2: No changes shall be made to the approved plans unless approved by the design professional in responsible charge and the
Building Official.
3: All mechanical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center
(206/431- 3670).
4: All permits, inspection records, and approved plans shall be at the job site and available to the inspectors prior to
start of any construction. These documents shall be maintained and made available until final inspection approval is
granted.
5: All construction shall be done in conformance with the approved plans and the requirements of the International
Building Code or International Residential Code, International Mechanical Code, Washington State Energy Code.
6: All wood to remain in placed concrete shall be treated wood.
7: Remove all demolition rubble and loose miscellaneous material from lot or parcel of ground, properly cap the sanitary
sewer connections, and properly fill or otherwise protect all basements, cellars, septic tanks, wells, and other
excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of
this requirement.
8: All construction noise to be in compliance with Chapter 8.22 of the City of Tukwila Municipal Code. A copy can be
obtained at City Hall in the office of the City Clerk.
9: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion. Strapping shall
be at points within the upper one -third and lower one -third of the water heater's vertical dimension. A minimum
distance of 4- inches shall be maintained above the controls with the strapping.
10: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the Cityof Tukwila
Permit Center.
11: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Building
Department (206 - 431 - 3670).
12: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of,
any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits
presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila
shall not be valid. The issuance of a permit based on construction documents and other data shall not prevent the
Building Official from requiring the correction of errors in the construction documents and other data.

15: Maintain coverage and operability of portable fire extinguishers, sprinkler systems and fire alarm systems during
demolition and construction.
16: The total number of fire extinguishers required for an ordinary hazard occupancy with Class A fire hazards is
calculated at one extinguisher for each 1,500 sq. ft. of area. The extinguisher(s) should be of the "All Purpose" (2A,
20B:C) dry chemical type. Travel distance to any fire extinguisher must be 75' or less. (IFC 906.3) (NFPA 10, 3 -2.1)
17: Portable fire extinguishers, not housed in cabinets, shall be installed on the hangers or brackets supplied. Hangers or
brackets shall be securely anchored to the mounting surface in accordance with the manufacturer's installation
instructions. Portable fire extinguishers having a gross weight not exceeding 40 pounds (18 kg) shall be installed so
that its top is not more than 5 feet (1524 mm) above the floor. Hand -held portable fire extinguishers having a gross
weight exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 3.5 feet (1067 mm) above the
floor. The clearance between the floor and the bottom of the installed hand -held extinguishers shall not be less than 4
inches (102 mm). (IFC 906.7 and IFC 906.9)
18: Fire extinguishers shall not be obstructed or obscured from view. In rooms or areas in which visual obstruction cannot
be completely avoided, means shall be provided to indicate the locations of the extinguishers. (IFC 906.6)
19: Extinguishers shall be located in conspicuous locations where they will be readily accessible and immediately available
for use. These locations shall be along normal paths of travel, unless the fire code official determines that the
hazard posed indicates the need for placement away from normal paths of travel. (IFC 906.5)
20: No point in a building may exceed the maximum exit access travel distance listed in Chapter 10, section 1015, Table
1015.1 of the International Fire Code and International Building Code.
21: Minimum widths of corridors shall be maintained in accordance with Chapter 10 of the International Building Code and
the International Fire Code.
22: In Group B and M occupancies, the minimum clear aisle width shall be determined by the occupant load served, but shall
not be less than 36 inches. (IFC 1013.4.1)
23: Egress doors shall be readily openable from the egress side without the use of a key or special knowledge or effort.
(IFC 1008.1.8.3 subsection 2.2)
24: The path of egress travel along a means of egress shall not be interrupted by any building element other than a means
of egress component as specified in this chapter. Obstructions shall not be placed in the required width of a means of
egress except projections permitted by this chapter. The required capacity of the means of egress system shall not be
diminished along the path of egress travel (IFC 1003.6)
25: Door handles, pulls, latches, locks and other operating devices on doors required to be accessible by Chapter 11 of the
International Building Code shall not require tight grasping, tight pinching or twisting of the wrist to operate. (IFC
1008.1.8.1)
26: An approved fire alarm system is required for this project. The fire alarm system shall meet the requirements of
N.F.P.A. 72 and the City of Tukwila Ordinance #2051.
27: All new fire alarm systems or modifications to existing systems shall have the written approval of The Tukwila Fire
Prevention Bureau. No work shall commence until a fire department permit has been obtained. (City Ordinance #2051) (IFC
104.2)
28: Local U.L. central station supervision is required. (City Ordinance #2051)
29: Remote indicator lights are required on all above ceiling smoke detectors. (City Ordinance #2051)
30: The installation of wiring and equipment shall be in accordance with N.F.P.A. 70, Article 760, Fire Protective

31: When the control panel is located inside a room, the door to the room shall have a sign with one -inch letters which
reads "Fire Alarm" or "Fire Alarm Control ". (City Ordinance #2051)
32: Dedicated fire alarm system circuit breaker(s) shall be equipped with a mechanical lockout device. (NFPA 72
(4.4.1.4.2.1))
33: In areas that are not continuously occupied, automatic smoke detection shall be provided at each fire control unit(s)
location to provide notification of fire at that location. (NFPA 72)
34: The reset code for the fire alarm panel or keypad shall be 1- 2- 3 -4 -5. The reset code shall not be changed without
approval of the Fire Marshal. The reset code should be permanently posted at the keypad. (City Ordinance #2051)
35: An electrical permit from the City of Tukwila Building Department Permit Center (206- 431 -3670) is required for this
project.
36: Fire Department lock boxes shall be provided for access to all fire alarm panels and sprinkler risers. The appropriate
key(s) for access shall be placed in the lockbox. Lockbox order forms must be obtained from the Tukwila Fire
Department. The lockbox should be mounted so that it is readily visible and not over 60 inches high. (City Ordinance
#2051)
37: The Tukwila Fire Department has changed keybox manufacturers, from Supra to Knox. Install a fire department Knox
keybox. Contact the Tukwila Fire Prevention Office at 206 - 575 -4407 for ordering information.
38: All electrical work and equipment shall conform strictly to the standards of the National Electrical Code. (NFPA 70)
39: An aisle to and working space shall be provided for each electrical panel. An aisle width not less than 24 inches shall
provide access to the panel and 30 inches of working space shall be provided directly in front of the panel. (NEC
110.26(A) thru F(2))
40: Each circuit breaker shall be legibly marked to indicate it's purpose. (NEC 110 -22)
41: Doors into electrical control panel rooms shall be marked with a plainly visible and legible sign stating "ELECTRICAL
ROOM" or similar approved wording. (IFC 605.3.1)
42: When walls and ceilings are required to be of fire resistive or noncombustible construction, interior finish materials
shall meet the requirements of International Building Code 803.
43: The maximum flame spread class of finish materials used on interior walls and ceilings shall not exceed that set forth
in Table No. 803.5 of the International Building Code.
44: New and existing buildings shall have approved address numbers, building numbers or approved building identification
placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers
shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a
minimum of 4 inches (102mm) high with a minimum stroke width of 0.5 inch (12.7mm). (IFC 505.1)
45: Aboveground gas meters, regulators and piping exposed to vehicular damage due to proximity to alleys, driveways or
parking areas shall be protected in an approved manner. (IFC Ch. 312, sec. 312.1 thru 312.3)

Dear Ms. Marshall:
The undersigned hereby requests an extension of the above referenced
permit. Pursuant to your correspondence dated November 24, 2008 the City
of Tukwila extended the expiration date of the permit "...through February
16, 2009." The reason(s) in support of the additional extension include but
are not limited to the following:
1. Work has commenced pursuant to the permit and is about to be
completed;
2. Inspections have been or are in the process of being requested for
the purpose of finalizing the work under the permit and
documenting the successful completion of the permit's scope of
work.
The previous permit extension granted by the City of Tukwila thwarted the
letter and spirit of the relevant provisions of the building code. As you recall
I spoke with you by telephone on August 18, 2008 to discuss the pending
permit expiration date of August 20, 2008 and to discuss the obstacles the
undersigned had encountered in getting the permit work started. We also
• •
discussed the process for extending the permit expiration date. At that time
you advised me that, pursuant to the codes and custom and practice, permit
extensions were routinely granted provided that the permit holder submitted
a written request outlining the reasons for the need to extend the expiration
date. This information was consistent with your letter dated July 15, 2008
which stated that multiple extensions of the permit expiration date could be
obtained.
I submitted a written request for a permit extension on behalf of New
Horizon Ventures, Inc. which was received by your office via facsimile on
August 18, 2008 and was delivered to your office via Federal Express on
August 19, 2008. There is no dispute that the request for an extension was
made in a timely fashion.
For the next three (3) months there was no response from the City of
Tukwila to this request. By letter dated November 24, 2008 the City of
Tukwila granted the permit extension for one hundred eighty (180) days
from the original expiration date (August 20, 2008). In effect the deleterious
conduct on the part of the City of Tukwila exhausted three (3) months out of
the six (6) month extension. More importantly I had no choice but to instruct
the contractor to "stand- down" during the three (3) month hiatus because I
could not in good conscience ask the contractor to proceed with work until
the permit issue was resolved. As an aside the contractor prudently reminded
me that he was not willing to risk his good standing by beginning work
when the status of the permit was in limbo.
As you know our entire economy has been undergoing unprecedented
turmoil since the latter part of 2008 and continuing on into this year. While
our efforts on the Tukwila property were suspended awaiting the permit
extension our financing for this project became a casualty of the larger

problems facing the credit markets regionally and nationally. Therefore once
the November 24, 2008 letter from your office was received I not only had
to restart the contractor but we also had to secure financing in a drastically
changed world of finance.
Whether the City of Tukwila's actions or omissions in this matter are
the result of intentional conduct, negligence or incompetence is a question
which is beyond the scope of this correspondence. However it is beyond
dispute that, in addition to the previously cited reasons, the City of
Tukwila's actions have been the sole and exclusive cause of unique hardship
for our company. If we had the full benefit of the stated one hundred eighty
(180) day extension there would have been no need to request a further
extension. Therefore the herein requested extension must be granted for all
the reasons outlined but independently because the City of Tukwila's
conduct has undercut our ability to make use of the full extension time
discussed in the November 24, 2008 letter.
I don't think it is necessary to repeat the history of setbacks outlined
in my August 18, 2008 letter that we experienced in getting this project
started. The inexplicable delay in issuing a permit extension which you
described in our telephone conversation as being a routine matter created a
situation where by mid to late November, 2008 I was in the position of
reviving this project almost as if it was starting from scratch.
The City of Tukwila further obstructed our ability to get this project
going again because during the time the permit was in "limbo" the City
commenced a lawsuit against our company seeking damages and injunctive
relief. The existence of that lawsuit scared away any lenders that we were
looking to provide us with the financing to pay for this work. Clearly the
City of Tukwila has an agenda in this matter which is unrelated to applying

the relevant codes in a fair and impartial manner. Those issues are also
beyond the scope of this correspondence except for establishing without any
doubt that this company has experienced circumstances beyond its control.'
Thanks to a truly Herculean effort by Miller and Son Construction and
their team of subcontractors we have been able to substantially complete the
majority of the permit's scope of work. By the time you receive this letter
there should have already been inspections called in and/or completed under
this permit. After consulting with Mr. Miller I can confidently say that the
work covered by the above referenced permit can be completed within the
time frame of an additional extension provided the extension is granted in a
timely fashion. We will continue to work with the City inspectors to quickly
bring this project to completion.
This letter shall also serve to put the City of Tukwila and your
department on notice that work under the above referenced permit has been
commenced and is in progress prior to the February 16, 2009 expiration date
of the permit. Therefore pursuant to applicable codes, the substance of which
has been confirmed in prior correspondence from your office, a permit
extension is automatically granted, even without a specific request, because
of the commencement of the work. Nothing in this letter shall be construed
as an admission that we are required to submit a written request for an
extension now that work is actually going on at the site. The written request
is purely for the sake of redundancy and the undersigned reserves all rights
to raise any and all issues as permitted by applicable local codes or state law.
' This is one of the criteria for a permit extension outlined in your July 15, 2008 letter.
2 Completed work, work in progress, pending and/or completed inspections is independent grounds for
automatically extending the expiration date of an open permit. This fact is confirmed by your July 15, 2008
letter.
I am not sure if you are aware of a letter dated January 16, 2009 sent
by Mr. Robert Benedicto. The undersigned disagrees with and disputes the
conclusions of that letter however that disagreement is more appropriately
voiced in another forum. One point from Mr. Benedicto's letter is relevant in
our dialogue. Mr. Benedicto confirms that once the City is notified that work
has begun under the permit any needed extensions are automatic as long as
"progress" is being made. The City has now been put on notice that work
has started, is in progress and has been or is about to be completed.
Assuming without admitting that there is some valid legal basis to the claims
made in Mr. Benedicto's letter we have satisfied even his artificially
rigorous requirement because anyone can go to the site and see that work is
in progress and about to be completed.

On January 2, 2009, the City automatically mailed you a notice that your building permit
application (D08 -048) will expire on February 16, 2009. The letter noted that you may
be eligible to obtain an extension for the pending building permit. This letter is to inform
you that this automated letter was sent in error and you will not be eligible to obtain an
extension on the subject permit.
The building permit was needed in order to resolve certain building code violations at the
subject property. On February 13, 2008, the City issued a Notice and Order demanding
that the code violations be resolved. The City provided a compliance date of March 21,
2008. The compliance date has long since passed and violations have yet to be resolved.
On August 18, 2008, you requested an extension on the subject building permit. The
City, believing that you were working in good faith to resolve the violations, granted you
an extension until February 16, 2009. According to the City's permit data you have

failed to obtain any required inspections and the City is unaware of any progress made on
the repairs. .
On August 21, 2008, the City filed a complaint for nuisance abatement with King County
Superior Court. The City's compliant asked the court for the following:
1. A judgment in favor of the City against the property owner reflecting civil
penalties.
2. Preliminary and Permanent Injunctions ordering the property owner to cease and
desist all activity on the Property until the building is brought into compliance
with the Tukwila Municipal Code.
3. A judgment in favor of the City for its costs, disbursements, and reasonable
attorneys' fees.
Given that you have failed to answer the complainant, the City is entitled and is prepared
to ask the Court to enter a default judgment in favor of the City. In order to avoid future
legal action, the City expects that all work will be completed by that date and that all
required inspections be obtained.
If the building violations have not been resolved by February 16, 2009, the City will
request that a default judgment be awarded. The City will also request that the Court
enter an order of abatement, granting the City the right to access the property to correct
all building code violations on the property and will request that a tax lien be placed on
the property so that the City can recover all cost associated with resolving the outstanding
violations.
The City hopes that this matter can be resolved by the February 16, 2009 deadline.

Per the International Building Code and/or the International Mechanical Code, every permit issued by the Building Division under the
provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not
commenced within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or
abandoned at any time after the work is commenced for a period of 180 days.
Based on the above, you are hereby advised to:
Call the City of Tukwila Inspection Request Line at 206 -431 -2451 to schedule for the next or final inspection.
This inspection is intended to determine if substantial work has been accomplished since issuance of the permit or last inspection; or if
the project should be considered abandoned.
If such determination is made, the Building Code does allow the Building Official to approve one or more extensions of time for
additional periods not exceeding 90 days each. Extension requests must be in writing and provide satisfactory reasons why

I appreciate the time you took earlier today to speak with me
regarding the above referenced project. This letter is in response to your
correspondence dated July 15, 2008 which advises us of the pending
expiration of the above listed permit and is a request for an extension of that
permit.
As I indicated to you in our telephone conversation the process of
lining up the contractor(s) to do the work contemplated by the permit has
been very challenging. I have notes going back to March, 2008 regarding
different contacts I made to get bids. I have made numerous telephone calls
to different contractors asking them to review the plans and submit a bid.
Multiple copies of the plans have been mailed out and yet it has been
difficult if not impossible to establish a dialogue with a contractor in the
Seattle area. I have never had a longer list of persons/businesses that I called
but who did not return my call. I am surprised by how difficult it is to open a
dialogue for a small construction project when I am located 300 miles away.

I am told that given the smaller nature of this job my ability to elicit a
response depended in large part on whether the party with whom I was
dealing had any bigger job to pursue. In any event I have spent the bulk of
the time that this permit was open trying to line up a contractor to do the job.
I could not have predicted that the duration of the permit would be
consumed lining up someone to do the work. As of about ten (10) days ago
Miller & Son Construction has sent us a bid for the work required by the
permit. My initial contract with Mr. Miller took place in early April, 2008
and, even though he has been great to work with, I have been anxiously
awaiting his bid proposal and his commitment to take on the project. Now
that we have a firm proposal the project can start. As of last week I
instructed Mr. Miller to wait until I had confirmation that the permit was
extended before he started work because there was no way he could
complete the job by the August 20, 2008 deadline.
Mr. Miller has confirmed that he will do the job as per his bid. His
company is licensed and bonded in the State of Washington. If necessary I
can provide you with a letter from him confirming these facts. I hope we can
extend the permit so that work can begin forthwith. As you know the scope
of work in this permit is in response to a request from the City of Tukwila to
upgrade certain aspects of the property. The City's request arrived at our
company through a rather circuitous route because it was sent to the escrow
company through whom we pay our property taxes. As soon as we received
the City's request I went to work to comply. Our company takes pride in the
fact that we work diligently to achieve compliance with the requirements of
any jurisdiction wherein we have property. Our company intends to fully

I regret the delay that has taken place but in going over my notes and
reviewing everything that was done I am fully convinced that the delay was
due to circumstances entirely beyond our control. I never realized the
difficulty I would encounter trying to coordinate a building project from here
in Spokane.
Now that the obstacles to getting the job started have been removed
we respectfully request an extension of the permit so we can complete the
process of complying with the City of Tukwila's requests. Please advise if
there is a fee due for the extension and please direct your response to me at
the below indicated address. I hope this can be handled quickly so we can
give Mr. Miller the "go- ahead" as soon as possible. Thank you for your time

Per the International Building Code and/or the International Mechanical Code, every permit issued by the Building Division under the
provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not
commenced within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or
abandoned at any time after the work is commenced for a period of 180 days.
Call the City of Tukwila Inspection Request Line at 206 -431 -2451 to schedule for the next or final inspection.
This inspection is intended to determine if substantial work has been accomplished since issuance of the permit or last inspection; or if
the project should be considered abandoned.
If such determination is made, the Building Code does allow the Building Official to approve one or more extensions of time for
additional periods not exceeding 90 days each. Extension requests must be in writinM and provide satisfactory reasons why
circumstances beyond the applicants control have prevented action from being taken.
In the event you do not call for the above inspection and receive an extension prior to 08/20/2008 , your permit will become null and
void and any further work on the project will require a new permit and associated fees.
