Mayor Bauch called on Allan Milligan, Utility Accountant for the City,
to lead the Pledge of Allegiance. Mr. Milligan has just recently
received his citizenship papers.
Mayor Bauch, presiding, called the Regular Meeting of the Tukwila City
Council to order.

Mr. Elray Simon, 4625 South 134th Street, commented on the business
located on the property north of his residence. The business is in
violation of several requirements of Ordinance No. 743. He stated
that he had contacted the City and someone investigated the problems
but since that time nothing has been done.
Mayor Bauch stated that he was aware of the problem but was unaware
that there had been no action. He further stated that he would follow
through on this.
PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS
Mayor Bauch read a Proclamation declaring the week beginning July 24,
1977, as HIRE A DISABLED VETERAN WEEK in Tukwila and urged all employers
to join in this admirable effort.
John McFarland, Administrative Assistant, reviewed the claim for damage
involving a Tukwila Police Vehicle and stated that the report clearly
indicates liability on the part of the City. He recommended the claim
be awarded in full in the amount of $158.04.
MOVED BY VAN DUSEN, SECONDED BY BOHRER, THAT THE CLAIM FOR DAMAGES
BE PAID. MOTION CARRIED.
Claim for Damages: John McFarland reviewed the claim for damages involving a Tukwila
James M. Smith, Jr. Police Vehicle and recommended that the claim be paid in full in the
amount of $169.96. The report clearly indicates liability on the part
of the City.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE CLAIM FOR DAMAGES BE PAID.
It was explained that the City's insurance has a $250.00 deductable
clause.

Melvin E. Dickey requested a waiver from Resolution #489 to allow a
rezone from unclassified to M -1 on property located at 4621 South
134th Street.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT THE WAIVER BE GRANTED.
Mr. Elray Simon, 4625 South 134th Street, asked about Resolution No. 489
and stated that he is against the rezone. He had heard that the
developer hopes to put an impound lot on the property and he is opposed
to it as the site is approximately 40 feet from his back door.
Impound lots cause undue noise and commotion, and he felt it would be
detrimental to the value of his property.
Mayor Bauch explained that the Resolution requires a waiver from the
Council to allow the applicant to apply to the Planning Commission for
a rezone. At this time, Council is not hearing the merits of the case.
He recommended Mr. Elray present his objections to the Planning
Commission.
Councilman Bohrer asked if the motion included accepting the staff
recommendation? He was told that it did not.
MOVED BY BOHRER, SECONDED BY SAUL, THAT THE MOTION BE AMENDED TO
INCLUDE THE STAFF RECOMMENDATION THAT THEY BE DIRECTED TO ANALYZE
THE REZONE APPLICATION WITH PARTICULAR RESPECT TO TUKWILA ORDINANCE
NO. 743 AND THE NEIGHBORING RESIDENTIAL PROPERTIES. MOTION CARRIED.
MOTION CARRIED AS AMENDED.
Gerald E. Schneider requested a waiver from Resolution No. 489 to allow
a rezone from R -4 to C -1 on property located at Southcenter Boulevard
and 65th Avenue South.
MOVED BY HILL, SECONDED BY SAUL, THAT THE WAIVER BE GRANTED.
Councilman Bohrer recommended including the staff recommendation.
It is staff's recommendation that the City Council approve the waiver
request with the condition that the applicant may file a rezone
application to C -1 only if he proposes to construct an office use on the
property.
Kjell Stoknes, OCD Director, explained that at present there is no
office zoning category and C -1 is more proper than RMH.
MOVED BY BOHRER, SECONDED BY VAN DUSEN, THAT THE MOTION BE AMENDED TO
INCLUDE THE STAFF RECOMMENDATION PER THEIR REPORT DATED JULY 11, 1977.
MOTION CARRIED.
MOTION CARRIED AS AMENDED.
Henry H. Ketcham, Jr., and William P. Ketcham requested a waiver to
Resolution No. 489 to allow the grading and fill of property located
at 62nd Avenue South and South 153rd Street for a 30 -unit apartment
complex.
Councilman Hill suggested the waiver be granted with the stipulation
that they satisfy the Fire Department that they can get fire protection
to the 30 units.
Mayor Bauch noted that this action on granting the waiver is final action
and you cannot put a stipulation on this unless it is associated to the
fill.
Deputy City Attorney Hard agreed.
Chief Crawley, Fire Chief, stated that they have met with the developer,
explained their requirements to him, and he agreed to the terms.

regarding merger
of King County and
the Municipality
of Metropolitan

Councilman Hill stated that the property is already zoned, and they will
be building within the Codes.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT THE WAIVER BE GRANTED.
Councilman Gardner noted that they will be filling a swamp and
controlling the drainage which should improve the area.
Councilman Bohrer asked if a plan had been submitted showing the nature
of the pond that will be left on the site.
Mr. F. E. Hammons, developer for the Ketcham Brothers, explained that
the pond is approximately 3,600 square feet and there are 52,000 square
feet in the total property. The pond is approximately 18 inches at the
deepest part but dries up during the summer. They want to clear the
area and make an attractive pond with landscaping around it.
Councilman Bohrer expressed concern that Council, in working on the
Comprehensive Plan, has designated the area north of this as a single
family residential area. He stated that policies in the proposed
comprehensive plan indicate there should be a buffer between a three
story apartment and the single family residence.
Councilman Hill asked if there is a steep rise behind this site? Kjell
Stoknes stated that there is a steep rise to the west but to the north
it is fairly level with a localized ridge line, but it is not severe.
Mr. Hammons discussed the hill to the west and the ridge on the north
and explained the elevation of the proposed buildings compared to those
existing.
Councilman Bohrer stated that the ridge to the north is approximately
100 yards to the north of the site and the ground is a gentle slope
to that point. This is the area that will be the residential area
adjacent to a three -story apartment complex.
Mr. Hammons stated there is a 25 foot set -back in this area and the
building sites will be graded to a lower elevation.
Kjell Stoknes stated that the proposed grading plans are consistent
with Resolution No. 489. He again raised the question of an
apartment in the area where Council has said they want to see single
families. This could discourage the building of single family
homes to the north.
Councilman Hill stated that this is a real problem created by the
rezone granted by a past Council; now, how can you deny them their
rights after the zoning has been granted.

MOVED BY HILL, SECONDED BY VAN DUSEN, THAT CHIEF CRAWLEY BE ALLOWED
TO ADVERTISE THE 1951 CITY SERVICE TRUCK FOR SALE, WITHOUT LADDERS.
MOTION CARRIED.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT COUNCIL COMPLY WITH THE
REQUEST OF CHIEF CRAWLEY AND ALLOW HIM TO HAVE THE 1970 PLYMOUTH
STATION WAGON AUCTIONED OFF. MOTION CARRIED.
MOVED BY HILL, SECONDED BY SAUL, THAT COUNCIL ADOPT THE JOINT STATEMENT
OF PRINCIPLES AND FORWARD TO KING COUNTY.
Councilman Bohrer asked if this statement of principles binds the
City to accept the merger proposal when it is developed? Mayor Bauch
stated that it does not bind the City; it will be decided at the
voting poles.

BY TITLE ONLY. MOTION CARRIED.
Deputy City Attorney Hard read a Resolution of the City of Tukwila,
Washington, authorizing the Mayor to execute an interlocal agreement
with the City of Renton to apply for a grant to cover preliminary
engineering for Grady Way Bridge.
MOVED BY HILL, SECONDED BY BOHRER, THAT RESOLUTION NO. 596 BE ADOPTED
AS READ. MOTION CARRIED.
Attorney Hard requested Council consideration of a proposed resolution
on the purchase of park property. The property referred to is the
site known as the CHG property. He explained that the sellers of the
property wish to have a decision on this as soon as possible. There
is a court hearing set for August 5 relating to this.
Councilman Saul asked if there was anything particular in the agreement
Council should know about. Attorney Hard stated that the City agrees
to pay the purchase price ($265,000.00) plus closing costs.
Councilman Van Dusen questioned the wording of the Resolution. It
sounds like we are settling a lawsuit but should read that we are
following the study which emerged from the Comprehensive Park Plan.
Councilman Hill suggested placing this on the agenda for the Committee
of the Whole Meeting of August 25, 1977. Attorney Hard stated that
the main point as far as timing is to proceed with the title insurance.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE AGENDA BE AMENDED TO
INCLUDE THE PROPOSED RESOLUTION. MOTION CARRIED.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION BE
READ. MOTION CARRIED.
Deputy City Attorney Hard read a resolution authorizing purchase of
park property.
Councilman Hill suggested deleting the portion of Paragraph Two that
starts 'and to dismiss with prejudice the lawsuit' and ends 'cause
number 824877'. Attorney Hard stated that it could be omitted from
the Resolution. It is included in the agreement as it is a genuine part
of the arrangements. Councilman Van Dusen stated that this was submitted
to Council by the Park Board; it wasn't something suggested by Council.
MOVED BY SAUL, SECONDED BY VAN DUSEN, THAT THIS ITEM BE PLACED ON THE
AGENDA FOR THE COMMITTEE OF THE WHOLE MEETING OF JULY 25, 1977.
Attorney Hard reminded Council that it takes approximately 10 days to
two weeks to complete a title search. The owners have shown good faith
and have every right to expect the City to follow through.
Kjell Stoknes stated that they have records of the study documenting
this site as part of the park plan.
Councilman Bohrer stated he would like time to study the resolution and
the agreement.
Councilman Saul stated he supported proceeding with the title search.

of park property In 1976, the Council indicated that acquiring a park site for
Cont. McMicken Heights was their second priority and they instructed the
Park Board to survey the area for a park site. The Park Board studied
five sites and designated this particular property as their No. 1
selection. It was after this that a building permit for that property
was applied for.

Mayor Bauch informed Council that he will be on vacation from July 25
to August 10. He will be accompanying 36 boys to the National Boy
Scout Jamboree on the east coast.
He reminded Council and audience that July 25 is the opening day for
filing for Council positions.
Mayor Bauch announced that on August 22 there will be a public hearing
before the Committee of the Whole Meeting on the possible use of
Revenue Sharing money.
Treasurer's Monthly Councilman Saul read the City Treasurer's report. June income from
Report of Investments investments of $1,500,000 sold was $10,521.42. Purchased investments
amounted to $1,775,000. A large property tax allocation and June sales
tax produced the additional surplus funds to invest.
Councilman Van Dusen expressed concern over the new closing hours of
the Police Station. He recalled that back in February it was stated
that the Police Station would remain open 24 hours. He stated that
low security of the area and booking problem individuals during the
closed hours caused his concern.
Mayor Bauch explained that when the budget was discussed it was the
intention, at that time, that when Valley Communication opened, the
Police Station would discontinue clerical help after 5 p.m. and
resume at 8 a.m. All police will be dispatched from Valley Communicator
There have been only 18 bookings in the last 3 months. It doesn't
warrant round the -clock clerks in the department. He explainted
further that the reason Valley Communication hasn't gone into full
operation is because they haven't received the Federal Communication
Commission License for Renton and Auburn to use the frequency.
Tukwila and Kent are on the same frequenty but Auburn and Renton are
different. Tukwila and Kent started dispatching from the center this
morning.
Councilman Van Dusen protested that this should be looked at more
carefully before a definite decision is made to close the Police Station
Councilman Saul stated he is also concerned about the booking problem.
He noted that when we move into new City Hall, we should have
someone on duty 24 hours again.
Councilman Hill also stated that he would like to see someone there 24
hours so we won't have a security problem.
