Dedication of 20 feet of right-of-way along the east side of the property for future access is to be
provided with the provision that the property value will be credited against the proportionate fair •
share cost for future street improvements.
Emergency access, cumulative neighborhood development traffic impacts including the new lots
created by this short plat on existing South 150th Street, the adjoining neighborhood and
neighborhood traffic circulation are the reasons for the connection between South 150th Street to
South 152nd Street. The connection wM provide alternate access and result in access streets
functioning as access streets instead of driving South 150th Street to a collector arterial status.
Public Works approval of this shortplat is based on the approved lots having adequate access and not
impacting the existing neighborhood.

Street Improvement
Proportional Fair Share Agreement
The proposed Easter short plat creating two new lots will increase the cumulative traffic emergency
accessibility need and increased neighborhood access street traffic volumes. An access street on the 48
Ave S alignment between S 150 St and S 152 St will provide alternative emergency access, neighbor-
hood traffic circulation that distributes volumes, and provide for the access streets functioning at access
street use.
An access street connecting S 150 St and S 152 St will mitigate the impacts by providing two emergency
access routes and distributing neighborhood access traffic and providing for utilities including drainage
and undergrounding.
Owner of the above development agrees to:
1. Dedicate 20 feet of right -of -way along the eastern side of the short plat for street and
utility use.
2. Pay a proportionate share of the 48 Ave S (S 150 St - S 152 St) construction costs
based on the number of lots and be credited the value of the dedicated right -of -way
against these costs.
3. Will waive the right to protest the formation of an L.I.D. for the improvements
which includes the proportionate fair share conditions of item 2.

This agreement shall be binding upon the parties, their respective heirs, legal representatives, assignees,
transferees and successors, and runs with the land.
This agreement shall be recorded by the City Clerk with the King County Auditor as required by 12CW
Chapter 35.91, and the cost of said recording will be paid by the City.
So that the owner can remove encumbrances from the property caused by this requirement, the Owner
can pay the City the Owner's pro -rata share for projected costs. These costs will be made available to
the Owner upon written request to the Public Works Director.
