Ordinance No. 353
AN ORDINANCE relating to the scope of existing electric
public utility franchises within the boundaries of the City, estab-
lishing and limiting the service areas of the same for the health,
safety and welfare of the public.
BE IT ORDAINED:
WHEREAS, non exclusive electric public utility franchises
have heretofore been granted various electric public utilities per-
mitting the use and occupancy of the City's real properties under
certain circumstances, and
WHEREAS, IT appears that an overlap or duplication of
service areas would in all probability result in a duplication of
electrical towers, poles, wires, transformers and substation
facilities in and about said properties creating increased danger
and hazard to the person andfroperty of the public without attendant
increase in service or economy, and
WHEREAS, AN establishment of defined service areas for
the various electrical public utilities would lessen the duplication
and increased hazards as well as the potential duplicate burden upon
City's properties,
NOW, THEREFORE,
(1) It is hereby declared to be the policy of the City
that all electric public utilities heretofore or
hereafter franchised shall exclusively serve such
area within the city as shall be determined by the
city council to be consistent with the health,
safety and welfare of the public in the elimination
of duplicate electrical installations, attendant
hazards and burden upon the city's various real
property.
(2) Those electric public utilities now franchised
shall be, and by this ordinance are, granted
exclusive service areas consisting of such areas
within the city limits as they exclusively served
on January 1, 1962.
(3) Every electric public utility shall, within
Sixty (60) days of the first publication of
this ordinance, file with the City Clerk a
map showing the boundary of all areas within
the City in which such utility actually, ex-
clusively served consumers on January 1, 1962.
Unless controverted by an interested citizen
or another such utility within 30 days of filing
such map shall conclusively determine the estab-
lished service area of the filing utility.
(4) No electric public utility shall hereafter be
permitted to establish any facility pursuant
to its franchise for the purpose of serving
any area now or hereafter established as the
exclusive service area of another electric
public utility.
(5)
Any area actually served by any two or more
franchised electric public utilities on January
1, 1962, shall be and remain the common service
area of both unless or until such service shall
be discontinued by any such utility for 30 days
or more, in which case such discontinuing utility
shall thereafter be deemed to be excluded from
service such area.
(6) The boundaries of service areas shall in every
instance follow the exterior property line of
the consumer actually served. In the event of
any dispute among utilities the location and
boundary of service areas shall be investigated
by the City Engineer and reported to the City
Council. The Council shall hear the engineer's
report together with any evidence submitted to
the engineer by any interested person and shall,
by ordinance, determine and locate such boundary.
(7) Should any common service area of two or mare
electric public utilities exist wherein any such
utility shall be excluded as provided in Paragraph
(5) above, then such excluded utility shall within
30 days of such exclusion abate and remove any
electrical equipment or facilities which serve
only the area from which it was thereby excluded,
it being the purpose of this provision that hazards
arising from the continuation of such facilities be
abated as soon as is reasonable.

(8) Should any part or portion of this ordinance be
invalid, all of the rest and remainder shall
continue in full force and effect.

IN THE
CITY OF TUKWILA
The area in the City of Tukwila served by Puget Sound Power Light Company is de-
scribed in 2 parcels as follows:
1. That area bounded on the North by South 139th Street from the right-
of-way of the Chicago, Milwaukee, St. Paul Pacific Railroad West
to 55th Avenue South and the Northerly line of the Renton branch of
the right -of -way of the Chicago, Milwaukee, St. Paul Pacific Rail-
road; on the West by the following described line; beginning at South
139th Street and 55th Avenue South; thence South to South 142nd Street;
thence West to 53rd Avenue South; thence South on 53rd Avenue South to
South 147th Street; thence East to the East line of Lot 13 of Seattle
Land Company's acre tracts on South 147th Street; thence South on the
East line of Lots 9 to and including Lot 13 of the above dlat to the
South line of said Lot 9; thence 'Wrist to the Macadam Road; thence South-
easterly along the Macadam Road to the East line of Lot 1 of Cedar Lodge
Addition, extended North; thence South along the last described line
and continuing South along the East line of Lots 9 to and including
Lot 14 in Brookvale Garden Tracts to a point on the South line of
Section 23, Township 23 North, Range 4 East, W.M.; on the South by an
East West line coinciding with the South line of above Section 23 and
extended East and West; and on the East by the East city limits of the
City.
2. Also that area within the City of Tukwila South of a line through the
South line of Section 23, Township 23 North, R -nge 4 East, W.M. extended
East and West.
