REPORTS TUKWILA CITY COUNCIL COMMITTEE OF THE WHOLE MINUTES Tukwila City Hall Council Chambers Council President Hernandez called the Committee of The Whole Meeting to order and led the audience in the Pledge of Allegiance. JOHN MCFARLAND, City Administrator; RON WALDNER, Chief of Police; LARRY HARD MIKE KENYON, City Attorneys; ROSS EARNST, Public Works Director; DOUG MICHEAU, Public Works Coordinator; RON CAMERON, City En!eneer; BOB MCQUEEN, Assistant Police Chief; Acting Assistant Chief HAINES; TOM KEEFE, Fire Chief; JACK PACE, Senior Planner; DON WILLIAMS, Parks Recreation Director. Jack Pace briefed the Council on the proposed revisions to the Adult Entertainment Ordinance. He stated that staff recommends three revisions to the Adult Entertainment Ordinance: 1) Revise stock -in -trade definition to read 30% rather than 10 2) Propose addition of the M -1 and CM zones to the M -2 zone; and, 3) Establish an avenue for administrative appeal for the conformance of non conforming adult uses. Mr. Pace added that the M -1 and CM zoning classifications are proposed additions to the M -2 zone as areas in which adult businesses are permitted. By including these zones, an additional 1071 acres are added to the existing 1148 acres zoned M -2. the 1000 foot buffer from residential zones and uses is retained. As a general category, all commercial industrial zones comprise 2730 acres. Adding the M -1, CM and M -2 zones together brings the total acreage (zoned to allow adult business) to 2219 acres. City Attorney Mike Kenyon stated that the standard is "a reasonable alternative avenue" for adult businesses to locate (alternative to where they are now), and his best estimate as to what a judge will rule is 1500 acres. Thus, by adding the M -1, CM and M -2 zones together (2219 acres) as the staff has proposed, makes it that much more likely that a court will find it to be reasonable. The Council's concerns in the draft ordinance were expressed in the areas of 1) Allowing a use from a less intense zone to exist in a more intense zone while maintaining less intense uses exclusively in those zones; 2) Will the City be placed in a weaker position by adding the M- 1, CM and M -2 zones together. After the Council had conscientiously addressed the recommendations of the Planning Commission (Staff Report), Council President Hernandez asked the Council's pleasure in setting a Public Hearing date. MOVED BY ROBERTSON, SECONDED BY MORIWAKI, THAT THE RECOMMENDED DATE OF SEPTEMBER 17, 1990 BE ACCEPTED TO HOLD A PUBLIC HEARING ON THE REVISIONS OF THE ADULT ENTERTAINMENT ORDINANCE. MOTION CARRIED. Jerry Clark, Arborist, City of Seattle, provided a slide presentation on trees in an effort to educate the Council on how to identify common and botanical names of trees. Lucy Lauterbach stated that an on -site tour of trees is planned for the near future. Council President Hernandez, the Mayor, and Councilmember Robertson did attend the August 9, 1990 Planning Commission meeting. Hernandez reported it was decided at that meeting to reschedule the SAO Public Hearing to August 30, 1990. Committee of The Whole Minutes August 13, 1990 Page 2 Reports (con't) ADJOURNMENT 9:30 p.m. Councilmember Moriwaki reported that Housing Standards, and Community Development Block Grants were among some of the issues discussed at the recent Community Affairs/Parks Committee meeting. Councilmember Ekberg reported that the Finance Safety Committee discussed the donation of a FAX Machine to be used in the Haz -Mat Van; and Underground Tanks. The committee also reviewed regulations for outdoors burning. Councilmember Rants announced that a salmon dinner is being planned for the Council scheduled for September 6, 1990. Don Williams, Parks Recreation Director, reported that he had recently presented to the Technical Review Committee a Grant request for $150,000 to the IAC Agency (a state funding agency for parks projects). Williams stated it looks very promising that this amount will be approved. The City will match this figure for the purpose of developing another phase of the Green River Trail next year. Williams also past out an update report on Crystal Springs Park which noted the proposed date of September 10, 1990 for Council to award bid. City Attorney Larry Hard reported that The City will be receiving $50,000 as a result of World Wide Video being found in contempt of court in the Case of World Wide Video vs. the City of Tukwila.
