Council President Hill called the Tukwila City Council Committee of the
Whole Meeting to order.
GARDNER, TRAYNOR, HILL, SAUL, MRS. PESICKA, VAN DUSEN, BOHRER.
MOVED BY TRAYNOR, SECONDED BY MRS. PESICKA, THAT THE MINUTES OF THE
COMMITTEE OF THE WHOLE MEETINGS HELD MAY 5, 1977, MAY 9, 1977, AND
MAY 11, 1977 BE APPROVED AS PUBLISHED. CARRIED.
Mr. Joseph O'Zey said the telephone company was doing the trenching this
morning so the problem had been taken care of. Mayor Bauch
said the telephone company obtained an easement and they are bringing
in the telephone lines. The problem has been resolved. Councilman
Pesicka asked about the TV cable and Mr. O'Zey said he presumed it was
being dropped in the trench while it was open. Mayor Bauch said he would
call about it. Mr. O'Zey asked if the telephone company would absorb
the cost. Mayor Bauch said it was his thought with the agreement Mr.
O'Zey would be treated the same way as others and the line would be
brought to his property line without charge to him. When it reaches
his property line, Mr. O'Zey will be billed. Council President Hill
said if Mr. O'Zey is sent a bill for more than his property he should
contact the City. Mr. O'Zey said he would.
Council President Hill declared the Hearing closed.
Councilman Van Dusen said this is the proposed ordinance that the
Police Department brought to the Public Safety and Health Committee and
an informal Public Hearing was held on May 12, 1977. Officer Kilburg
explained at the Public Hearing the need of this ordinance. There was
a representative from the Doubletree Inn, Mr. Merkel from the Southcenter
South Apartments, and a letter from the Canyon Estates at the Public
Hearing. They were all in agreement that there was need for the
ordinance. It will cost the apartment owners some money, but it will not
be easy for unwanted persons to get into apartments and motels in the
City. Councilman Saul said the Police would go to a building when there
is a burglary and then notify the owner when the security devices have
not been installed. There will not be a general check made to inspect
all of the apartments and motels in the City.
Mayor Bauch said he thought the last sentence of Section 1, Paragraph 1,
should make provision for replacement doors.
MOVED BY MRS. PESICKA, SECONDED BY VAN DUSEN, THAT ITEM (1) OF SECTION 1
HAVE A LAST SENTENCE ADDED THAT READS: "ANY DOOR REPLACED IN EXISTING
STRUCTURES MUST COMPLY WITH THIS ORDINANCE." CARRIED.
Mayor Bauch said in Section 4 there was some question about the reference
to jail sentence. He said he contacted the City Attorney and he does not
feel any judge would put anyone in jail for violation of this ordinance.
As far as the fine is concerned, each day that the ordinance is not
complied with would add up on the fine.
MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE LAST SENTENCE IN SECTION 4
HAVE THE FOLLOWING PHRASE DELETED, "OR BY IMPRISONMENT FOR NOT MORE THAN
NINETY DAYS, OR BY BOTH SUCH FINE AND IMPRISONMENT." THE FOLLOWING
STATEMENT BE ADDED AS THE LAST SENTENCE OF SECTION 4: "IT SHALL BE A
SEPARATE OFFENSE FOR EACH AND EVERY DAY OR PORTION THEREOF DURING WHICH
ANY VIOLATION OF ANY SUCH PROVISION IS COMMITTED." CARRIED.

Mayor Bauch said the area concerned is near the San Juan Apartments.
The south side of the street is dedicated. He continued that in an
effort to bring the street up to City standards this negotiation went
on between the Public Works Director and the property owners. He said he
had some reservations in that there appears to be no way to force them
to upgrade the street. Councilman Pesicka asked about undergrounding and
sidewalks. Mayor Bauch said there is nothing to force them to upgrade
the street. He said he would suggest the City ban all building on the
street until it is upgraded or an L.I.D. put in. It could be a safety
hazard. He continued that the first paragraph states the agreement is
only in force if it is zoned as it is and remains so. Mayor Bauch
said the owners have indicated they want to do some building but so
far they have not applied for a building permit. Frank Todd, audience,
said when he left office there was a letter in the files stating that if
the City would zone R -3 they would dedicate. They were never forced to
complete the transaction. Council President Hill said he thought the
City should say they will accept the dedication of the portion of
153rd Street when it is improved to City standards. He said he felt
if the City takes it and gives them six months and then they might sell
the property. Councilman Traynor said he thought the whole street
should be in before the City accepts it. Mayor Bauch said the property
owners came to Staff and said they were ready to enter into an agreement.
Councilman Bohrer said he felt the suggestion of the Mayor's to delete
paragraph 1 of the Property Use and Development Agreement was good.
Council President Hill said since the property has been rezoned he did
not see how we could go back and rezone it to R -1. Councilman Traynor
said he was looking for the motive he could not see any benefit for
the City or for the people either unless they plan to sell the property.
Council President Hill said he agreed, if we are going to accept the
street let them build it up to standard before it is accepted.
MOVED BY TRAYNOR, SECONDED BY MRS. PESICKA, THAT THE RESOLUTION AUTHOR-
IZING THE MAYOR TO ENTER INTO A PROPERTY USE AND DEVELOPERS AGREEMENT
WITH WILLIAM P. KETCHAM AND HENRY H. KETCHAM, JR., TO PROVIDE FOR THE
IMPROVEMENT AND DEDICATION OF A PORTION OF SOUTH 153RD STREET BE
TABLED UNTIL STAFF COMES BACK AND GIVES FURTHER DIRECTION AS TO
MOTIVE AND ADVANTAGE. CARRIED.

He said he thought there would be an enforcement problem. His suggestion
was to put it back on the agenda for reconsideration.

PROPOSED ORDINANCE AS IT STANDS ON JUNE 6, 1977 AT THE REGULAR COUNCIL
MEETING.
Mayor Bauch said he did not think the City, at this stage of the game,
could compare an ordinance from the City of Seattle regarding drinking
in the parks. He said he did not accept that Fort Dent is a Tukwila
park. The Tukwila parks are neighborhood parks. The problems that would
come up would be different than those that come up in the large Seattle
parks. There is no evidence that we have a problem with people
going down to the Tukwila parks and bringing their beer out. The police
guild uses the park for their annual picnic and they take their beer
along. He said he did not categorize that as causing trouble. He said
we cannot penalize our residents of the drinking of beer because the
County chose to build a park within our area. He said if we had a
problem he would be the first to ask for it. Our people will be forced
to go out to a County park so they can drink their beer. He continued
that he thought the present ordinance can be amended to specifically call
out Fort Dent where alcoholic beverages would be prohibited. It is,-"

City Parks." Mayor Bauch said that is correct, the reference to school
grounds could be left in.

Mayor Bauch said he would like to withdraw this ordinance as it is
presently written. He said in two weeks he would present a different
ordinance to consider, he would like to include U.S.T.M.E. and transfer
money from Valley -Comm into the Police Department. He said we also have
a problem with the increased rates with Group Health that are not shown.
He said under 0.M.C. the budget can be amended by resolution or ordinance
and by resolution the publishing cost would be saved.

RETURNED TO ADMINISTRATION AND RETURNED FOR THE JUNE 6, 1977 AGENDA OF
THE REGULAR COUNCIL MEETING. CARRIED.
Mayor Bauch said there is a Senior Citizen Program to provide meals for
those unable to prepare their own meals or are homebound. This program
is operated by the County but it takes a local representative to
administer the program. They are balanced TV meals. The person who
participates must have a refrigerator with a freezer part and an oven
that bakes. The program provides through federal funding. Mileage is
paid for the volunteer who delivers the meals. There would be no cost
to the City except possibly to do some advertising and let the people
know about it and furnish electricity for the freezer maintained by the
volunteer. The City has to collect the money and return it back to
the County on a two week basis. It is a case of money in and money out.
He said he would have to have money in the budget to pay the bills to
match the money that is coming in. It would be between $2,000 and
$5,000 for the number of meals for the people who would participate.
We have to have at least 20 meals a week or we cannot be in the program.
They would like a single person to take at least seven meals. The
meals are high protein and have rice or potatoes and are balanced meals.
He said he would like to include $3,000 in and out item in the budget.
A survey would have to be made as to those who would like to participate.
The meals are 85 cents each. It could be included in the ordinance
for the transfer of funds. Councilman Bohrer said the citizens who
receive the meals pay for them? Mayor Bauch said that is correct.
MOVED BY SAUL, SECONDED BY MRS. PESICKA, THAT THE ORDINANCE BE AMENDED
TO ADD THE MEALS ON WHEELS PORTION IN THE AMOUNT OF $3,000. CARRIED.
Mayor Bauch said the City employees have had identification cards in the
past. They have borrowed cameras and borrowed lamination material. The
various departments feel they need to continue the identification cards
and reissue them from time to time and as new employees come in. The
Fire Department feels that some people would not want them coming in
to make fire inspection unless they have identification cards. Some
employees use them for official identification. Mayor Bauch said they
had investigated going out for contract to see what the cost would be.
They have contacted the City of Renton and Kent who have their own
equipment. Neither are willing to come in and do this for the City. We
would have to send employees there and it would offset any savings in
time lost off work. We went out and looked at identification equipment
to do the job in- house. The lowest price quoted was out of line. We
have been informed that a local person has a unit, they are going out
of business and will sell equipment at half price which would be
$750. Councilman Pesicka asked how long it would take to pay for itself.

Identification Mayor Bauch said it would never pay for itself. He added the part time

takes four different pictures. It is something the City needs. We have
100 employees and they should be reissued every two years. Councilman
Traynor said he did not know why it was necessary to have identification
cards. Councilman Pesicka said she could see where the firemen or
recreation people would use them. Councilman Traynor said if firemen
are driving a fire truck people would know they are from the Fire
Department. Councilman Saul said he could see where there would be a
reluctance on the part of people to let someone into their home without
an identification. Carla Elfstrom, audience, said the City employees
use the identification card when they make or pick up purchases for
the City. Councilman Bohrer said he thought there are employees who
would use them.

BE PURCHASED FOR IDENTIFICATION CARDS.
Councilman Traynor said he felt the number of people who are going to
the stores to make purchases should be limited and he thought it would
be cheaper to send employees who needed identification out to have
their pictures taken. Frank Todd, audience, said the Police and Fire
Department employees are identified by their badges. It seems an
expensive way to identify the rest of the employees.

PUBLIC WORKS COMMITTEE. CARRIED.
Councilman Saul said they had all received a letter from Kejll Stoknes,
OCD Director, stating plan of action after the Comprehensive Plan has
been adopted. He said there will be an ordinance ready for the next
Council meeting setting forth the plan. That is so once the Comprehensive
Plan is adopted there won't be chaos all of a sudden.
Sidewalks Councilman Saul said he noted they are not putting in sidewalks in front
of the new furniture stores at Parkway Plaza. Council President Hill
asked if we have a sidewalk ordinance. Al Pieper, Building Official,
said there were no sidewalks down there. Councilman Traynor said the
Council should ask Staff why sidewalks get in someplaces and not in others
Christensen Rd. Mayor Bauch said two quotes had been received. They came in over the
$5,000 which was the limit. They were about $2,000 over. We are going
to go out and accept the quote on the security part of the bid. Mayor
Bauch said we will go back for bids.
Smoke Detectors Councilman Saul said as far as he could tell there has not been any
action on the smoke detectors. He said the money has been there since
January. Mayor Bauch said they have bought things for it and he did not
know what was causing the delay. Councilman Van Dusen said Jim Hoel,
Fire Marshal, has said there was not a lot of response, but they are
going going to install them.
Girls' Slow Pitch Councilman Traynor announced the name of the Girls' Slow Pitch Team
Team would be the Classics. He said they would be playing soon and he
would distribute the schedule.
Landscaping for Mayor Bauch said Tom Emrich, Mithun and Associates, has called regarding
City Hall the landscaping for the proposed City Hall. He said the matter had
been discussed and it is his recommendation that the landscaping be
done in- house. Mr. Carl Stixrood, OCD, has been recommended. He has had
experience and training in this line.
Comprehensive Plan Mr. Robison, audience, said it was his suggestion to hold the June 1
Land Use Meeting Committee of the Whole Meeting in a larger building in order to accommo-

Comprehensive Plan concerning McMicken Heights will be discussed and
there is evidence of a large crowd. Mayor Bauch said the Tukwila
Elementary School has been obtained for this meeting.
