City of Tukwila Jim Haggerton, Mayor Parks & Recreation Department Rick Still, Director INFORMATIONAL MEMORANDUM TO: Park Commissioners FROM: Dave Johnson, Recreation Superintendent DATE: August 13, 2014 SUBJECT: DRAFT PARK RULES AND REGULATIONS The Park Rules and Regulations are governed by the Chapter 12.08 of the Tukwila Municipal Code, which was last updated in 1998. For the past 9 months, you have spent time reviewing and suggesting updates and new sections. Enclosed is a draft copy based on the suggestions from the Park Commission as well as the Park and Recreation Staff. This draft is currently being reviewed by other departments, including Police, Fire, and Planning. It is our hope to review these at the August Park Commission meeting and compile your comments along with those from other departments into a draft to be reviewed by the City Attorney before coming back to you at the September meeting for final review. From there, it would go through the council approval process. There will be opportunity for public input at these meetings as well as at council meetings. It is unlawful to plant or install any structure, monument, wall, fence, equipment, bench, table tree, plant, sign or other item in or on park property without approval of the Parks and Recreation Director. (Ord. 1850 §1(part), 1998) 112.08.020 Animals Running at Large Unless otherwise posted, or approved by the Parks and Recreation Director ilt is unlawful to allow or permit any animal to run at large in or on park property- _ - - • a•:ks Department Horses are not permitted in any park except on posted 'bridle trails (Ord. 1850 §1(part), 1998 12.08.030 Motor Vehicle Operations a) Unless otherwise posted, or approved by the Parks and Recreation Director, ilt is unlawful to operate any motor vehicle, motorcycle, tricycle, or bicycle in or on park propertyCity public parks except upon a park drive, parkway, park boulevard, paved roadway or parking lot _ ' - •' (Ord. 1850 §1(part), 1998) b) Unless other posted, or approved by the Parks and Recreation Director, it is unlawful to operate any motor vehicle or motocycle on trails. It shall be unlawful for any person in or on park property y paFl& to feed any wild animal, bird, fowl-1°r fish except as may be authorized by the Parks and Recreation Director. §1(part), 1998) (Ord. 1850 12.08.060 Refuse Deposit It is unlawful to throw or deposit any refuse, -or litter, broken glass, nails, yard waste, junk, or advertising material in or on any park property, except in designated receptacles. It is unlawful to deposit any refuse not generated in the parks in designated park receptacles. (Ord. 1850 §1(part), 1998) 12.08.070 Fires It is unlawful to build any fire in or on park property, except in devices designed to contain such fires provided by the Parks and Recreation Department. Fires are allowed only in designated areas using approved devices. No open fires are permitted. (Ord. 1850 §1(part), 1998) 12.08.090 Facilities Use Reservations Program and activities scheduled by the Parks and Recreation Department have first priority for use of parks and facilities. Otherwise, parks and facilities will be available on a "first -come, first - served" basis, and participants shall yield to the holder of such permit or schedule. Partici.ants with or without a .ermit or schedule shall abide by all rules and regulations and shall not unreasonably interfere with other persons' use of or the city's maintenance or operation of city park facilities. _(Ord. 1850 §1(part), 1998) 12.08.095 ark Hour Unless otherwise posted, or approved by the Parks and Recreation Director, ilt is unlawful for any person to be in or on park propertva public park when it is closed. A park may be closed to public use during certain hours as determined by the Mayor. Unless otherwise posted, public parks are closed from 30 minutes past sunset until 30 minutes before sunrise. (Ord. 1850 §1(part), 1998) 112.08.100 Violation - Penalty Persons in violation of these rules and regulations are guilty of a misdemeanor and upon conviction shall be punished by imposition of a fine of not more than $300.00 and /or imprisonment for not more than 30 days. 1 (Ord. 1850 §1(part), 1998)1 t,.. Minors under the age of 18 are prohibited from possessing, smoking or otherwise using tobacco products in or on en--14kwil,a-putilif park property, at the Tukwila Community Center and the outside at as adjacent to the Center, and at other City facilities. 18. Persons in A- violation of this section is an infraction and the violator isare subject to a civil fine of up to $100.00. A notice of infraction shall be issued and assessed in the same manner as traffic infractions. The provisions contained in Chapter 46.63 RCW for the disposition of traffic infractions apply to the disposition of infractions of this section except as follows: The provisions in Chapter 46.63 RCW relating to the provision of records to the Department of Licensing in accordance with RCW 46.20.270 are not applicable to this section; and b12-: The provision in Chapter 46.63 RCW relating to the imposition of sanctions against a person's driver's license or vehicle license are not applicable to this section. All activities shall comedy current application/approval processes and with all Washington State Liquor Control Board requirements. r5olicitinE, Concessions, Commercial Activities Unless otherwise posted, or approved by the Parks and Recreation Director it is unlawful to do any of the following in or on park property: 1) Sell refreshments or merchandise, or operate a fixed or mobile concession, event, or traveling exhibition. 2) Solicit. sell. offer for sale peddle, hawk any goods or services. 3) Film record, or photograph for commercial purposes. 4) Conduct classes or organized competitions. 5) Distribute any commercial circular notice, leaflet, pamphlet or printed material of any kind 6) Enter upon, use or traverse any portion of a park for commercial purpose, including fund raising andjor fund solicitation. 7) Attach or secure to any vehicle or structure any commercial circular notice, leaflet, pamphlet or printed material of any kind. 8) Use, place or erect any advertising in any park; or to attach any notice bill poster. sign, wire, rod, or cord to any tree, shrub, railing, post or structure within any park; or to place or erect in any park, a structure of any kind. Overnight Camping Unless otherwise posted, or approved by the Parks and Recreation Director, it is unlawful in or on park ro ert to er -ct a tent or shelter or to arran_e beddin- or both for the u .ose of or in such a wa a will permit remaining overnight; or park a trailer, camper or other vehicle for the purpose of remaining overnight. Any vehicle left in a parking stall designated for a municipal park for a period of time exceeding the maximum amount of time permitted asposted, or if a time limit is not posted, then for a period of time exceeding 24 hours, without lawful permission or authority shall be cited with a parking infraction by the Chief of Police or his designee and shall be subject to impound in the same manner as provided in TMC 9.20.090. Any vehicle left in a park, and not in a parking stall, shall be cited with a parking infraction by the Chief of Police or his designee and subject to immediate impounding in the same manner as provided in TMC 9.20.09d. Submit,grievance to the Responsible Official listed above. 2.
