TUKWILA CITY COUNCIL SPECIAL MEETING MINUTES Tukwila City Hall Council Chambers Council President Robertson called the Special Meeting of the Tukwila City Council to order. DENNIS ROBERTSON, Council President; JOAN HERNANDEZ, CLARENCE MORIWAKI, ALLAN EKBERG, STEVE LAWRENCE, JOHN "Wally" RANTS. MOVED BY MORIWAKI, SECONDED BY LAWRENCE, TO EXCUSE JOE DUFFIE FROM COUNCIL MEETING DUE TO HIS TWO -WEEK ANNUAL TRAINING DUTY WITH THE MILITARY. MOTION CARRIED. MOVED BY MORIWAKI, SECONDED BY LAWRENCE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Mike Kenyon read an ordinance of the City Council of the City of Tukwila, Washington, regulating development on sensitive areas and buffers; amending Ordinance Nos 1247 and 1289 and Tukwila Municipal Code (TMC) Title 18; amending Ordinance Nos. 1331 and 1334 and TMC Title 21.04; amending Ordinance No. 1014 and TMC Title 17; and providing for an effective date. MOVED BY ROBERTSON, SECONDED BY MORIWAKI, THAT ORDINANCE NUMBER 1599 BE APPROVED AS READ.* M. Catherine Harris, 5610 South 141st Street, submitted a letter addressed to the members of the Tukwila City Council expressing her disfavor with the SAO proposal, stating (in summary) that the SAO addresses Zoning Code and other laws of the City, but not the City's Comprehensive Land Use Plan. Additionally, the letter touches upon the fact that the City's Comp Plan must be adopted by July 1, 1993 consistent with the goals of the Growth Management Act of 1990 (RCW 36.70A). Mrs. Harris' letter concluded with the following recommendation: "I recommend that before you adopt this proposed legislation that you stop, read, and understand the Act and the Guidelines to ascertain whether or not you are doing this correctly." Councilmember Rants responded that he would liked to have reviewed Mrs. Harris' comments during previous discussions of the SAO. To bring it before the Council at this late date does not allow appropriate time for responding. Council President Robertson commented that the process used to address the SAO was incredibly open to the public; and for Mrs Harris to be able to voice her concerns at this time is ample proof that the Council and the Administration is open and accessible to its constituency. Robertson added that the Council and Administration Page 8, Item 4: Variation of Standard, etc. 4a, The DCD Director may reduce the standard wetland /watercourse buffers on a case -by -case basis if the buffer does not contain 15% or greater slopes. Page 9 When an applicant submits an appliaton for any building permit, subdivision, short subdivision or any other land use review which approves a use, development or future construction, the location of any sensitive areas and buffers on the site shall be indicated on the plans submitted. 1. The DCD Director may waive any of the following if the size and complexity of the project does not warrant a step in the procedures: 1. Para 1 2. Para 4 3. Robertson concluded his remarks by praising the Council and the City Staff for the many hours and weekends they had given up to devote solely to the Sensitive Areas Ordinance. Robertson stated that this is by no means perfect legislation, but it is the Council's best effort. Councilmember Ekberg commented that we may have been slow in the process but it was because the Council wanted to involve the citizens; and to really "sank their teeth" into Tukwila's needs and not just adopt an existing ordinance used by other governing agencies as some cities did. Councilmember Hernandez commented that the Council did listen, made changes where needed and have tried to make the SAO as acceptable as possible to the populace. Hernandez added that through the test of time amendments may have to be made, but the process to this point was an earnest one. Councilmember Moriwaki commented that the process needs no defending because it was done very openly, and gained input from all interested parties. Moriwaki stated that he and Robertson initiated this form of citizen participation to try to protect the quality of life and the character that makes the Tukwila community unique. 1, 1 After much discussion, the Council agreed to adopt the Sensitive Areas Ordinance as amended per ATTACHMENT "A Due to Councilmember Duffle's military commitment, he informed the Council (via letter): "If I was at the meeting, I would vote "NO" vote on passage of the SAO. I believe in what the SAO is trying to do, but I disagree with the way the Council went through it without allowing citizens to comment on it as we went along." *MOTION CARRIED.
