Mayor Bauch introduced Patrick J. Lowery, the new Crime Prevention Officer hired under a Law Enforcement Administration Assistance Grant. Mr. Lowery commented that under the Crime Prevention Program, the Department will assist on Community Awareness Programs, security training courses, security surveys, and property marking programs. John Sheets, Police Chief, invited Council to stop in and meet Mr. Lowery and discuss the programs with him. Letter from Mayor Bauch to Council was read appointing Mr. Richard A. Goe, 5112 South 163rd Place, to fill the vacancy on the Board of Adjustment. This is Position No. 5 and expires December 31, 1977. He urged Council to give prompt attention to this matter. PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS 2699 2812 72,867.46 2813 2831 4,315.25 2832 2841 11,501.62 2842 7,803.50 2843 2857 7,159.47 2858 2873 10,107.09 Kjell Stoknes, OCD Director, explained the waiver request is to grade and fill a 55 acre tract of land east of the Burlington Northern lead tracks. This site is only a small portion within Tukwila boundaries of a much larger tract lying within the Renton City Limits. The plans are to fill the entire area but leave in reserve a border strip for the proposed P -1 Drainage Channel. The site will be filled to elevations ranging from 16 feet on the east and west to a high of 19 feet. Councilman Bohrer asked about the level of the land at this time and was told it ranges from a low of 12 feet in the northeastern corner to a high of 20 feet. Discussion ensued on the designated wetland area and the drainage channel. TUKWILA CITY COUNCIL REGULAR MEETING June 20, 1977 Page 2 PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS Cont. Request for Waiver from Resolution #489, Burlington Northern-Cont. Amended, 7/5/77 *Mr. Gordon, refer- ring to the whole area under develop- ment, stated that /g 77 Kjell Stoknes explained that Soil Conservation Service has a require- ment now that local cities have to buy a certain percentage of wetlands or open space before projects can begin and if it is not done by a certain date, the project will be cancelled. It is difficult for cities to come up with this money because of the budgeting process. Mr. James Gordon, Burlington Northern, explained that the wetlands and the drainage ditch are being treated independently. There is a petition being circulated concerning the drainage ditch to get it constructed through Renton and into Kent. The entire ditch is set aside for this purpose. There is no permit to fill the so- called wetland area. It has been suggested that this area can be used as a holding basin until the ditch is constructed. Mr. Stoknes explained that the P -1 Channel is not a wetland; the wetland designated by S.C.S. is the area to the north along with a small triangle on the northeast corner of the site in Tukwila, approximately two acres in size. Councilman Traynor stated that he has always supported Resolution #489, and he still does but feels that this is one case where the waiver should be granted. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE WAIVER BE GRANTED TO RESOLUTION NO. 489 ON THIS REQUEST. Mr. Gordon explained that they applied to Tukwila for a grading and fill permit on April 26, 1977. He stated that on June 13 at the Committee of the Whole Meeting he felt they demonstrated that the property is compatible to the surrounding zoning and that there is a hardship to be experienced if the permit is withheld. The permit has been approved by both King County Hydraulics and the Department of Ecology. There is a deadline on the King County Special Use Permit of October 1 for the use of the gravel pit and they are attempting to complete the fill by that date causing the urgency in the permit from Tukwila. A requirement of the County approval is the reserving of the area for the P -1 Channel; along with this they will also be assessed per acre for construction of the ditch. Councilman Van Dusen asked if the 20 acre wetland in Renton has been dedicated to the City: Mr. Gordon explained that it was donated to Renton. There is an additional 39 acres that they also want set aside. Councilman Van Dusen asked if Burlington Northern would be willing to dedicate the northeast corner of the Tukwila site for wetlands? Mr. Gordon explained that this would be a handicap in platting the lots and suggested there might be an alternate solution. Councilman Van Dusen also asked if the P -1 Channel is not constructed,would Burlington Northern be willing to dedicate it for open space? Mr. Gordon stated he thought it a realistic assumption. Mr. Stoknes stated that his real concern on this project is the City's liability from damage from storm waters. As the area is filled, the storm water level will get higher and higher in the surrounding areas. He suggested requiring a liability disclaimer with the fill permit. He discussed some kind of excavated area for a storage pond somewhere. Mr. Len Clark, Stevens, Thompson Runyan, discussed in detail the drainage problems and the possible solutions that have been discussed with Renton, Department of Ecology, and King County Hydraulics. The County, as it stands right now, requiring that any structures built must be at an elevation of 21.8 feet. When the Channel is completed, the elevation required will be 15 feet. Councilman Bohrer asked about the type and timing of development and was told that larger lots are proposed for the Tukwila area. *They have several prospects and are ready to move as soon as the permits are approved. They hope that all development will be rail oriented. There are still many plans to be completed. Termination of Employment, Steven M. Hall, Public Works Director OLD BUSINESS Comprehensive Land Use Policy Plan, Maps and Policies ROLL CALL VOTE: 4 YES PESICKA, SAUL, TRAYNOR, VAN DUSEN: 3 NO BOHRER, GARDNER, HILL. AMENDMENT TO THE MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY SAUL, TO AMEND THE MOTION TO INCLUDE: 1. IN THE NORTHEAST CORNER, EVERYTHING NORTH OF THE 15 -FOOT CONTOUR LINE BE DEDICATED TO WETLANDS. 2. IF P -1 CHANNEL IS NOT CONSTRUCTED, THE AREA BE DEDICATED TO THE CITY FOR OPEN SPACE. Mayor Bauch stated that Item 1 should be made a limitation of the fill permit and that Item 2 would be a condition of the plat. Councilman Bohrer sited a policy in the emerging Comprehensive Plan that says the City should discourage filling when not in conjunction with actual development. He stated that it appears that this particular piece of land is not faced with eminent development. Councilman Traynor asked where the water will drain until completion of the P -1 Channel. Mr. Clark stated that it flows into the Spring brook Channel and eventually on to the pump station. MOTION CARRIED AS AMENDED WITH HILL AND BOHRER VOTING NO. Councilman Traynor stated that he would like to see Mr. Stoknes pursue the water storage problem. MOVED BY TRAYNOR, SECONDED BY MRS. PESICKA, THAT STEVE HALL'S LETTER OF TERMINATION BE READ FOR THE RECORD. MOTION CARRIED. The letter states that Steve Hall is terminating his employment as Public Works Director with the City on July 15, 1977. He will be taking the position of Public Works Director with the City of Milwaukie, Oregon. He stated that he enjoyed working for former Mayor Frank Todd and has the same feelings for the current Mayor Ed Bauch. He concludes: "I wish to thank everyone with the City for their patience and under- standing during my time of employment and for the deep friendships and loyalties which have been fostered over the past five years." Kjell Stoknes displayed the revised Comprehensive Land Use Plan Map. Mayor Bauch explained that it was for Council review and approval for publication prior to the Public Hearings. MOVED BY SAUL, SECONDED BY MRS. PESICKA, THAT THE AREA SOUTH OF SOUTH 192ND AND FRONTING 33 AVENUE SOUTH FOR A DEPTH OF 150 FEET BE CHANGED TO SINGLE FAMILY RESIDENTIAL. MOTION CARRIED. MOVED BY TRAYNOR, SECONDED BY MRS. PESICKA, THAT ALL THE MEDIUM DENSITY RESIDENTIAL FROM THE ELEMENTARY SCHOOL BOUNDARY SOUTH TO THE HIGH DENSITY RESIDENTIAL BE CHANGED TO SINGLE FAMILY. Councilman Hill asked how this would affect the apartments already built in the area. It was explained that if a building is at least 3/4 destroyed by fire, it cannot be rebuilt, and if the area is rezoned back to R -1, they become non conforming. Councilman Bohrer stated that in considering the rest of the Tukwila hill, the prime consideration has been that apartment buildings should not intrude beyond the crest of the hill. Mr. Rub Salant, audience, asked if any of the residents in the area had been contracted and informed that Council was contemplating changing their property? Councilman Traynor reminded Council that this is not changing the zoning. TUKWILA CITY COUNCIL REGULAR MEETING June 20, 1977 Page 4 OLD BUSINESS Cont. Comprehensive Land Use Policy Plan, Maps and Policies Cont. /e77 Fred Satterstrom, Planning Associate, noted that if you remove all of the medium density in that area, it creates a situation similar to the existing Comprehensive Plan where the high density is abutting single family residential. The medium density classification was proposed to form a transition between the high density and the single family residential. In this area thereis no topographic separation, hence the medium density was providea. He urged Council to at least retain a conceptual strip of medium density along the high density residential. Mr. Robert W. Thorpe, R. W. Thorpe and Associates, 1815 Seattle Tower, reminded Council that they have requested a waiver on the 15 acres adjoining the school property. Their property represents about 60 percent of the area in Councilman Traynor's motion. He discussed their proposed Planned Unit Development and urged Council to stop and consider what is already developed in this area before changing the map back to single family. He stated that they are willing to work with the City on their Planned Unit Development and asked Council to deny the motion. Bud Habler, property owner in the area, stated that on either side of the property being discussed there are apartments and it does seem like denying reality to color it yellow. Councilman Traynor stated that he is representing a portion of the citizens, and they do not want any more apartments. MOTION CARRIED WITH HILL AND VAN DUSEN VOTING NO. Frank Todd, audience, addressed the property between the Village Green Apartments and Interurban and the property immediately south of it. Due to the fact that this land is long and narrow, if left, the apartment designation would make it unusable. He requestd that the area be designated for restaurant or office use. MOVED BY TRAYNOR, SECONDED BY MRS. PESICKA, THAT THE PROPERTY SOUTH OF THE VILLAGE GREEN BETWEEN THE RIVER AND THE INTERURBAN RIGHT -OF -WAY BE DESIGNATED RED (COMMERCIAL). MOTION CARRIED. Councilman Bohrer asked Council to consider the area north of South 178th Street and west of Southcenter Parkway above Levitz. He stated that an office designation had been discussed but at the time of review of this area there was no such thing, now there is. MOVED BY BOHRER, SECONDED BY SAUL, THAT THE AREA ON THE BENCH NORTHWEST OF THE INTERSECTION OF SOUTH 180TH AND SOUTHCENTER PARKWAY ABOVE LEVITZ BE DESIGNATED AS OFFICE CLASSIFICATION. MOTION CARRIED. Frank Todd, audience, stated that the position of the Council seems to be to create jobs but not to provide housing for the people working in Tukwila. Council has just changed the area north of South 178th to an office zone across from the single family residential without a buffer. He stated that they have been before Council with a proposed Planned Unit Development on the property south of South 178th, east of the freeway and adjacent to it. He requested Council to consider a designation of Planned Unit Development for this area which consists of 24 acres. Councilman Van Dusen asked if we had a Planned Unit Development designation? Fred Satterstrom explained Tukwila Municipal Code 18.48, Community Unit Projects. He stated that staff had considered the Planned Unit Development as a use for gradual transition from high density residential to single family residential. Usually density bonuses are given in a Planned Unit Development, but there are no provisions for this in Community Unit Projects. Council President Hill said he was wondering how that would affect the two developments that are already built in that area. Maybe Mr. Stoknes can answer that. The zoning is there but a lot of it is built. As I recall, Kjell, you were saying you could repair the buildings, you could maintain them, but if one of them burned down you could not re- build them. Kjell Stoknes, OCD Director, asked if he could refer that question to Fred Satterstrom, a member of his Staff. Fred Satterstrom said he believed he had been at the meeting answering questions about non conforming uses that evening and the code reads something to the effect that if three fourths of the building were burned or destroyed it may not be rebuilt. Basically, the answer to your first question is that you would change that to single family then and follow it up later on by rezoning if it became at that time non conforming. Councilman Traynor said he still did not know whether the apartments are there or not and maybe this is not the way he thought the hill should look. Is this a plan to show us how the residents of this City want the City to Look and as a resident is that how I like the City to look? Councilman Bohrer said with respect to the Tukwila hill much of the prime consideration has been that the apartment buildings should not intrude beyond the crest of the hill and as that area is presently drawn much of it would violate that rule which has been main- tained throughout much of the rest of the sessions of the Tukwila City Council. Rub Salant, audience, said he was wondering if it is residents Mr. Traynor referred to, whether these residents have been told what you were contemplating about changing their particular piece of property from whatever it is to whatever you desire it to be. You talk about the residents these are the people who own the land, are they not? Councilman Traynor said he thought he had been misunderstood he was not changing the 1 zoning, he was changing the map. Rub Salant, audience, said isn't that the same think as changing the zoning? If you recommend that the comprehensive plan be changed to a certain way that is the way the zoning will follow. Fred Satterstrom, Planning Associate, said he would like to say one thing about wiping out the entire medium desnity in that area. What it does is brings us back to a similar situation we have with the existing comprehensive plan and that is where we have multiple family which is interpreted in today's comprehensive plan to mean high density abutting up against single family residential. If medium density classification as originally proposed is to form a transition between the high density residential area and the single family residential areas where there was not a topographic separation between the two uses. In this area that topographic difference between the two uses does not exist in all places along the medium density strip and the medium density transition classification was proposed. I would urge the Council to consider at least if the desire is to move the medium density classification out completely to at least retain a certain conceptual strip of medium density along the high density residential classification as shown on that map to at least connote a transition between the bulk of residential development, as was the intention of medium density designation. Mr. Robert Thorpe, R. W. Thorpe and Associates, 1815 SeattleTower, Seattle said he had spoken before this group on a number of occasions and a couple of people were were sometimes when he was not. He said they had asked for a waiver on the 15 acres adjacent to the school property and it represents about 60 per cent of what Mr. Traynor is talking about. On a number of occasions we have shown you plans of what we think we -would like to see happen in this area. In fact we have discussed leaving the back third of it which is a steep open space and have even discussed with Staff the possibility of covenanting it to that effect and paying development rights. So in essence what Mr. Traynor is saying by doing it single family would preclude that because what we were anticipating in putting densities on the lower reaches, leaving this open, with VERBATIM TRANSCRIPT FROM TAPE OF TUKWILA CITY COUNCIL REGULAR MEETING HELD JUNE 20, 1977. PAGE 2 density transfer on the property development and leave this open. If it was all single family you would prempt that and have four or five units per acre. I think you are aware of how many trees and that kind of thing the single family has to it. Basically we presented a plan to you that is fairly consistent with keeping the density low up here about 8 units per acre overall. A couple of other points, I think the Staff has a very good point about the fact that you have R -4 zoning on the 5 acres down in this area right here which is Mr. Black's property, this property up in here is already developed, to high density classification up to this point here, so this is already developed. This is already developed. You have a proposal right now for a four story apartment building on this property right here this portion here should be R -4 so this and this and this are already being presently developed at R -4. So that leaves basically our property. So what you are talking about is the Tukwila citizen's property. As a practical matter this part is already developed and this is developed, and there is a proposal now for this piece of property. I think you should save this piece of property and say you are talking about Tukwila Citizen's Property. You have existing zoning here and here and here. I think the comprehensive plan should take into account if you are going to have this thing stand up over a long period of time, not have a great deal of hassle with property owners and a great deal of misunderstanding, and if it is going to stand up in the courts you are going to need to recognize what is there. I feel very stronly about that point. I think that the basis of what you are trying to do you have an existing facility here and by providing extensive open space in this area you have a great deal of potential for the City. We want to work with you and with the Staff. I am a little bothered by one thing, as another planner, here you have a lot of work that you have put in this is one of the better documents that I have as a planner seen. Staff has done an awfully good job. Then you will appoint a citizen's committee. I (TO SIDE 3 OF TAPE) recognize the existing comprehensive plan and the existing zoning were done by professionals. You have a committee who supposedly is looking at the problem very cloasely. They have both given you a recommendation and now in a somewhat arbitrary manner there is a motion to call this whole thing back. I have been to a number of meetings. I know the Councilmen are getting some input from the neighborhood. I just ask that you consider that here are 17 or 18 property owners who have owned this property for a number of years, they have tried to show you in good faith that they want to do soils reports, and all, and I know you have seen a lot of bull on some of these other apartments and I know that these other apartments on the hillside, the way they are landscaped are not testament to what we are trying to do. But that is a beautiful piece of property left in Tukwila and what is done there will really make a lot of difference in what this place looks like. This is Mr. Black's property. All that I am asking for is the opportunity to work with you, if you open this as just a single family use I think you have precluded something. The STaff is right, you are not going to have a transitional strip, and you will be back where you were. All I can say is that the property owners will not want to leave a legacy to something that is going to disappear it is most beautiful piece of property. I would ask that you deny this whole thing because it 95 per cent affects us and we would work with you to do what you think is consistent and we will leave a major open space area. We will have to get approval for zoning, it is still zoned single family, we still have to get approval of all permit processes through the Planning Commission, so I think you have a lot of guarantees. It does seem to be like denying reality to color that in --yellow. r Councilman Traynor said the high density shown on the map was done by a citizen committee many years ago. Because of the Council's lack of backbone, and I am not saying whether or not the citizen's group was right or wrong in doing that, but I know that one seventh of the citizens of this City do not want any more apartments. Mr. Robert Thorpe, audience, said as he understood it the Council has before it an ordinance that is essentially a continuation of the 489 waiver, and if in fact that ordinance is passed, as I understand it, what you will do is take this comprehensive plan and not allow any zoning changes unless they are compatible with the comprehensive plan. Now, to me, I think this is a little bit of a misunderstanding because the community is being told this is a guideline, the zoning code is a blue print, but if you in fact color this in yellow then there is no way a zoning change can occur if 489 as you are proposing it, passes. This is what we are concerned about. We work with banks a great deal and I think you are going to create a cloud of uncertainty that may make any kind of a development very difficult, unless it is well spelled out. I am asking you to take a look at all of those perameters, and if you think you are moving on that ordinance that says that any development has to be compatible with this and you do pass this subsequent to that then you are walking into some kind of a situation, with this ordinance. *MOTION CARRIED, WITH HILL AND VAN DUSEN VOTING NO. RECESS 9:15 P.M. 9:25 P.M. agO Frank Todd stated that they are not asking for density bonuses but are asking for larger apartments along the freeway to buffer the noise from smaller units. They are proposing large areas of open space. He stated, what they are asking is, does the City of Tukwila want housing or do they go elsewhere? They would like to annex to Tukwila and develop their property. Kjell Stoknes stated that under the present Ordinance, there are no provisions for density incentive; however, the Planning Commission, when reviewing a rezone request, will discuss density incentive that will increase the density in each of the residential categories. Criteria will be developed when a Planned Unit Development is applied for. Mr. Todd's property is not excluded from a potential Planned Unit Development. Frank Todd requested that Council designate the area under discussion as medium density. MOVED BY HILL, SECONDED BY VAN DUSEN, THAT THE AREA NORTH OF THE CANYON TO SOUTH 178TH BE DESIGNATED AS MEDIUM DENSITY. Dennis Robertson, 16038 48th Ave. South, stated that the petition Council received signed by the surrounding property owners represent eight families. The petition was worded "our land" indicating that the surrounding property owners agree,and they will eventually want multiple zoning also. The access South 178th Street which is a very bad hill. Most of the traffic will leave the area through the single family residence rather than go downhill into the industrial area. The people want to see this area stay single family. Dick Goe, 5112 South 163rd Place, discussed the potential traffic factors that will develop on South 178th if this area goes multiple. ROLL CALL VOTE: 5 NO BOHRER, GARDNER, MRS. PESICKA, SAUL, TRAYNOR. 2 YES HILL, VAN DUSEN. MOTION FAILED. Frank Todd again commented that Council wants jobs in the City and more arE developing every day, but Council does not want to allow housing to be built to provide competition in the rental market. MOVED BY HILL, SECONDED BY SAUL, THAT THE MAP BE PREPARED FOR PUBLICATION FOR THE PUBLIC HEARINGS. Mr. J. L. Barnes requested that the petition signed by the owners of the area at 51st Avenue South and South 158th Street and presented to the Council at the June 1 Committee of the Whole Meeting be made a matter of official record. MOTION CARRIED WITH VAN DUSEN VOTING NO. Councilman Gardner stated that he did not vote as he has property involved. MOVED BY TRAYNOR, SECONDED BY MRS. Ad Hoc Committee The report of the Ad Hoc Committee on Fire Zones submitted by Al Pieper, Report on Fire Chairman, was read for the record. Interest income for the month of May was $10,313.98. Investments sold were $2,075,000 Purchased $2,500,000. Steve Hall reported that the Preconstruction Conference on the 1977 Stred Project will be held tomorrow, June 21. Hopefully, the construction will be under way in about ten days. Mayor Bauch stated he hiked the Christianson Trail and noted that the signs are up announcing that the road will close on July 24. Kjell Stoknes reported that the Recreation Department checked the areas interested in basketball hoops. The three areas selected are Hampton Heights, the Canyon Estates, and 59th Place South. Steve Hall reported that the only way to resolve disputes over surveys are by mutual consent of the property owners or by the court system. Attorney Retainer Frank W. Zepp Bridge EXECUTIVE SESSION 153 Councilman Bohrer stated that the City Attorney volunteered a report on what is properly included in their retainer and requested that this be on the agenda for July 11. Steve Hall suggested that Council pass a Resolution directing that the handrails on the Frank W. Zepp Bridge remain "International Orange." This was the color picked by Frank Zepp in 1970 for the color of the bridge. MOVED BY HILL, SECONDED BY SAUL, THAT THE CITY ATTORNEY DRAW A RESOLUTION THAT THE COLOR OF THE FRANK W.
