MINUTES OF THE SPECIAL
MEETING OF APRIL 11, 1977 BE APPROVED AS PUBLISHED. MOTION CARRIED.
MOVED BY HILL, SECONDED BY SAUL, THAT THE VOUCHERS BE ACCEPTED AND
WARRANTS BE DRAWN IN THEIR RESPECTIVE AMOUNTS. MOTION CARRIED.

This being the date set and proper notice having been published,
Mayor Bauch opened the public hearing to consider the proposal to change
Maule Avenue to a one -way street. Steve Hall, Public Works Director,
explained the recommendation is to change Maule Avenue to a one -way
street, north bound, from South 147th to South 143rd Place. Maule
Avenue runs parallel to and on the east side of Interurban Avenue and,
at the present time, it does not meet city standards.
Ron Mettler stated that south bound traffic could affect the Village
Green Apartments and agreed that north bound was the best direction.
Trucks use the apartment parking area for turn around now and there
is no way to keep them out but, that section is not a part of Maule
Avenue. He asked if something could be worked out so they are not
using the entrance to the Village Green for access to Maule Avenue.
Steve Hall suggested the posting of signs since it is private property.
There being no further comments, Mayor Bauch declared the public hearing
closed.
Councilman Hill asked if, on private streets, they could put in
speed bumps. Steve Hall stated they could but he didn't know about the
liability.

Ron Mettler, audience, noted that the Comprehensive Plan has passed the
Planning Commission and is now coming to the Council. He suggested,
since it has been in the review stage for so long, that the City
publish the old Comprehensive Plan and the new one in the Record
Chronicle to let the citizens know what is taking place. Mayor Bauch
stated that it was a good suggestion.
Mayor Bauch recognized Kjell Stoknes, who introduced Don Williams, the
new Recreation Supervisor. Mr. Williams replaces Richard Hunt who
resigned from the position in March.
PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS
Letter from Robert H. McQueen, Tukwila Police Officers Association,
was read. The letter states that the Police Officers Association is
a strong supporter of youth activities and are in the process of
beginning a one -year scholarship program at Foster High School. They
are asking Council to allow the Association to contract with a
vending machine company for the installation of such machines in
new city hall. The Association would ask only for a small percentage
to offset the cost of maintenance and bookkeeping, leaving the
remainder to be used for youth activities.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT COUNCIL COMPLY WITH THE
REQUEST OF THE TUKWILA POLICE OFFICERS ASSOCIATION.
Councilman Hill stated that the Police Guild has done a lot for
the youth of the City and, if we can help them, we should. Councilman
Van Dusen said he had discussed this with Officer McQueen and feels
that their intentions are honorable. Councilman Traynor concurred
with the comments made by Councilman Hill. Councilman Pesicka said
she felt it a good way for them to raise money. *MOTION CARRIED.
Voting Delegates Letter from Kent E. Swisher, Executive Director, Association of Washington
1977 Annual AWC Cities, advising the City that prior to the annual meeting of the
Convention Association each member city shall designate three delegates to
represent such city in the affairs of the Association. Mayor Bauch
stated that there are enough people going this year so the City
should select their delegates.
MOVED BY HILL, SECONDED BY SAUL, THAT THE MAYOR REPRESENT ADMINISTRATION
AND THAT TRAYNOR AND VAN DUSEN REPRESENT THE COUNCIL AS VOTING
DELEGATES.
Mayor Bauch asked if there were any other nominations, there being
no additional names submitted he declared the nominations closed.
MOTION CARRIED.
Letter from Mayor Bauch was read referring to a memo from Gary
Crutchfield, Assistant Planner, stating that Mr. Charles Dow, Board
of Adjustment member, has not attended the past two meetings. In
checking it was discovered that Mr. Dow has moved from Tukwila and
left no forwarding address. In the Mayor's letter he is declaring
Mr. Dow's seat vacant on the Board. He urges the Council to approve
this action as socq as possible. Councilman Traynor stated that
this Board is one our most important and they need a majority there.
MOVED BY TRAYNOR, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH THE
MAYOR'S RECOMMENDATION AND DECLARE THE SEAT VACANT. MOTION CARRIED.
Councilman Hill read a letter from Sam Ruljancich, Firefighters
Representative, asking the City to invest the shares received from
Social Security contributions for he and Richard Franklin. Mayor
Bauch explained when the proposal was first presented to the Firefighters
to have the City invest their share they requested that their shares
be returned to them. There is no way we can receive the money back
from two employees. We would have to create a special fund and it
would incur considerable cost to the City.

Councilman Hill stated that this is just for two employees, if it
were for all of them then we could do it.

MOVED BY HILL, SECONDED BY VAN DUSEN, THAT COUNCIL INFORM THE EMPLOYEES
OF THE EXPENSE IT WOULD BE FOR THE CITY TO INVEST THEIR FUNDS AND
SUGGEST THAT THEY INVEST IT THEMSELVES. MOTION CARRIED.
Rockery on So. At the last regular meeting Council asked Steve Hall, Public Works
144th, J. North Director, to contact Tri-State Construction about rockery rocks. Mr.
Property Hall reported that he received a letter from Tri -State stating that,
at this time, they do not wish to dispose of the rocks on their
site on South 144th. Councilman Hill said that he noted there is a
house being built on the property and wondered if it was for the
Norths or if the property has been sold. He was told that the
building permit was issued to a Mr. and Mrs. Housley. Councilman
Hill said that the agreement between the Norths and the Church
states that the Church will put the wall back. If the Church had
put the wall back at that time the City would have had to take it
out plus all of the dirt when South 144th et al was improved. This
seemed like a waste of time so he discussed this with the City. The
City was already replacing the wall when they discovered the agreement
with the Church so they stopped work. Legally the Church is liable
to put it back but, he thinks the City is morally obligated.
MOVED BY HILL, SECONDED BY SAUL, THAT COUNCIL CONTACT MR. AND MRS.
HOUSLEY AND SEE HOW HIGH THEY WANT THE WALL AND PUT IT IN.
Councilman Traynor stated that so far he has seen nothing that
says the City is obligated. Councilman Van Dusen asked if this
agreement would have any effect on the sales contract. Attorney
Hard stated that this is the first time he has seen the agreement but,
he did not believe it was an obligation running with the land.
MOTION FAILED
Telemetering In January bids were opened for telemetering systems for four
Systems, sanitary sewer lift stations. In February, at the recommendation, of
Approval Steve Hall, Public Works Director, all bids were rejected. In a
letter dated April 4, 1977, Mr. Hall is requesting that Council
concur with staff's recommendation and allow City forces to proceed
with the purchase and installation of the telemetering systems using
City forces and contractual electrical work.
Councilman Hill asked if the City had to go out for bids again since
the price is over the maximum bid requirement? Steve Hall explained
that the City did go out for bids and that satisfies the bid law.
It has been shown that the City can do the project for less than
the contract bid price.
MOVED BY HILL, SECONDED BY MS. PESICKA, THAT COUNCIL ACCEPT THE
RECOMMENDATION OF STEVE HALL AND PROCEED WITH THE TELEMETERING SYSTEMS
INSTALLATION. MOTION CARRIED.
Ordinance #1012 Councilman Traynor recommended that Council adopt both the Ordinance
Adopting the on the Building Code and the Ordinance on Fire Zones then, at the
1976 Uniform next Committee of the Whole Meeting have the Fire Chief and the
Building Code Building Inspector there to explain all about Fire Zones. Fire
Zones have to do with the safety of the people and the Firefighters
and it is critical.

Establishing
Fire Zones Deputy City Attorney Hard read an ordinance creating and establishing
Fire Zones and repealing former related ordinances.
Councilman Van Dusen stated that he needs more information on the
Fire Zones. Councilman Traynor explained that the adoption of the
previous ordinance is useless without this. Mayor Bauch stated that
this is just a separation of two subjects from the original ordinance.
If you'? going to change the ordinance you can do it later. Council-
man Traynor again suggested having the Fire Chief and Building Inspector
explain Fire Zones. Councilman Van Dusen agreed it was a good idea.
MOTION CARRIED.
MOVED BY HILL, SECONDED BY SAUL, THAT ORDINANCE NO. 1013 BE REFERRED
TO THE COMMITTEE OF THE WHOLE MEETING OF APRIL 25, 1977 AND HAVE
THE FIRE CHIEF THERE. MOTION CARRIED.
Resolution #581 MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE PROPOSED RESOLUTION
Authorizing BE READ. MOTION CARRIED.
Participation in
an Interlocal Deputy City Attorney Hard read a resolution authorizing participation
Agreement in an Interlocal Agreement establishing the restructured Puget Sound
Establishing Council of Governments.

BE ADOPTED AS READ. MOTION CARRIED.
Mayor Bauch explained that, in the new Interlocal Agreement and
the By -laws for PSCG, it requires that the Delegate and Alternate
be elected officials. The Mayor was previously elected Delegate
now, he is asking Council to select an Alternate.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT COUNCILMAN BOHRER BE
APPOINTED AS THE ALTERNATE. MOTION CARRIED.
Mayor Bauch reminded Council of the Special Meeting set for Thursday,
April 21, 1977, 7:00 P.M. to discuss the new Subdivision Code.
Mayor Bauch called Council's attention to two items under consideration
in Olympia. The first is titled 'Private Property Rights' and has to
do with outdoor advertising signs. (Senate Bill 2339 and Senate Bill
2956) If this bill would pass, in order to enact the Grandfather
Clause in our Sign Code, the City would have to pay the owner of
the signs and the property owner where the sign is located for taking
them down. He recommended that Council go on record as opposed to these
two bills.

MAYOR TO GO TO OLYMPIA AND EXPRESS OPPOSITION TO BOTH BILLS.

The second is Senate Bill 2934. This bill would abolish all Municipal,
District and Magistrate Courts and put them under the State Court
System. Mayor Bauch explained that this would increase the overtime
cost to the City, in Police Officers court time, by 200% to 300
The City would lose control as to when court cases were held.
MOVED BY HILL, SECONDED BY SAUL, THAT COUNCIL OPPOSE THIS BILL
AND DIRECT THE MAYOR TO SEE THAT THIS OPINION IS KNOWN. MOTION CARRIED.
King Co. Council, Mayor Bauch informed Council of a new concept introduced by the
Sphere of County Council. They are holding public hearings on it next Monday
Influence and he intends to attend. It is called the Spheres of Influence.
The idea is that the County would sign Interlocal Agreements with
Cities agreeing to coordinate and work with the Cities where
anything is to be done in the City's Planning Area. This
includes such things as roads, building, rezoning etc. The agreement
would work in reverse also where decisions would affect the adjacent
area. This is brand new concept and they are starting to explore it.

MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS
Public Safety Councilman Van Dusen announced a public hearing to be held before the
Committee Public Safety Committee, May 12, 1977, 7:00 P.M. in the Council
Report Chambers to discuss a proposed Ordinance requiring security devices
for prevention of burglary in apartment houses, hotels and motels.
He stated that they are also working on a 'Noise Ordinance'. They
will hold a Committee Meeting on April 28, 1977, 4:00 P.M. to hear
Mr. Dave Saunders, Department of Ecology. They are in contact with
Mr. Pete Bricie of the University of Washington who has done several
noise studies. He will present a proposal for a study in the City.
The study would be done by students so the only cost would be
mileage. He stated that they are also studying the Ordinance on
Amusement Devices.
Mayor Bauch commended Councilman Van Dusen and his Committee for
being the first to hold a public hearing for input before going
to the Council.
Tukwila City Councilman Traynor asked if the City has a City Parkdevelopment plan.
Park He noted that the had been to the park and couldn't tell what was
going on. He said that some trees had been chopped down and felt
we need a development plan if we don't already have one. Steve Hall
said, to the best of his knowledge, we do not have a development
plan. The trees were chopped down by vandals.
Report, Public Steve Hall reported there will be a Pre- Construction Conference on
Works Department LID #27, Wednesday, April 20, 1977, and hopes to get this under way.
The appraisals on the Rights -of -way on LID #28 are expected this
week. Attorney Hard explained that the lawsuit on this LID is in
the Court of Appeals and he expects the Judges to hear the arguments
sometime in the Fall.
