Mayor VanDusen called the Regular Meeting of the
Tukwila City Council to order and led the audience in
the Pledge of Allegiance.

MOVED BY MORIWAKI, SECONDED BY ROBERTSON, THAT
COUNCILMEMBER DUFFLE BE EXCUSED. MOTION

Colleen Anderson, 12630 34th Ave So., voiced her disapproval of the
exclusion of "pit bulls" from the dog show being held as part of the
Tukwila Days celebration. She added that Don Williams, Parks
Director, has assured her that the show is open to all dogs on leash and
under control.

Councilman Ekberg requested that the minutes of 6/18/90 be removed
from the Consent Agenda.

Mayor VanDusen opened the public hearing at 7:10 p.m.
Rick Beeler briefly outlined the petitioner's request to apply for a
short plat at the Tukwila Pond development in order to divide
developed land from undeveloped land. Joel Benoliel,
Partner /Spieker Partners, stressed their need to obtain a waiver as a
prerequisite to the release of their construction mortgage on the
property. As Tukwila Pond is a large wetland, and development on
the site is regulated by the Draft Sensitive Areas Ordinance, after a
lengthy discussion it was determined that Attorney Colgrove would
review the current draft of the SAO and draft an agreement for the
variance to the moratorium for proposal to Council.

to Council by next week.
MOVED BY ROBERTSON, SECONDED BY LAWRENCE, TO
POSTPONE A DECISION UNTIL THE ADMINISTRATION
COMES FORWARD WITH A DRAFT AGREEMENT.*
Glen Amster, attorney for Spieker Partners, commented that the
applicant had already signed an agreement with regard to the
continuation of the SEPA process. He envisioned that an agreement
waiving the moratorium would include similar language. Attorney
Colgrove clarified that the agreement would be similar but would
address the concerns discussed tonight.

The public hearing was opened at 7:58 p.m. Rick Beeler explained
that the petitioner proposes a single family development at the S.W.
corner of Slade Way and So. 160th. The property is in an area of steep
slopes and high landslide and erosion potential. The applicant wishes
a waiver to proceed with a short plat and a boundary line adjustment
to create 5 lots. A geotechnical study is critical to either the number of
lots or the exact placement of lots or the placement of the roads.
Leroy Lowe, 410 Bellevue Way S.E., explained that the waiver is
needed so that the purchase and sale agreement can close by July 15.
They are unable to obtain financing with the moratorium in effect;
non refundable funds were put up for the purchase.
MOVED BY ROBERTSON, SECONDED BY LAWRENCE,
THAT THE WAIVER BE APPROVED SUBJECT TO THE
APPLICANT FILING AN AGREEMENT TO CONFORM TO THE
ADOPTED SENSITIVE AREAS ORDINANCE AND PROCEED
AT THEIR OWN RISK AND EXPENSE.*
Rick Beeler and Councilman Robertson discussed that the applicant
must go through a waiver for each stage, i.e., permit by permit.
MOVED BY EKBERG, SECONDED BY ROBERTSON, THAT
THE MOTION BE APPROVED WITH THE CONDITION THAT
THE SUB -PLOT ITSELF, NOT CONSTRUCTION OF STREETS
OR CONSTRUCTION OF GRADING, IS AUTHORIZED BASED
ON A GEOTECHNICAL STUDY. ANY STEPS BEYOND THAT
WOULD REQUIRE FURTHER WAIVER REVIEW..
Councilman Ekberg explained that this procedure would allow the
potential purchaser of the property to know that they are going
through the sub -plot process, and as a result of a geotechnical study,
the applicant will be able to identify the number of plots he'll get as a
result of the waiver.
Rick Beeler clarified that the short plat is not final until after the SAO
is passed and staff reviews it and certifies that it conforms to the
ordinance.

waterworks utility of the City, including the
system of sewerage as a part thereof; amending
Ordinance No. 1337 as amended by Ordinance No.
1408 and Ordinance No. 1413, providing for the
issuance of $1,030,000 principal amount of water
and sewer revenue bonds, 1990, of the City for
the purpose of providing funds to pay the costs
of completing a portion of the system or plan of
additions to and betterments and extensions of
the waterworks utility of the City adopted by
Ordinance No. 1337, as herein amended, and to pay
costs of issuing the bonds; fixing the date,
form, maturities, interest rates, terms and
covenants of such bonds; providing for the sale
and delivery of such bonds Shearson Lehman Hutton
Inc., Seattle, Washington; and repealing Section
9 of Ordinance No. 1408 and Sections 3 and 4 of
Ordinance No. 1413.
MOVED BY HERNANDEZ, SECONDED BY MORIWAKI,
THAT THE ORDINANCE BE ADOPTED AS READ.*
Finance Director Alan Doerschel explained that to borrow the money
for six years the interest on a six year bond will be about 6.5 The
bonds are callable and can be paid off at the end of three years. Mr.
Doerschel clarified that the ordinance is still in its draft form and is not
ready for passage tonight.
Councilmember Hernandez withdrew her motion.
MOVED BY ROBERTSON, SECONDED BY HERNANDEZ,
THAT A SPECIAL MEETING BE HELD ON JULY 9 FOR THE
PURPOSE OF CONSIDERING THE PROPOSED BOND
ORDINANCE. MOTION CARRIED.

8:55 9:08 p.m. The meeting was called back to order with
Councilmembers in attendance as listed above.
NEW BUSINESS Mayor VanDusen explained that the administration is asking for
Cascade View/Mid Year authorization to proceed with the hiring of five police officers so that
Positions they can be trained by the September 1 acceptance date. He added
that he would like to move the position of Associate Planner to a lower
emergency category and deal with it under future legislation. After
discussion, Council agreed that it was important to proceed with the
Urban Environmentalist position as soon as possible.
MOVED BY MORIWAKI, SECONDED BY LAWRENCE, TO
APPROVE THE FIVE POLICE OFFICER POSITIONS AND THE
URBAN ENVIRONMENTALIST POSITION AS ORIGINALLY
PROPOSED BY COUNCILMAN RANTS.*
Police Chief Ron Waldner clarified that the request included a sixth
law enforcement position, that of a Patrol Lieutenant
MOVED BY MORIWAKI, SECONDED BY RANTS, TO AMEND
THE MOTION TO READ SIX POLICE OFFICER POSITIONS.
MOTION CARRIED.
Council resumed their discussion regarding the Urban
Environmentalist. It was determined that the position needs to be
clarified before it is authorized. Councilman Moriwaki withdrew his
motion approving the Urban Environmentalist position. The subject
will be discussed further in the Community and Parks Committee.
Councilman Moriwaki stressed the importance of this position and the
desire to move ahead with the authorization as quickly as possible.

concerning the AWC conference, the name Lawrence be changed to
Ekberg.

APPROVE THE MINUTES OF JUNE 18, 1990, AS AMENDED.
MOTION CARRIED.
John McFarland reported that Wendy Morgan has submitted her final
human services draft. Copies will be distributed to Council by the end
of the week. The Georgette Group has submitted their final study on
library services. Copies of the study as well as an executive summary
will be distributed to Council.
Councilman Rants reported on the trip to Southgate creek with Joe
Robbles and the possibilities for the proposed drainage system at the
site.

THAT COUNCIL ADJOURN TO EXECUTIVE SESSION.
