CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS PUBLIC HEARING Vacation of a portion of South 168th Street located East of 153rd Ave. South TUKWILA CITY COUNCIL COMMITTEE OF THE WHOLE MEETING M I N U T E S TRAYNOR, HILL, SAUL, VAN DUSEN, BOHRER. /706 City Hall Council Chambers Council President Hill called the Committee of the Whole Meeting to order. APPROVAL OF MINUTES MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE APRIL 11, 1977, MINUTES OF THE COMMITTEE OF THE WHOLE MEETING BE APPROVED AS PUBLISHED. CARRIED. This being the date set and proper notice having been published, Council President Hill opened the public hearing to consider the proposal to vacate a portion of South 168th Street, located east of 53rd Avenue South. Kjell Stoknes, Director of Office of Community Development, indicated on the wall map the area that was under consideration. He said this matter was discussed at the Park Board meeting last week and they recommended against it, that it be denied. He said the Office of Community Development concurred with the Park Board recommendation. Council President Hill said consideration would be given first to those favoring the vacation and then those who are opposed. Wallace W. Hoffner, resident whose property adjoins the property to be vacated, said no one would want a park just 60 feet wide. He said he had trimmed the grass and pruned the trees in an effort to keep the property in question looking good. Mr. Leslie H. Davis, whose residence and property adjoins the property to the north, said if this property is turned into a mini -park, it would reduce the value of the surrounding property because of the possibility of noise, chaos, and debris that would be present. Mrs. Leslie H. Davis said she felt it was no place to put a park, it was too small, and she wondered who would maintain it and clear up the debris that would be thrown around. She said they would move if a park is put in there. They would be happy to buy the land, she said. Mr. Hoffner said a building could not be put on the lot. The property could only be used as a trail. There being no audience comments against the vacation, the Public Hearing was declared closed by Council President Hill at 7:08 P.M. Councilman Saul asked what the City planned to do with this property? Mr. Stoknes said it might be a hard path with trees next to the property on both sides. He said the City did not have any firm thoughts about it at this time. Councilman Saul asked if the area would be fenced? Mr. Stoknes said he would assume that some fencing would be in order. Councilman Bohrer said in City Council Motion No. 76 -13 relating to the acquisition of surplus properties adjacent to rights -of -way they stated: "It is the policy of the Tukwila City Council that the City acquire all surplus property adjacent to the public rights -of -way as it becomes available and, once acquired, shall remain in the name of the City for future development." Councilman Traynor said he recalled a piece of property the City purchased and then gave back to the property owners after they had received payment for it because it was not being used by the City. He said he thought the City today could use that piece of property adjoining if it had not been turned back. He said that was one reason the policy statement was made. MOVED BY VAN DUSEN, SECONDED BY BOHRER, THAT THE MATTER OF THE VACATION OF A PORTION OF SOUTH 168TH STREET LOCATED EAST OF 53RD AVENUE SOUTH BE ON THE AGENDA OF THE MAY 2, 1977, REGULAR COUNCIL MEETING. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE COMMITTEE OF THE WHOLE MEETING RECESS AND THE COUNCIL GO INTO A SPECIAL MEETING ADJOURNED FROM APRIL 21, 1977. CARRIED. Council President Hill called the Committee of the Whole Meeting back to order with Council Members present as previously listed. Agenda, Committee MOVED BY TRAYNOR, SECONDED BY SAUL, THAT ITEMS 4, 5, 7, and 8 BE of the Whole Meeting ON THE AGENDA OF THE MAY 2, 1977, REGULAR COUNCIL MEETING. Councilman Van Dusen said there appeared to be members of the audience who would like to talk about the new Comprehensive Plan. Councilman Traynor said he would like to see a specific date established to talk about the Comprehensive Plan. Richard Wilson, attorney in the audience, said he would like to hear some discussion on the Compre- hensive Plan. Council President Hill said he would like to sit down and study it out before it is discussed. He said it would be discussed five or six times before it is adopted. It will be discussed section by section. CARRIED. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT ITEMS 3 AND 6 OF THE AGENDA FOR THE.COMMITTEE OF THE WHOLE MEETING BE ON THE AGENDA OF THE MAY 9, 1977, COMMITTEE OF THE WHOLE MEETING. CARRIED. Report by the Mayor Mayor Bauch stated he would be out of town on City business from Tuesday through Sunday. Mayor Bauch stated he was delivered a court decision late in the afternoon of the Todd vs. Davis Appeal. He said the appeal was won by the City Council, the court case was upheld as passed down by the Superior Cout. He said the cost of the Appeal will be recovered from Mr. Todd and Mrs. Kinney.
