AN ORDINANCE OF THE CITY OF TUKWILA, WASHING-
TON, AMENDING THE TUKWILA TRAFFIC CODE, TITLE
9 OF THE TUKWILA MUNICIPAL CODE, BY ADDING
THERETO A NEW SECTION 9.40.070 PROHIBITING
INATTENTIVE DRIVING AND PROVIDING THE PUNISH-

THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. The Tukwila Traffic Code, of the Tukwila
Municipal Code, is hereby amended by the addition of a new
Section 9.40.070 thereto to read as follows:
9.40.010 INATTENTIVE DRIVING. It is unlawful for
any person to operate a motor vehicle within the
City in an inattentive manner. For the purposes of
this Section, "inattentive manner" means the opera-
tion of a motor vehicle in a manner which evidences
a lack of the degree of attentiveness required to
safely operate the vehicle under the prevailing
conditions, including but not limited to the nature
and condition of the roadway, presence of other
traffic, presence of pedestrians and weather condi-
tions. The offense of operating a motor vehicle in
an inattentive manner shall be considered to be a
lesser offense than, but included in the offense of
operating a motor vehicle in a negligent manner.
Section 2. This ordinance shall be in full force and
effect five (5) days after passage and publication as pro-
vided by law.
