SPECIAL MEETING CALL TO ORDER ROLL CALL OF COUNCIL MEMBERS OFFICIALS IN ATTENDANCE Proposed Ordinace adopting a new sub- division code, including provi- sions for short plats, and repeal- ing the present subdivision ordinance M I N U T E S BOHRER, HILL, SAUL, TRAYNOR, VAN DUSEN. Councilman Pesicka arrived at the meeting at 7:25 P.M. /8/ City Hall Council Chambers Mayor Pro Tem Hill called the Special Meeting that was recessed on April 25, 1977 back to order at 7:08 P.M. Steve Hall, Director of Public Works; Fred Satterstrom, Office of Community Development; John McFarland, Administrative Assistant. Charles Baker, audience, said in respect to Section 3.2 (Environmental Considerations), paragraph 2, page 34, that during the public hearing it was brought out that some trees would have to be taken out in order to build. Mayor Pro Tem Hill asked if it was thought that the sentence "Every reasonable effort shall be made to preserve existing trees" was adequate? Councilman Saul said most people who are building have consideration for the trees. Councilman Traynor said he thought not every builder tries to protect the trees. Fred Satterstrom, Office of Community Development, said when the matter was discussed with the Planning Commission they were talking about preserving the 6 inch perimter trees, this paragraph was put in to encourage the retention of trees when they would not have to be removed. MOVED BY BOHRER, SECONDED BY VAN DUSEN, TO AMEND THE ORDINANCE, SECTION 3.3, COMPATIBILITY WITH EXISTING LAND USE AND PLANS, PARAGRAPH 1, PAGE 35, BY REMOVING THE WORD "DEVELOPED." Fred Satterstrom said he did not object to deletion of the word. Councilman Van Dusen expressed the opinion that the deletion of the word made it clearer. Mr. Kirsop, Planning Commission, said the Planning Commission would have no objection to the deletion of the word. *CARRIED. Councilman Bohrer said he would like to refer back to Page 32, Section 2.3.5, Required Improvements, and make a motion. MOVED BY BOHRER, SECONDED BY VAN DUSEN, TO AMEND THE ORDINANCE, SECTION 2.3.5., REQUIRED IMPROVEMENTS, ITEM 2, PAGE 32, BY ADDING "CHAPTER 17.20, 17.24, AND 17.28" IN THE SECOND LINE TO REPLACE "SECTION 3." CARRIED. Section 3.6, Minimum Standards for Residential Subdivision Design, was discussed. Mayor Pro Tem Hill said Steve Hall, Director of Public Works, would like to have an Item (d) added to Paragraph 2, Private Access Roads, page 37. MOVED BY VAN DUSEN, SECONDED BY MRS. PESICKA, TO AMEND THE ORDINANCE, SECTION 3.6, MINIMUM STANDARDS FOR RESIDENTIAL SUBDIVISION DESIGN, PARAGRAPH 2, PRIVATE ACCESS ROADS, PAGE 37, BY ADDING ITEM (d), WHICH WOULD READ, "THE PROPOSED PRIVATE ACCESS ROADS DO NOT SERVE MORE THAN FOUR (4) LOTS NOR ARE MORE THAN TWO HUNDRED (200) FEET IN LENGTH." CARRIED. Steve Hall, Director of Public Works, said he would like to see the last sentence in Section 3.6, Minimum Standards for Residential Subdivision Design, Paragraph 2, Private Access Roads, Page 37, read as follows: "When private access roads are authorized, the easement width shall be a minimum of thirty (30) feet." Mr. Hall explained the need of this width in answer to Councilman Saul's question. Councilman Traynor stated many of the private roads that had been put in the City were not kept up, and it would be practically impossible to get fire or police vehicles down them. As soon as they are put in they expect the City, the County, or someone else to maintain them. MOVED BY VAN DUSEN, SECONDED BY MRS. PESICKA, TO AMEND THE ORDINANCE BY CHANGING LAST SENTENCE OF PARAGRAPH 2, PRIVATE ACCESS ROADS, PAGE 37, TO READ AS FOLLOWS: "WHEN PRIVATE ACCESS ROADS ARE AUTHORIZED, THE EASEMENT WIDTH SHALL BE A MINIMUM OF THIRTY (30) FEET." CARRIED, WITH SAUL VOTING NO. RECESS 8:15 P.M. -8:25 P.M. /g /41 MOVED BY PESICKA, SECONDED BY VAN DUSEN, TO AMEND THE AMENDMENT TO THE ORDINANCE BY CHANGING PARAGRAPH 2, PRIVATE ACCESS ROADS, PAGE 37, TO READ AS FOLLOWS, "WHEN PRIVATE ACCESS ROADS ARE AUTHORIZED, THE EASEMENT WIDTH SHALL BE A MINIMUM OF THIRTY (30) FEET AND SHALL CONFORM TO THE APPLICABLE STANDARDS FOR DESIGN ALIGNMENT SET FORTH IN CHAPTER 17.24.040, PARAGRAPH 2." CARRIED. Steve Hall, Director of Public Works, referred to Item (3), Street Grades, Page 38, and said the 15 percent street grade was not satisfactory. MOVED BY PESICKA, SECONDED BY SAUL, TO AMEND THE ORDINANCE, ITEM (3), STREET GRADES, PAGE 38, TO READ AS FOLLOWS, "STREET GRADES SHALL CONFORM TO DEPARTMENT OF PUBLIC WORKS STANDARDS." CARRIED. MOVED BY MRS. PESICKA, SECONDED BY TRAYNOR, THAT THE SPECIAL MEETING RECESS FOR TEN MINUTES. CARRIED. The Special Meeting was called back to order by Mayor Pro Tem Hill with Council Members present as previously listed. Steve Hall, Director of Public Works, explained the need for the public right -of -way as set forth for the types of streets specified. Discussion continued and Mr. Hall stated the introductory paragraph from Page 37 was needed as the introductory paragraph on Page 42. MOVED BY BOHRER, SECONDED BY MRS. PESICKA, TO AMEND THE ORDINANCE BY USING SECTION 3.6., MINIMUM STANDARDS FOR RESIDENTIAL SUBDIVISION DESIGN, ITEM 3, PUBLIC RIGHTS -OF -WAY, PAGE 37, AS ITEM 1, (a), PUBLIC RIGHTS -OF -WAY, AND ADDING TO THE END OF THE PARAGRAPH AFTER SHORT PLATS "OR BINDING SITE IMPROVEMENT PLANS." CARRIED. MOVED BY VAN DUSEN, SECONDED BY SAUL, TO AMEND THE ORDINANCE, ITEM 1, PUBLIC RIGHTS -OF -WAY, PAGE 42, BY REMOVING "ARTERIAL, 80', AND 60'." CARRIED. Lowell Gordon, audience, said the paragraph on Page 43, Private Access Roads, was very restrictive. Councilman Traynor said private access roads were usually a problem, they are hard to service with fire and police protection, and are usually in a rundown conditions. MOVED BY MRS. PESICKA, SECONDED BY SAUL, TO AMEND THE ORDINANCE, ITEM 4, PRIVATE ACCESS ROADS, PAGE 43, FIRST LINE, BY DELETING THE WORD "MAY" AND INSERTING THE WORD "SHALL." CARRIED, WITH SAUL AND BOHRER VOTING NO. Mr. Lowell Gordon said when the private streets are put in they are approved by the City, the builder or developer puts thought in them as to fire and police service. The private streets receive every bit as much attention as a public street. Councilman Traynor said the City has always had trouble with private roads in one way or another. MOVED BY MRS. PESICKA, SECONDED BY SAUL, TO AMEND THE ORDINANCE, ITEM 4, PRIVATE ACCESS ROADS, PAGE 43, BY ADDING ITEM (d), "DO NOT SERVE AS PRIMARY ACCESS ROADS TO MORE THAN TWO (2) LOTS OR BE MORE THAN 250 FEET IN LENGTH." Fred Satterstrom, Office of Community Development, said that when private access roads go in and buildings are built they do not have to set back and this leads to many problems if the land is subdivided. Mr. Kirsop, Planning Commission, said as far as the Planning Commission is concerned there is a growing trend toward flexibility in zoning. The City of Tukwila does not have unlimited land resources and the land we have has to be used more intensively than in the past. For a massive facility involving heavy trucking you need large streets. *CARRIED, WITH SAUL AND HILL VOTING NO. MOVED BY BOHRER, SECONDED BY SAUL, TO AMEND THE ORDINANCE, ITEM 4, PRIVATE ACCESS ROADS, PAGE 43, BY DELETING THE "SHALL" AND RETURN TO "MAY" AND DELETE THE PROPOSED ITEM (d). CARRIED. ADJOURNMENT 9:55 P.M. MOVED BY BOHRER, SECONDED BY MRS. PESICKA, TO AMEND THE ORDINANCE, ITEM 6, RAILROADS, PAGE 43, BY ADDING TO THE END OF THE FIRST SENTENCE "AND BINDING SITE IMPROVEMENT PLAN." CARRIED. MOVED BY MRS. PESICKA, SECONDED BY VAN DUSEN, TO AMEND THE ORDINANCE, ITEM 4, PRIVATE ACCESS ROADS, PAGE 43, LAST SENTENCE, SO IT READS, "WHEN PRIVATE ACCESS ROADS ARE AUTHORIZED, THERE SHALL BE A MINIMUM EASEMENT WIDTH OF FORTY (40) FEET." CARRIED, WITH TRAYNOR AND HILL VOTING NO. MOVED BY SAUL, SECONDED BY VAN DUSEN, TO AMEND THE ORDINANCE, ITEM 8, LOTS, PARAGRAPH C, THROUGH LOTS, PAGE 44, BY DELETING THIS PARAGRAPH. MOTION FAILED, WITH SAUL AND VAN DUSEN VOTING YES, AND HILL, TRAYNOR, PESICKA, AND BOHRER VOTING NO. Councilman Saul said he would like to go back to Page 37 and make a motion because he felt this posed a hardship on anyone who wanted to develop residential property. MOVED BY SAUL, SECONDED BY MRS. PESICKA, TO AMEND THE ORDINANCE, SECTION 3.6., MINIMUM STANDARDS FOR RESIDENTIAL SUBDIVISION DESIGN, ITEM 2, PRIVATE ACCESS ROADS, LAST SENTENCE, PAGE 37, TO READ "TWENTY (20)" FEET RATHER THAN "THIRTY (30) FEET." MOTION FAILED, FIVE TO ONE, WITH SAUL VOTING YES. MOVED BY VAN DUSEN, SECONDED BY MRS. PESICKA, THAT THE PROPOSED SUBDIVISION CODE ORDINANCE BE ON THE AGENDA FOR THE MAY 2, 1977 REGULAR COUNCIL MEETING. CARRIED. MOVED BY MRS.
